Notice is hereby given that, pursuant to the provisions of Part VI of the Canadian Environmental Protection Act, Permit No. 4543-2-06020 is approved.

1. Permittee: Torngat Fish Producers Co-operative Society Ltd., Happy Valley, Newfoundland.

2. Type of Permit: To dump or load fish offal.

3. Term of Permit: Permit is valid from August 9, 1999, to August 8, 2000.

4. Loading Site(s): 55°27.50' N, 60°12.90' W, Hopedale, Newfoundland.

5. Dump Site(s): 55°27.20' N, 60°12.35' W, at an approximate depth of 40 m.

6. Route to Dump Site(s): Most direct navigational route from the loading site to the dump site.

7. Equipment: Vessels, barges or other floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved dump site.

8. Method of Dumping: Fish offal shall be discharged while the equipment or vessel is steaming within 300 m of the approved dump site. Dumping will take place in a manner which will promote the greatest degree of dispersion. All vessels will operate at maximum safe speed while discharging offal.

9. Rate of Dumping: As required by normal operations.

10. Total Quantity to be Dumped: Not to exceed 100 tonnes.

11. Material to be Dumped: Fish offal.

12. Requirements and Restrictions:

12.1. It is required that the Permittee report, in writing, to Mr. Rick Wadman, Manager, Environmental Protection, Department of the Environment, 6 Bruce Street, Mount Pearl, Newfoundland A1N 4T3, (709) 772-5097 (Facsimile), at least 48 hours prior to the start of the first dumping operation to be conducted under this permit.

12.2. A written report shall be submitted to the Manager, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit and the dates on which the loading and dumping activities occurred.

12.3. It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

12.4. The Permittee shall periodically determine the water depth in the area of the disposal site. The depth readings shall be taken every eight weeks, beginning with the start date of this permit, and reported to Mr. Rick Wadman, identified in paragraph 12.1.

12.5. The loading and transit of waste material to the dump site must be conducted in such a manner that no material enters the marine environment. Waste material spilled at any place other than the permitted dump site must be retrieved. All waste must be contained on shore while the barge is away from the loading site.

12.6. The fish offal must be covered by netting or other material to prevent access by gulls.

12.7. This permit must be displayed in an area of the plant accessible to the public.

12.8. Vessels operating under the authority of this permit must carry and display a radar-reflecting device at all times mounted on the highest practical location.

12.9. The loading or ocean dumping conducted under this permit shall not be carried out without written authorization from the Permittee.

12.10. Fish offal loaded for the purpose of ocean dumping may not be held aboard any vessel for more than 96 hours without the written consent of an inspector designated under the Canadian Environmental Protection Act.

CANADA SHIPPING ACT

Eastern Canada Response Corporation Ltd.

Notice of an Amendment to the Bulk Oil Cargo Fees (BOCF) Charged by Eastern Canada Response Corporation Ltd. (ECRC) pursuant to an arrangement required by paragraphs 660.2(2)(b) and 660.2(4)(b) of the Canada Shipping Act.

Description

ECRC currently is a certified response organization pursuant to subsection 660.4(1) of the Canada Shipping Act (Act) in respect of a rated capability of 10 000 tonnes and a geographic area covering:

(a) The waters of James Bay, Hudson Bay and Ungava Bay and the waters in the Province of Quebec and that portion of the St. Lawrence River in the Province of Ontario to a line drawn between Butternut Bay (latitude 44°31'12" N and longitude 75°46'54" W) on the Canadian side to Oak Point (latitude 44°30'48"N and longitude 75°45'20" W) on the United States side of the St. Lawrence River and in the Atlantic Provinces, excluding the waters north of the 60° N latitude and the primary areas of response associated with the designated ports of Saint John, New Brunswick, and Point Tupper, Nova Scotia.

