COMMENCEMENT OF INVESTIGATION

Woven Fabrics of Cotton

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) is satisfied that the request (Request No. TR-99-003) received from Western Glove Works (the requester) of Winnipeg, Manitoba, is properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of woven fabrics, dyed, solely of cotton, either plain or 3-thread or 4-thread twill weave, weighing 230 g/m or more but not exceeding 310 g/m, of tariff item No. 5209.31.90 or 5209.32.00, for use in the manufacture of trousers, shorts, overalls, skirts and jackets (the subject fabrics).

The Tribunal will conduct an investigation under section 19 of the Canadian International Trade Tribunal Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabrics, which are classified under tariff item Nos. 5209.31.90 and 5209.32.00.

The Tribunal's investigation was commenced on July 26, 1999, and will be conducted by way of written submissions. To participate in the Tribunal's investigation, the requester or an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before August 23, 1999. The Tribunal's recommendations to the Minister of Finance are scheduled to be issued by November 23, 1999.

Corrosion-resistant Steel Sheet Products

In the matter of a review (Review No. RR-98-007), under subsection 76(2) of the Special Import Measures Act, of the findings made by the Canadian International Trade Tribunal on July 29, 1994, in Inquiry No. NQ-93-007, concerning certain corrosion-resistant steel sheet products originating in or exported from Australia, Brazil, France, the Federal Republic of Germany, Japan, the Republic of Korea, New Zealand, Spain, Sweden, the United Kingdom and the United States of America

The Canadian International Trade Tribunal, under the provisions of subsection 76(2) of the Special Import Measures Act, has conducted a review of its findings made on July 29, 1994, in Inquiry No. NQ-93-007.

Pursuant to subsection 76(4) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby continues the finding in respect of certain corrosion-resistant steel sheet products originating in or exported from Brazil, the Federal Republic of Germany, Japan and the Republic of Korea, with an amendment to exclude corrosion-resistant steel sheet products imported under tariff item No. 9959.00.00 for use in the manufacture of passenger automobiles, buses, trucks, ambulances or hearses, or chassis therefor, or parts, accessories or parts thereof.

Pursuant to subsection 76(4) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby continues the finding in respect of certain corrosion-resistant steel sheet products originating in or exported from the United States of America, with an amendment to exclude corrosion-resistant steel sheet products imported under tariff item No. 9959.00.00 for use in the manufacture of passenger automobiles, buses, trucks, ambulances or hearses, or chassis therefor, or parts, accessories or parts thereof.

Pursuant to subsection 76(4) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby rescinds the finding in respect of certain corrosion-resistant steel sheet products originating in or exported from Australia, France, New Zealand, Spain, Sweden and the United Kingdom.

Cableworks operates cable systems currently serving approximately 64 000 basic cable subscribers in Hamilton, Stoney Creek, Fergus and Grimsby. Halton Cable is the licensee of cable distribution undertakings serving approximately 20 000 subscribers in Rockwood and Georgetown.

2. Cogeco Cable, on behalf of TV Hamilton Limited
(TV Hamilton)

For authority to acquire effective control of TV Hamilton. TV Hamilton is the licensee of an English-language community programming network. The proposed transaction would transfer the one-third voting interest in TV Hamilton currently held by Cableworks to Cogeco Cable, which already holds a one-third voting interest in TV Hamilton.

3. Cogeco Cable is one of the four largest multiple system operators in Canada, with diversified holdings in television and cable systems serving over 800 000 subscribers in British Columbia, Alberta, Saskatchewan, Ontario and Quebec.

To amend the broadcasting licence for CBK Regina. CBC proposes to add a transmitter at Regina operating on the frequency 102.5 MHz (channel 273A) with an effective radiated power of 820 watts.

Rogers Cablesystems Limited (Rogers)

Rogers requests that its cable systems serving the above-noted localities not be required to carry the new religious station licensed to the B.C. Conference of Mennonite Brethren Churches.

Section 17 of the Broadcasting Distribution Regulations requires the Rogers systems to carry this new television service, unless relieved from this obligation by a condition of licence.

In Decision CRTC 99-107, which approved the new station, the Commission noted Rogers' concerns about the analogue capacity of its cable undertakings and also noted that the station did not intend to ask Rogers to carry its service.

