Remand

The Binational Panel in Canadian Secretariat File No. CDA-97-1904-02, acting pursuant to its authority under section 77.015 of the Special Import Measures Act, remanded, in part, the finding of the Canadian International Trade Tribunal in Inquiry No. NQ-97-001. The Binational Panel remanded to the Canadian International Trade Tribunal its finding, under subsection 43(1.01) of the Special Import Measures Act, to determine whether a separate finding is required in respect of Mexico and, further, whether separate reasons are also requisite.

Determination on Remand

The Canadian International Trade Tribunal, pursuant to section 77.016 of the Special Import Measures Act, hereby accepts that it erred by not issuing a separate finding for Mexico. This is being corrected with the issuance of a corrigendum to the finding in Inquiry No. NQ-97-001 (copy enclosed). For the reasons outlined in the accompanying determination on remand, the Canadian International Trade Tribunal is of the view that there is no legislative requirement or persuasive policy rationale to support the need for separate reasons to be issued with respect to the goods from Mexico.

INQUIRY — CORRIGENDUM TO THE FINDING OF OCTOBER 27, 1997 (see footnote 1)

Hot-rolled Carbon Steel Plate

In the matter of an inquiry (Inquiry No. NQ-97-001) under section 42 of the Special Import Measures Act respecting certain hot-rolled carbon steel plate originating in or exported from Mexico, the People's Republic of China, the Republic of South Africa and the Russian Federation

The Canadian International Trade Tribunal, under the provisions of section 42 of the Special Import Measures Act, has conducted an inquiry following the issuance by the Deputy Minister of National Revenue of a preliminary determination of dumping dated June 27, 1997, and of a final determination of dumping dated September 25, 1997, respecting the importation into Canada of hot-rolled carbon steel plate and high strength low alloy plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths, in widths from 24 inches (+/- 610 mm) to 152 inches (+/- 3,860 mm) inclusive, and thicknesses from 0.187 inches (+/- 4.75 mm) to 4 inches (+/- 101.6 mm) inclusive, originating in or exported from Mexico, the People's Republic of China, the Republic of South Africa and the Russian Federation, but excluding plate for use in the manufacture of pipe and tube (also known as skelp); plate in coil form; plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate); and plate produced to ASTM specifications A515 and A516M/A516, grade 70, in thicknesses greater than 3.125 inches (+/- 79.3 mm).

Pursuant to subsection 43(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby finds that the dumping in Canada of the aforementioned goods originating in or exported from the People's Republic of China, the Republic of South Africa and the Russian Federation has not caused material injury to the domestic industry, but is threatening to cause material injury to the domestic industry.

In accordance with subsection 43(1.01) and pursuant to subsection 43(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby finds that the dumping in Canada of the aforementioned goods originating in or exported from Mexico has not caused material injury to the domestic industry, but is threatening to cause material injury to the domestic industry.

The Canadian International Trade Tribunal, under the provisions of subsection 76(2) of the Special Import Measures Act, has conducted a review of its finding of material injury made on June 22, 1994, in Inquiry No. NQ-93-005.

Pursuant to subsection 76(4) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby continues the above-mentioned finding without amendment.

Renewal of Radio Programming Undertaking Licences Due to Expire in 1999

The Commission hereby announces that it has received licence renewal applications, some with amendments to add one or many conditions of licence mentioned below (as well as other amendments), for the following radio programming undertakings. These licences expire on August 31, 1999.

(a) Sex-role portrayal

"It is a condition of licence that the licensee adhere to the guidelines on sex-role portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-Role Portrayal Code for Television and Radio Programming, as amended from time to time and approved by the Commission. The application of the foregoing condition of licence will be suspended as long as the licensee remains a member in good standing of the Canadian Broadcast Standards Council."

(b) Station format

"It is a condition of licence that this station not be operated within the specialty format as defined in Public Notice CRTC 1995-60, as amended from time to time."

(c) Canadian talent development

"The licensee is required, by condition of licence, to make payments to third parties involved in Canadian talent development at the level identified for it in the Canadian Association of Broadcasters' (CAB) Distribution Guidelines For Canadian Talent Development, as set out in Public Notice CRTC 1995-196, as amended from time to time and approved by the Commission, and to report the names of the third parties associated with Canadian talent development, together with the amounts paid to each, on its annual return. Call for Applications for a Broadcasting Licence to Carry on a Television Programming Undertaking to Serve Vancouver and/or Victoria, British Columbia

The Commission announces that it has received an application for a broadcasting licence to carry on a television programming undertaking to provide television services to serve Vancouver, British Columbia.

The Commission hereby calls for applications from other parties wishing to obtain broadcasting licences to provide television services to Vancouver and/or Victoria.

Persons interested in submitting such an application are required to file a letter of intent no later than August 9, 1999, followed by a formal application to the Commission no later than September 23, 1999, and are also required to submit all necessary technical documentation to the Department of Industry by the latter date.

It should be noted that, in making this call, the Commission has not reached any conclusion with respect to the licensing of such a service, nor should it necessarily be construed that the Commission will, by virtue of having called for applications, authorize such a service at this time.

Applicants will be required to provide evidence giving clear indication that there is a demand and a market for the station and the proposed service. Without restricting the scope of the issues to be considered, the following should be addressed:

1. The contribution that the proposed service will make to achieve the objectives established in the Broadcasting Act and, in particular, to the production of local and regional programming.

2. The expected audience of the proposed service.

3. The means by which the applicant will promote the development of Canadian talent, including local and regional talent.

4. An analysis of the markets involved and potential advertising revenues, taking into account the results of any survey undertaken supporting the estimates.

5. An indication of possible shared investment or co-operative program buying arrangements with Canadian or foreign broadcasters.

6. Evidence as to the availability of financial resources consistent with the requirements established in the financial projections of the applicant's business plan. For the convenience of applicants, the Commission has available upon request a document entitled "Documentation Required by the Commission to Support the Availability of an Applicant's Proposed Financing".

The Commission also reminds applicants that they must comply with the eligibility requirements set out in P.C. 1997-486, dated April 8, 1997, Direction to the CRTC (Ineligibility of Non-Canadians) and amended by P.C. 1998-1268, dated July 15, 1998, and in P.C. 1997-629 dated April 22, 1997, Order Amending the Direction to the CRTC (Ineligibility to Hold Broadcasting Licences).

The Commission will announce at a later date the public process where applications will be considered and where they may be examined by the public.

Notice of each application will also be published in newspapers of general circulation within the area to be served.

The public will be given the opportunity to comment on any application by submitting written interventions to the Secretary General of the Canadian Radio-Television and Telecommunications Commission, Ottawa, Ontario K1A 0N2 and by serving a true copy of the interventions on the applicants at least 25 days before the date of the hearing.