(b) The Canadian Great Lakes system and connecting channels within the Province of Ontario, including Lake Superior, the St. Marys River, Lake Huron, the St. Clair River, Lake St. Clair, the Detroit River, Lake Erie, Lake Ontario, the St. Lawrence River from Kingston, Ontario, to a line drawn between Butternut Bay (latitude 44°31'12" N and longitude 75°46'54" W) on the Canadian side to Oak Point (latitude 44°30'48" N and longitude 75°45'20" W) on the United States side of the St. Lawrence River, Lake Winnipeg, Athabasca River from Fort McMurray to Lake Athabasca and the waters of Lake Athabasca.

The list of fees in this notice is applicable to the three regions in ECRC's geographic area of response.

Definitions

1. In this notice of fees.

"Act" means the Canada Shipping Act. (Loi)

"Alert" means Atlantic Emergency Response Team (ALERT) Inc. (Alert)

"Alert's geographic area" means the geographic area of response for which Alert has been issued a certificate of designation. (zone géographique d'Alert)

"asphalt" means a derivate of oil that is commercially described as road or paving asphalt or unblended roofers flux, that has a specific gravity equal to or greater than one, that is solid at 15 degrees Celsius and that sinks to the bottom as a solid when immersed in water. (asphalte)

"Atlantic Provinces" means Nova Scotia, New Brunswick, Prince Edward Island and Newfoundland, including Labrador.

"BOCF" means bulk oil cargo fee. (droits sur les produits pétroliers en vrac (DCPV))

"designated oil handling facility" means an oil handling facility that is designated pursuant to subsection 660.2(8) of the Act and is located in ECRC's geographic area or in the Great Lakes Region. (installation de manutention d'hydrocarbures agréée)

"ECRC" means Eastern Canada Response Corporation Ltd., a company formed as a result of the amalgamation of Eastern Canada Response Corporation Ltd., Great Lakes Response Corporation of Canada and Canadian Marine Response Management Corporation, effective January 1, 1999. (SIMEC)

"Great Lakes Region" means the area covered by the Canadian Great Lakes system and connecting channels within the Province of Ontario, including Lake Superior, the St. Marys River, Lake Huron, the St. Clair River, Lake St. Clair, the Detroit River, Lake Erie, Lake Ontario, the St. Lawrence River from Kingston, Ontario to a line drawn between Butternut Bay (latitude 44°31'12" N and longitude 75°46'54" W) on the Canadian side to Oak Point (latitude 44°30'48" N and longitude 75°45'20" W) on the United States side of the St. Lawrence River, Lake Winnipeg, Athabasca River from Fort McMurray to Lake Athabasca and the waters of Lake Athabasca. "Newfoundland Region" means the Province of Newfoundland and Labrador. (région de Terre-Neuve)

"PTMS" means Point Tupper Marine Services Limited. (SPTM)

"PTMS' geographic area" means the geographic area of response for which PTMS has been issued a certificate of designation. (zone géographique de SPTM)

"ship" means a ship within the meaning of section 660.2 of the Act. (navire)

"ship (bulk oil)" means a ship that is constructed or adapted primarily to carry bulk oil in its cargo spaces. (navire (avec produits pétroliers en vrac))

Bulk Oil Cargo Fees

2. This BOCF applies to the loading and unloading of oil at oil handling facilities located in each of the following regions:

Quebec/Maritime Region

3. The total BOCF payable by a designated oil handling facility that has an arrangement with ECRC shall be determined by multiplying the total number of tonnes of bulk oil unloaded and (in the case of bulk oil intended for international destinations and destinations north of 60° N latitude) loaded at the designated oil handling facility, by the BOCF per tonne for each type of oil set out in sections 5 and 6 of this part.

4. The total BOCF payable by a ship (bulk oil) shall be determined:

(a) in the case of bulk oil loaded onto the ship (bulk oil) and intended for international destinations and destinations north of 60° N latitude, by multiplying the total number of tonnes of bulk oil loaded at an oil handling facility that does not have an arrangement with ECRC, by the BOCF per tonne for each type of oil set out in sections 5 and 6 of this part; and

(b) in the case of bulk oil unloaded from the ship (bulk oil), by multiplying the total number of tonnes of bulk oil unloaded at an oil handling facility that does not have an arrangement with ECRC, by the BOCF per tonne for each type of oil set out in sections 5 and 6 of this part.

