ANALYSIS STATEMENT

Description

The Air Services Charges Regulations (ASCRs) are made by the Minister of Transport to impose charges for the use of air facilities or services provided by or on behalf of the Minister.

In 1994, the Department of Transport released its National Airports Policy (NAP). Under this policy, the Government will maintain its role as regulator but will change its role from airport owner and operator to that of owner and landlord. The Government will retain ownership of 26 airports identified as part of the National Airports System (NAS airports). However, these airports will be leased to Canadian Airport Authorities who will be responsible for their financial and operational management. Ownership of regional/local and other smaller airports will be transferred to regional interests. Remote airports which provide exclusive, reliable year-round access to isolated communities and which currently receive federal assistance will continue to be supported.

With certain exceptions (e.g. remote airports and the Airports Capital Assistance Program), federal subsidies for airport operations are to be phased out gradually commencing in 1995-96 and terminating March 31, 2000. To facilitate the changes proposed under the NAP, the Department is continuing with cost reduction initiatives and changes to existing user charges in order to make the national airports system and regional/local airports financially self-sufficient.

It is recognized in the policy that some adjustments to the principle of financial self-sufficiency may be required given the capital requirements of NAS airports. An independent financial advisor has recommended that the Department implement multi-year increases for nine NAS airports, extending some beyond March 31, 2000. This measure was recommended in order to provide the necessary financial conditions to complete the remaining airport transfers.

With this amendment, the Department is continuing with graduated user charge increases within a framework that gradually brings local revenues in line with local costs. This gradual approach to achieving financial self-sufficiency began with site-specific fee increases in 1996 and again in 1997 and 1998. These local costs are the subject of local consultation in which the airport sizing and levels of service provided are determined by local demands. In addition, the Department is proposing to extend beyond 1999-2000, the number of years over which increases at NAS airports are to be implemented. This approach is consistent with the recommendation of the independent financial advisor on airport transfers.

This proposed amendment would cover fee increases in 1999 for the remaining airports operated by the Department as well as annual increases up to the year 2003 for certain NAS airports in order to complete implementation of the NAP requirement that all airports achieve financial self-sufficiency. Increases are proposed for landing, general terminal and/or aircraft parking charges.

The proposed changes for nine NAS airports (Charlottetown, Fredericton, Halifax, Prince George, Québec International, Regina, St. John's [Torbay], Saint John and Saskatoon) would be effective January 1, 1999. In addition, rates would be increased on January 1, 2000, at the same nine NAS airports. Rates would also increase on January 1 of each of the following three years (2001, 2002, 2003) for Charlottetown, Fredericton, Prince George, Québec International and Saint John airports. Changes at the remaining airports would be effective April 1, 1999.

In addition to landing, general terminal and aircraft parking fee increases mentioned above, it is proposed to increase the special landing charges applicable to international flights making refueling stops at Gander to $6.54 from $6.11 on the first 30 000 000 kg in accumulated weight landed, to $5.57 from $5.14 on the next 14 800 000 kg in accumulated weight landed, and to $5.18 from $4.75 on any weight in excess of 44 800 000 kg in accumulated weight landed. This change would be effective April 1, 1999.

References to London airport are being removed from the Regulations as this airport has been transferred to local control and as such is no longer subject to these Regulations.

The last amendment to these Regulations became effective on June 1, 1998, with SOR/98-298. Site-specific increases were implemented at most airports operated by the Department. Except for Schefferville Airport, the impact of that amendment at an airport was capped at $2.50 per enplaned/deplaned passenger.

Alternatives

The National Airports Policy (NAP) was announced by the Minister of Transport on July 13, 1994. Under the NAP, airports are to be transferred to other authorities by March 31, 2000. The NAP recognizes that there will be a need to adjust levels of service, improve operating efficiencies and increase revenues to meet the target of self-sufficiency laid out in the policy.

A number of alternatives were considered in developing the fee proposal. Smaller increases would not be reasonable given the need for increased cost recovery and airport financial self-sufficiency, while a higher increase was considered inappropriate at this time.

Benefits and Costs

The impact of the proposed increases in landing, general terminal and/or aircraft parking charges at each airport is set out in the attached table. If implemented in 1999, this proposal is expected to generate in the order of $8.2 million in additional revenue on a full-year basis. Additional revenue of approximately $6.4 million is expected in the year 2000, while approximately $1.9 million in additional revenue is expected in each of the years 2001, 2002 and 2003.

The proposed amendment will result in an increased cost to the aviation industry using facilities and services at these airports. However, the changes have been formulated in such a way that they should have limited adverse consequences for many airports.

These increases are not expected to create a major impact on the Canadian airline industry. User charges have typically represented about 3-4 percent of the airline total operating costs. The proposed $8.2 million increase in landing, general terminal and aircraft parking revenues represents an increase of approximately 19.65 percent over existing levels. As can be seen from the attached table, the impact of the increases at most of the airports listed would be less than the $2.50 per enplaned/deplaned passenger cap which has been consistently applied for previous site-specific fee increases. However, because of this capping practice, four airports (Gander, Mont-Joli, St. Anthony and Wabush) are not expected to reach financial self-sufficiency with the current proposal. Further increases at a later date may be required at these airports.

The current proposal would be the fourth amendment to the regulations dealing with site-specific fee increases under the NAP. With few exceptions, the amendment is expected to eliminate the remaining projected 1999-2000 deficit for non-NAS airports, and bring nine NAS airports to financial self-sufficiency.

Consultation

Air industry associations, such as the Air Transport Association of Canada, the International Air Transport Association, the Air Transport Association of America, the Northern Air Transport Association, the Association québécoise des transporteurs aériens inc., the Canadian Business Aircraft Association, the Canadian Owners and Pilots Association, the Alberta Aviation Council, the British Columbia Aviation Council, the Saskatchewan Aviation Council and the Central Air Carriers Association, have been advised by letter of the proposed changes and invited to give their comments. Stakeholders wishing to discuss the amendment are invited to contact department representatives.

In addition, the staff at Transport Canada airports are conducting local consultations with airport stakeholders regarding the proposed increases at each site.

Compliance and Enforcement

Charges payable under these Regulations will be recovered through the Department's current administrative collection procedures. Collection of outstanding debts due to the Crown may, through the provisions set out in sections 4.4 and 4.5 of the Aeronautics Act, be recovered in any court of competent jurisdiction.
