TOXIC SUBSTANCES MANAGEMENT POLICY

Notice concerning the confirmation of "Track 1 substance" status for Aldrin, Chlordane, DDT, Dieldrin, Endrin, Heptachlor, Hexachlorobenzene, Mirex, PCBs, Polychlorinated dibenzo-p-dioxins, Polychlorinated dibenzofurans, and Toxaphene, as determined by assessment of these substances against the Track 1 criteria of the Toxic Substances Management Policy

The Toxic Substances Management Policy (TSMP) outlines the federal government's approach to the management of toxic substances. The TSMP was developed to strengthen the protection of human health and the environment, and serves to provide guidance and improved consistent approach to the assessment and management of substances by the federal government. The Policy presents a management framework based on two key objectives: virtual elimination from the environment of toxic substances that are persistent, bioaccumulative, and primarily the result of human activity (Track 1), and life-cycle management of other toxic substances and substances of concern to prevent or minimize their releases into the environment (Track 2). The Policy commits the federal government to identify candidate substances for virtual elimination from the environment and to consult the public in the decision process. The federal government will engage stakeholders involved in the generation, release or use of confirmed Track 1 substances in order to propose domestic and international actions to protect the health of Canadians and the environment from these substances.

Scientific Justifications

Available scientific information covering the physical and chemical properties, environmental fate, and toxicity of Aldrin, Chlordane, DDT, Dieldrin, Endrin, Heptachlor, Hexachlorobenzene, Mirex, PCBs, Polychlorinated dibenzo-p-dioxins, Polychlorinated dibenzofurans, and Toxaphene has been reviewed. Summaries of these reviews have been prepared in the form of scientific justifications describing how the criteria for management under Track 1 of the Policy are met. These scientific justifications may be obtained from the Green Lane, Environment Canada's Web site on the Internet (http://www.ec.gc.ca/cceb1/eng/ tsmp.htm), or from the Director, Commercial Chemicals Evaluation Branch, Department of the Environment, Ottawa, Ontario K1A 0H3.

Public Comment Period

By publishing a notice in the Canada Gazette on March 22, 1997, the federal government announced the beginning of a 60-day public comment period, thereby offering interested parties the opportunity to comment on the scientific justifications. Any person was invited to submit, in writing, scientific evidence objecting to or supporting the analyses and the conclusions presented in the scientific justifications. After careful consideration of the submissions made in this regard, it was concluded that the evidence presented did not affect the assessment of these substances as meeting the Track 1 criteria of the Toxic Substances Management Policy.

Confirmation as Track 1 Substances

Based on analyses presented in the scientific justifications and after consideration of the comments received during the public comment period, the Minister of the Environment confirms that these substances meet the criteria for management under Track 1 of the Policy, and that they should be virtually eliminated from the environment.

Notice is hereby given that, pursuant to the provisions of Part VI of the Canadian Environmental Protection Act, Permit No. 4543-2-04181 is approved.

1. Permittee: Department of Public Works and Government Services, Quebec Region.

2. Type of Permit: To dump or load dredged material.

3. Term of Permit: Permit is valid from July 16 to November 30, 1998. Between July 16 and 31, 1998, the Permittee must comply with the conditions set out in the first paragraph of article 12.

4. Loading Site(s): L'Anse-à-Brillant Harbour, 48°43.27' N, 64°17.37' W (NAD 83).

5. Dump Site(s): (a) Disposal Site ABR-1, 48°43.92' N, 64°16.92' W (NAD 83); and (b) L'Anse-à-Brillant Harbour, 48°43.27' N, 64°17.37' W (NAD 83).

6. Route to Dump Site(s): (a) A distance of 1.5 km north of the L'Anse-à-Brillant wharf; and (b) Not applicable.

7. Equipment: Clamshell dredge or hydraulic shovel, towed scow, steel beam or scraper blade.

8. Method of Dumping: (a) Dredging will be carried out with a clamshell dredge or a hydraulic shovel and dumping will be carried out with a towed scow; and (b) Levelling of the seabed by a steal beam or a scraper blade.

9. Rate of Dumping: As required by normal operations.

10. Total Quantity to be Dumped: Not to exceed 4 500 m3 scow measure.

11. Material to be Dumped: Dredged material consisting of sand, silt, clay and colloids, and gravel.

12. Requirements and Restrictions: Between July 16 and 31, 1998, before commencing any dredging operation with ocean dumping, the Permittee must consult Fruits de mer Malbaie, P.O. Box 846, L'Anse-à-Brillant, Gaspé, Quebec G0C 1R0, and agree in writing to a period of operations that will avoid any alteration to the water quality in two sea water intakes that may be affected by suspended sediments caused by dredging operations. The above-mentioned sea water intakes are the property of the company and feed lobster hacheries during fishing season.

It is required that the Permittee report in writing to the Regional Director, Environmental Protection, Department of the Environment, Quebec Region, 105 McGill Street, 4th Floor, Montréal, Quebec H2Y 2E7, at least 48 hours prior to the first dumping operation pursuant to this permit. The Permittee shall submit a written report to the Regional Director within 30 days of the expiry of the permit. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit, the equipment used, and the dates on which the loading and dumping activities occurred.