5. The BOCF applicable in respect of oil other than asphalt is:

(a) an amended fee of twenty-five and two tenths cents (25.2¢) per tonne, plus all applicable taxes from August 1, 1999, to December 31, 1999; and

(b) an amended fee of thirty-six and seven tenths cents (36.7¢) per tonne, plus all applicable taxes from January 1, 2000.

6. The BOCF applicable in respect of asphalt is:

(a) an amended fee of twelve and six tenths cents (12.6¢) per tonne, plus all applicable taxes from August 1, 1999, to December 31, 1999; and

(b) an amended fee of eighteen and thirty-five hundredth cents (18.35¢) per tonne, plus all applicable taxes from January 1, 2000.

Newfoundland Region

7. The total BOCF payable by a designated oil handling facility that has an arrangement with ECRC shall be determined by multiplying the total number of tonnes of bulk oil unloaded and (in the case of bulk oil intended for international destinations and destinations north of 60° N latitude) loaded at the designated oil handling facility, by the BOCF per tonne for each type of oil set out in sections 9 and 10 of this part.

8. The total BOCF payable by a ship (bulk oil) shall be determined:

(a) in the case of bulk oil loaded onto the ship (bulk oil) and intended for international destinations and destinations north of 60° N latitude, by multiplying the total number of tonnes of bulk oil loaded at an oil handling facility that does not have an arrangement with ECRC, by the BOCF per tonne for each type of oil set out in sections 9 and 10 of this part; and

(b) in the case of bulk oil unloaded from the ship (bulk oil), by multiplying the total number of tonnes of bulk oil unloaded at an oil handling facility that does not have an arrangement with ECRC, by the BOCF per tonne for each type of oil set out in sections 9 and 10 of this part.

9. The BOCF applicable in respect of oil other than asphalt is:

(a) an amended fee of eleven and thirty-five hundredths cents (11.35¢) per tonne, plus all applicable taxes from August 1, 1999, to December 31, 1999, and

(b) an amended fee of twelve and five tenths cents (12.5¢) per tonne, plus all applicable taxes from January 1, 2000.

10. The BOCF applicable in respect of asphalt is:

(a) an amended fee of five and seven tenths cents (5.7¢) per tonne, plus all applicable taxes from August 1, 1999, to December 31, 1999, and

(b) an amended fee of six and twenty-five hundredths cents (6.25¢) per tonne, plus all applicable taxes from January 1, 2000.

Great Lakes Region

11. The total BOCF payable by a designated oil handling facility that has an arrangement shall be determined by multiplying the total number of tonnes of bulk oil unloaded and (in the case of bulk oil intended for international destinations and destinations north of 60° N latitude) loaded at the designated oil handling facility, by the BOCF per tonne for each type of oil set out in sections 13 and 14 of this part.

12. The total BOCF payable by a ship (bulk oil) shall be determined:

(a) in the case of bulk oil loaded onto the ship (bulk oil) and intended for international destinations and destinations north of 60° N latitude, by multiplying the total number of tonnes of bulk oil loaded at an oil handling facility that does not have an arrangement, by the BOCF per tonne for each type of oil set out in sections 13 and 14 of this part; and

(b) in the case of bulk oil unloaded from the ship (bulk oil), by multiplying the total number of tonnes of bulk oil unloaded at an oil handling facility that does not have an arrangement, by the BOCF per tonne for each type of oil set out in sections 13 and 14 of this part.

13. The BOCF applicable in respect of oil other than asphalt is:

(a) an amended fee of sixty-one cents (61¢) per tonne, plus all applicable taxes from August 1, 1999, to December 31, 1999; and

(b) an amended fee of eighty-one cents (81¢) per tonne, plus all applicable taxes from January 1, 2000.

14. The BOCF applicable in respect of asphalt is:

(a) an amended fee of thirty and five tenths cents (30.5¢) per tonne, plus all applicable taxes from August 1, 1999, to December 31, 1999; and

(b) an amended fee of forty and five tenths cents (40.5¢) per tonne, plus all applicable taxes from January 1, 2000.