Call for Comments on a Proposal to Amend Section 10 of the Broadcasting Distribution Regulations Submitted by the Canadian Cable Television Association

Summary

The Commission seeks public comment regarding a proposal submitted by the Canadian Cable Television Association to amend section 10 of the Broadcasting Distribution Regulations, which deals with the transfer of inside wire to customers. The Commission will accept comments that it receives on or before September 8, 1999.

1. On May 19, 1999, the Canadian Cable Television Association (CCTA) submitted an application to amend section 10 of the Broadcasting Distribution Regulations (the Regulations).

2. Section 10 of the Regulations specifies that:

10. (1) Subject to subsections (2) and (3), if a licensee owns the inside wire, it shall offer it for purchase to a customer when the customer's oral or written notice to terminate basic service is received.

(2) In the case of a single-unit dwelling, the licensee's offer under subsection (1) shall be at a price of not more than $5.

(3) If the customer is the owner or operator of a multiple-unit dwelling, the licensee shall offer to the customer for purchase the inside wire of each subscriber residing in the multiple-unit dwelling.

(4) If a customer decides not to purchase the inside wire, the licensee owning the wire may remove it within seven days after the date of the termination of service.

(5) If a licensee decides not to remove the inside wire under subsection (4), the licensee shall not later interfere with the ability of any person to use the wire.

3. The CCTA's proposed draft of section 10 of the Regulations reads as follows:

10. (1) A licensee shall not restrict or otherwise interfere with a customer's use of the inside wire.

(2) A licensee that owns the inside wire of a single unit dwelling shall not charge for the use of the wire.

(3) A licensee that owns the inside wire of a multiple unit dwelling may charge for the use of that wire in accordance with such terms as may be agreed to by the parties or determined by the CRTC.

4. The CCTA's proposal is based on four principles:

(1) Where the licensee owns the inside wire, it shall retain ownership of it, i.e., there is no transfer of ownership of the inside wire.

(2) The licensee that owns the inside wire will be prohibited by regulation from interfering with a customer's use of it.

(3) There will be no charge for use by another licensee of the inside wire in single-unit dwellings; in circumstances to be identified by the CRTC through the CRTC Interconnection Steering Committee (CISC) process, there will be a charge (also to be determined by the Commission) for use by another licensee of the inside wire in multiple-unit dwellings.

(4) All licensees will refrain from damaging another licensee's distribution system, cable drops, customer service enclosures and panel boxes.

5. The Commission invites written comments on the proposed amendments and underlying principles set out in paragraphs 3 and 4 above. The Commission will accept comments that it receives on or before September 8, 1999.

6. The Commission will not formally acknowledge written comments. It will, however, fully consider all comments and they will form part of the public record of the proceeding, provided that the procedures for filing set out below have been followed.

The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party", for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a work place, and includes

(a) a supplier of the controlled product;

(b) an employee at the work place;

(c) an employer at the work place;

(d) a safety and health professional for the work place;

(e) a safety and health representative or a member of a safety and health committee for the work place; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or

(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 200 Kent Street, Suite 9000, Ottawa, Ontario K1A 0M1.

YUKON TERRITORY WATER BOARD

YUKON WATERS ACT

Public Hearing

Pursuant to subsections 21(2), 23(1) and 23(2) of the Yukon Waters Act, the Yukon Territory Water Board will hold a public hearing on the following application for a water licence amendment on September 13, 1999.

The amendment is related to continuing a trial discharge of sewage effluent to a pothole lake, to extend the term of the licence to the year 2000, to increase the total amount of discharge from 2 Mm3 to 4 Mm3, to extend the period of discharge from 60 to 138 days, and to revise the monitoring program.

Interested persons may review the application and obtain copies of the Board's Rules of Procedure for Public Hearings at the Water Board office located at 419 Range Road, Suite 106, Whitehorse, Yukon Y1A 3V1, (867) 667-3980 (Telephone), (867) 668-3628 (Facsimile).

Any person who wishes to make representation in connection with this matter shall file with the Board by 12 noon, September 3, 1999, a signed notice of intent to intervene setting out a clear statement of their position and whether or not they intend to appear and make presentations at the public hearing.

If no notice of intent to intervene is received by the intervention deadline, the Board may cancel the public hearing.