It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

A copy of this permit must, at all times, be kept aboard any vessel involved in the dumping operations.

The Permittee must complete the Registry of Ocean Dumping Operations as provided by the Department of Environment. This registry must, at all times, be kept aboard any vessel involved in the dumping operations and be accessible to inspectors designated under the Canadian Environmental Protection Act.

The Permittee must signal the Coast Guard station at Rivière-au-Renard immediately before leaving port to begin disposal operations at the dump site. The Permittee must record these communications in the registry mentioned in the previous paragraph.

The Permittee shall mark out the dump site with buoys for the entire duration of dumping operations.

The loading or ocean dumping referred to under this permit shall not be carried out without written authorization from the Permittee.

12. Requirements and Restrictions:

12.1. It is required that the Permittee notify in writing, by facsimile or electronic mail, Mr. Adrian MacDonald, Environmental Protection Branch, Department of the Environment, Atlantic Region, Queen Square, 4th Floor, 45 Alderney Drive, Dartmouth, Nova Scotia, B2Y 2N6, (902) 426-3897 (Facsimile), adrian.macdonald@ec.gc.ca (Electronic mail), at least 48 hours prior to each occasion that dredging equipment is mobilized to the loading site. The notification shall include the equipment to be used, contractor, contact for the contractor, and expected period of dredging.

12.2. A written report shall be submitted to Mr. Adrian MacDonald, identified in paragraph 12.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit, the equipment used and the dates on which the loading and dumping activities occurred.

12.3. It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

12.4. The Permittee shall notify in writing Mr. Ernest Ferguson, Department of Fisheries and Oceans, P.O. Box 3420, Main Station, Tracadie-Sheila, New Brunswick E1X 1G5, (506) 395-3809 (Facsimile), at least 48 hours prior to the commencement of the first dredging operation.

12.5. The Permittee shall implement the mitigative measures identified in Part D of Environmental Screening for Loggiecroft Channel Dredging (May 1998) submitted in support of the permit application. Modifications to the mitigative measures shall be made only with the written approval of Environmental Protection Branch, Department of the Environment.

12.6. Project vessels shall use only the main navigation channels and shall have well muffled vessels. Project vessels shall not approach concentrations of seaducks or waterfowl when anchoring equipment, accessing wharves, or ferrying supplies.

12.7. A copy of this permit and documents and drawings referenced in this permit shall be available on-site at all times when dredging operations are underway.

12.8. The dredging and ocean dumping authorized by this permit shall only be carried out by the Permittee or by a person with written approval from the Permittee.

12.9. The Permitee shall submit a copy of the written approval, by facsimile or electronic mail, to Mr. Adrian MacDonald, identified in paragraph 12.1, within 24 hours of approving another person to conduct the dredging and ocean dumping authorized by this permit.

Food and Drug Regulations Amendment to Division 9

This notice is to provide the public with an opportunity to comment on a proposal to amend Division 9 of the Food and Drug Regulations. It is proposed that the amendment would permit the sale of a 650 mg sustained release dosage form of acetaminophen.

Currently, the standard dosage unit for acetaminophen specified in Division 9 of the Food and Drug Regulations is 325 mg. This limit does not permit for the marketing of an analgesic product which contains two adult standard dosage units (650 mg) of acetaminophen. The current Regulations allow that two 325 mg units be used as a single dose level of 650 mg of acetaminophen while prohibiting the sale of a 650 mg unit. This unnecessarily restricts the availability of this dosage form. This amendment would permit manufacturers to sell sustained release acetaminophen products that contain a total of 650 mg acetaminophen and allow consumers access to a 650 mg dosage unit of acetaminophen, without compromising current safety standards.

Division 9 of the Regulations was introduced in the mid 1980s in order to establish standard dosage sizes for non-prescription analgesics. The requirements set out the appropriate conditions for sale of these products, including restrictions on their sale, dosages for children and adults, package sizes, labelling and advertising.

In addition to the publication of this notice, a copy of this proposal was sent directly to the affected stakeholders. These include the pharmaceutical industry associations, Registrars of Pharmacy and Medicine, and provincial deputy ministers of Health.

This proposal is also posted on the Health Canada, Therapeutic Products Programme, Web site under "Drugs, Schedule Amendments, Early Consultation" (http://www.hc-sc.gc.ca/hpb-dgps/ therapeut/drhtmeng/schedule.html#early). Once comments are received and evaluated the Therapeutic Products Programme will proceed with a proposal to amend the Regulations. The effective date of this proposal to amend the Regulations will be the date of registration thereof with the Clerk of the Privy Council.

Notice No. DGTP-011-98 — Spectrum Utilization Policy in the Frequency Range 944-960 MHz

The purpose of this notice is to announce the release of the spectrum utilization policy for the use of the frequency bands 944-952 MHz and 953-960 MHz. This policy follows the July 1996 release of a policy proposals paper entitled Designation of Spectrum for Cordless Telephones and Proposals for the Future Use of the Bands 944-952 MHz and 953-956 MHz (Canada Gazette Notice No. DGTP-006-96).

The spectrum utilization policy addresses the issues of the future use of parts of the frequency bands referenced above for cordless telephones, wireless local loop applications, and fixed radio service links to support Studio-to-Transmitter Links.