Maintenance Dredging Services Tonnage Fees

The Minister of Fisheries and Oceans, pursuant to section 47 of the Oceans Act, hereby fixes the fees to be paid for maintenance dredging services in the St. Lawrence Ship Channel in accordance with the annexed Schedule, effective September 1, 1999, until August 31, 2002.

  MAINTENANCE DREDGING SERVICES TONNAGE FEES SCHEDULE

1. The following definitions apply for the purpose of establishing and collecting fees to be paid for the provision of maintenance dredging services by the Canadian Coast Guard to ships transiting the St. Lawrence Ship Channel.

"draught" means the largest static draught of a ship during a transit.

"fishing vessel" means a vessel, boat or craft that is employed in catching fish, processing fish or transporting fish back to shore.

"government ship" means any vessel, boat or craft that is owned or operated by the government of any country other than Canada, a province, state, territory or municipality of a country for which no fee, tariff or freight rate is charged for the vessel's, boat's or craft's services, or any vessel, boat or craft owned or operated by the Government of Canada.

"gross tonnage" means

(a) in the case of a ship that is subject to the 1969 Convention, the gross tonnage that is indicated on the International Tonnage Certificate for that ship; or

(b) in the case of a ship that is not subject to the 1969 Convention, the gross tonnage or register tonnage that is indicated on the certificate of registry for that ship.

"Minister" means the Minister of Fisheries and Oceans.

"1969 Convention" means the International Convention on Tonnage Measurement of Ships, 1969.

"pleasure craft" means a vessel, boat or craft that is used exclusively for pleasure and does not carry passengers or goods for hire, reward, remuneration or any object of profit.

"ship" means a vessel, boat, or craft carrying either a domestic or foreign flag, other than a pleasure craft, fishing vessel, and government ship.

"St. Lawrence Ship Channel" means the navigation channel of the St. Lawrence River between the upstream boundary of the Port of Montreal and the upstream end of Île aux Coudres.

"transit" means any upstream movement or downstream movement made by a ship that begins, stops or ends at a Canadian port and that includes all or part of the St. Lawrence Ship Channel.

2. Subject to sections 7 to 11, the fee applies to each ship that

(a) is on a transit in the St. Lawrence Ship Channel; and

(b) has a draught of 5.0 metres or more during a transit.

3. Subject to sections 7 to 11, every ship shall pay to the Minister a fee obtained by multiplying the gross tonnage of that ship by $0.0345 for each transit, subject to a minimum fee of $25.

4. Each of the corporations identified in Column I shall pay to the Minister the fixed fee in the corresponding line in column II:

5. The fee set by section 3 shall be paid by the ship upon issuance of an invoice by the Minister or by a person authorized by the Minister to the ship or the authorized agent of the ship.

6. The fee set by section 4 shall be paid by each of the corporations mentioned therein upon issuance of an invoice by the Minister or by a person authorized by the Minister.

7. No fee is payable by a ship that is travelling non-stop through Canadian waters to, or from, a port in the United States without a stop at a Canadian port.

8. A stop by a ship at a Canadian port for the sole purpose of taking on bunkers that will be used exclusively to continue its voyage will not be subject to the fee.

9. A stop at a Canadian port for one or more of the following sole purposes will not be subject to the fee:

(i) to respond to a medical emergency;

(ii) to undertake emergency ship repairs;

(iii) to respond to a government department or agency request to stop; or

(iv) to make an overnight stop required due to the seasonal removal of lighted aids to navigation.

10. Subject to section 12, no fee is payable when a movement of a ship is within the boundaries of a port on the St. Lawrence Ship Channel.

11. Subject to section 12, no fee is payable by a ship on a transit

(a) beginning at the Port of Montreal and proceeding directly into the St. Lawrence Seaway; or

(b) ending at the Port of Montreal after proceeding directly from the St. Lawrence Seaway.

12. For purposes of the application of sections 10 and 11, the Terminal at Contrecœur shall be deemed to be a destination distinct from the Port of Montreal.

13. Interest is payable on an overdue fee commencing 30 days after issuance of the invoice and is calculated pursuant to the Interest and Administrative Charges Regulations. (see footnote a)
