Nonwovens

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) is satisfied that the request (Request No. TR-97-014) received from Lenrod Industries Ltd. (the requester) of Saint-Laurent, Quebec, is properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of nonwovens, consisting of polypropylene staple fibres mixed solely with polyester staple fibres, thermally bonded (area bonded) on one side and thermally bonded or thermally embossed (point bonded) on the other side, to be cut to customers' specific size requirements, then rewound and packaged, for use in the manufacture of furniture, mattresses and mattress supports (box springs) [the subject nonwovens].

The Tribunal will conduct an investigation under section 19 of the Canadian International Trade Tribunal Act into the appropriateness of reducing or removing the customs duty on importations of the subject nonwovens, which are classified under tariff item No. 5603.93.90.

The Tribunal's investigation was commenced on June 3, 1998, and will be conducted by way of written submissions. To participate in the Tribunal's investigation, the requester or an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before June 25, 1998. The Tribunal's recommendations to the Minister of Finance are scheduled to be issued by October 1, 1998.

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) is satisfied that the request (Request No. TR-97-011) received from Australian Outback Collection (Canada) Ltd. (the requester) of Vancouver, British Columbia, is properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of woven fabrics, plain weave, solely of cotton, containing two-ply yarns, impregnated with materials that are not predominantly plastic or rubber, weighing not less than 250 g/m but not more than 400 g/m, valued at $4.50/m or more, for use in the manufacture of coats, jackets or hats (the subject fabrics).

The Tribunal will conduct an investigation under section 19 of the Canadian International Trade Tribunal Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabrics, which are classified in subheading No. 5209.31 or 5907.00.

The Tribunal's investigation was commenced on June 5, 1998, and will be conducted by way of written submissions. DETERMINATION

Scientific Instruments

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-97-045) on May 8, 1998, with respect to a complaint filed by Flolite Industries (the complainant), under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), as amended by the North American Free Trade Agreement Implementation Act, S.C., 1993, c. 44, concerning Solicitation No. W8485-7-SC15/A of the Department of Public Works and Government Services (the Department). The solicitation was for a quantity of videoprobes, model XL615SYS, including videoprobe tip adapters, models XT6100 SG and XT6100FG, "Everest Imaging," or equivalent, for the Department of National Defence.

The complainant alleged that the Department had accepted a proposal offering a product that was not equivalent to that specified.

Having examined the evidence presented by the parties and considered the provisions of the North American Free Trade Agreement and the Agreement on Internal Trade, the Tribunal determined that the complaint was not valid.

The solicitation is for a safety management program. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into this complaint.

It is alleged that the Department conducted the evaluation of proposals in a manner that was inconsistent with the Request for Proposal and that was biased in favour of the contract awardee.

Maritime Broadcasting System Limited (MBSL)

For authority to acquire the assets administered by the trustee, Mr. David Doyle, and for broadcasting licences to continue the operation of the (radio) programming undertakings CFBC and CJYC-FM Saint John, upon surrender of the current licences issued to Fundy Cable Ltd./Ltée (Fundy), under the same terms and conditions as the current licences. It should be noted that these assets were part of a series of transactions between Fundy, MBSL and Newcap Inc. (Newcap). In Decision CRTC 97-639, the Commission approved MBSL's applications to acquire the assets of the radio programming undertakings CFBC and CJYC-FM Saint John from Fundy, on behalf of Newcap, as well as Newcap's applications to acquire the assets of these undertakings, pursuant to an assignment agreement entered into with MBSL, and for broadcasting licences to continue the operation of CFBC and CJYC-FM Saint John. However, a trust arrangement was determined necessary when Newcap indicated its intention of not finalizing the transaction with MBSL and because of contractual obligations imposed on MBSL by Fundy.

For a broadcasting licence to carry on a low-power FM (radio) programming undertaking at Iqaluit, operating on a frequency of 93.3 MHz (channel 227) with an effective radiated power of 100 watts. This application is submitted by the CBC, acting as an agent for the Atmospheric Environment Service of Environment Canada. The applicant states the program content from Iqaluit Weatheradio will consist of regularly updated weather information tailored to the interests and needs of local listeners in the Iqaluit and Frobisher Bay area.
