BONNEVILLE POWER ADMINISTRATION

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Notice is hereby given that by an application dated May 7, 1999, the Bonneville Power Administration (BPA) applied to the National Energy Board (Board), under Division II of Part VI of the National Energy Board Act (Act), for authorization to export energy purchased from the wholesale power markets in the provinces of British Columbia, Alberta and Saskatchewan to the United States on an as-needed basis. Any purchase would be under price and terms of the Canadian wholesale power market entities involved.

The Board wishes to obtain views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The Directions on Procedure that follow explain in detail the procedure that will be used.

1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application in the Public Information Office at its offices located at: Bonneville Power Administration, 905 NE 11th Avenue, P.O. Box 3621, Portland, OR 97208-3621, United States, (503) 230-3000. A copy of the Application shall be available to anyone making a request. A copy of the application is also available for viewing during normal business hours in the Board's library, Room 100, 311 Sixth Avenue SW, Calgary, Alberta T2P 3H2.

2. Submissions that any party wishes to present shall be filed with the Secretary, National Energy Board, 311 Sixth Avenue SW, Calgary, Alberta T2P 3H2. The facsimile number is (403) 292-5503. Submissions shall also be filed with the Applicant by August 15, 1999.

3. Pursuant to subsection 119.06(2) of the Act, the Board shall have regard to all considerations that appear to be relevant. In particular, the Board is interested in the views of submittors with respect to:

(a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported;

(b) the impact of the export on the environment; and

(c) whether BPA has

(i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and

(ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrated an intention to buy electricity for consumption in Canada.

4. Any answer to submissions that BPA wishes to present in response to items 2 and 3 of the Notice of Application and Direction of Procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by August 30, 1999.

5. Any reply that submittors wish to present in response to item 4 of this Notice of Application and Directions on Procedure shall be filed with the Secretary of the Board and served on BPA by September 10, 1999.

APPLICATION FOR A COMPULSORY LICENCE

Notice is hereby given that on April 28, 1999, there was filed by Brantford Chemicals Inc., with the Commissioner of Patents, an application pursuant to the provisions of section 65 of the Patent Act, for a compulsory licence under Patent No. 1,275,349 dated October 16, 1990, owned by Merck & Co., Inc. on the ground that the rights of the patentee under the said patent have been abused in accordance with the allegations contained in the application and statutory declarations filed.
