CANADIAN ENVIRONMENTAL PROTECTION ACT

Notice is hereby given that pursuant to the provisions of Part VI of the Canadian Environmental Protection Act, Permit No. 4543-2-06027 is approved.

1. Permittee: Falcon Seafoods Ltd., Burgeo, Newfoundland.

2. Type of Permit: To dump or load shellfish offal.

3. Term of Permit: Permit is valid from November 8, 1999, to November 7, 2000.

4. Loading Site(s): 47°37.04' N, 57°37.25' W, Burgeo, Newfoundland.

5. Dump Site(s): 47°36.77' N, 57°35.45' W, at an approximate depth of 55 m.

6. Route to Dump Site(s): Most direct navigational route from the loading site to the dump site.

7. Equipment: Vessels, barges or other floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved dump site.

8. Method of Dumping: Shellfish offal shall be discharged while the equipment or vessel is steaming within 200 m of the approved dump site. Dumping will take place in a manner which will promote the greatest degree of dispersion. All vessels will operate at maximum safe speed while discharging offal.

9. Rate of Dumping: As required by normal operations.

10. Total Quantity to be Dumped: Not to exceed 1 000 tonnes.

11. Material to be Dumped: Shellfish offal.

12. Requirements and Restrictions:

12.1. It is required that the Permittee report, in writing, to Mr. Rick Wadman, Manager, Environmental Protection, Department of the Environment, 6 Bruce Street, Mount Pearl, Newfoundland A1N 4T3, (709) 772-5097 (Facsimile), at least 48 hours prior to the start of the first dumping operation to be conducted under this permit.

12.2. A written report shall be submitted to the Manager within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit and the dates on which the loading and dumping activities occurred.

12.3. It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

12.4. A reading of the water depth at the disposal site shall be taken before the first disposal of offal and once every three weeks while disposal is taking place. These readings shall be submitted to Mr. Rick Wadman, identified in 12.1, as soon as possible.

12.5. The loading and transit of waste material to the dump site must be conducted in such a manner that no material enters the marine environment. Waste material spilled at any place other than the permitted dump site must be retrieved. All waste must be contained on shore while the barge is away from the loading site.

12.6. The shellfish offal must be covered by netting or other material to prevent access by gulls.

12.7. This permit must be displayed in an area of the plant accessible to the public.

12.8. Vessels operating under the authority of this permit must carry and display a radar-reflecting device at all times mounted on the highest practical location.

12.9. The loading or ocean dumping conducted under this permit shall not be carried out without written authorization from the Permittee.

12.10. Shellfish offal loaded for the purpose of ocean dumping may not be held aboard any vessel for more than 96 hours without the written consent of an inspector designated under the Canadian Environmental Protection Act.

ORDER

Whereas by Order-in-Council P.C. 1701, dated March 25, 1952, and whereas the Indian Bands Council Elections Order dated February 11, 1997, it was declared that the Council of the Beardy's and Okemasis Band, in the Province of Saskatchewan, should be selected by elections to be held in accordance with the Indian Act;

Whereas the Beardy's and Okemasis Band has developed the "Beardy's and Okemasis First Nation Band Custom Election Act" as its local community election system for selecting a Chief and Councillors;

Whereas for the good government of the Beardy's and Okemasis Band, conversion to a local community electoral system for selecting the members of the Council of the Band would better serve the needs of the Band;

Whereas the Minister of Indian Affairs and Northern Development considers it appropriate to revoke section 74 of the Indian Act as it applies to the Beardy's and Okemasis Band in order that the said Band may select its Council in accordance with its local community electoral system;

Therefore, the Minister of Indian Affairs and Northern Development, pursuant to subsection 74(1) of the Indian Act, hereby amends the Indian Bands Council Elections Order dated February 11, 1997, in accordance with the schedule hereto.

Whereas the Indian Bands Council Elections Order, dated February 11, 1997, confirmed that the Council of the Ochapowace First Nation Band should be selected in accordance with the Indian Act;

Whereas the Ochapowace First Nation Band has developed the "Ochapowace Election Act" as its local community election system for selecting a Chief and Councillors;

Whereas for the good government of the Ochapowace First Nation Band, conversion to a local community electoral system for selecting the members of the Council of the Band would better serve the needs of the Band;

Whereas the Minister of Indian Affairs and Northern Development considers it appropriate to revoke section 74 of the Indian Act as it applies to the Ochapowace First Nation Band in order that the said Band may select its Council in accordance with its local community electoral system;

Therefore, the Minister of Indian Affairs and Northern Development, pursuant to subsection 74(1) of the Indian Act, hereby amends the Indian Bands Council Elections Order, dated February 11, 1997, in accordance with the schedule hereto.

Whereas the Minister of Indian Affairs and Northern Development considers it appropriate to revoke section 74 of the Indian Act as it applies to the Cross Lake First Nation Band in order that the said Band may select its Council in accordance with its local community electoral system;

Notice No. DGRB-017-99 — Procedure to License Fixed Earth Stations and to Approve the Use of Foreign Fixed Satellite Service Satellites in Canada

This notice announces the release of Industry Canada's interim licence application procedure, Client Procedures Circular 2-6-01 (CPC-2-6-01, Provisional), Procedure for the Submission of Applications to License Fixed Earth Stations and to Approve the Use of Foreign Fixed Service Satellites (FSS) in Canada. This procedure can be found on the Industry Canada Web site at the address noted below.

Industry Canada released Radio Systems Policy 008 (RP-008), Policy Framework for the Provision of Fixed Satellite Services, in December 1998. By means of this policy framework, Canada has liberalized many aspects of the provision of fixed satellite service (FSS) communications in Canada. As a consequence of this liberalization and of other related commitments made in the policy framework, many aspects of Industry Canada's existing radio licence application procedure for fixed earth stations require modification. This circular contains an interim earth station licence application procedure that will immediately accommodate provisions in the policy framework with respect to the use of foreign FSS satellites. Further, consistent with another commitment made in the FSS policy framework, a consultation with the public on a new streamlined licensing process, including the use of spectrum licences, to authorize the operation of fixed satellite services in Canada will follow next year.

Under the interim licence application procedure, most applicants for earth station radio licences will follow a revised one-step procedure. However, the option of submitting a letter of intent to establish an earth station will continue to be used for cases where an applicant wishes to seek some assurance that a licence can be issued. In addition, the special procedure, available only for certain Very Small Aperture Terminal (VSAT) networks, is broadened to be applicable to all earth station networks involving significant numbers of the same type of earth station.

This licence application procedure replaces the licence application procedures and eligibility requirements currently set out in Radio Standards Procedure 114 (RSP-114), Licence Application Procedure for Planned Earth Stations in Space Radio Communications Services, and Radio Standards Procedure 116 (RSP-116), Licence Application Procedure for Planned Television and/or Radio Receive Only (TVRO) Earth Stations in the Fixed-Satellite Service. However, the technical standards outlined in RSP-114 and RSP-116 will remain in effect.

Further, in carrying out the commitment announced in the policy framework to establish a procedure by which foreign satellite operators may submit technical and administrative information on satellite stations to facilitate subsequent approvals of earth station licence applications, this circular also sets out a procedure to apply for approval for the use of foreign FSS satellites in the Canadian market. A list of satellite stations approved to provide fixed satellite services in Canada is included in the circular, and an updated list will be made available on Industry Canada's Web site.

This Client Procedures Circular is in effect provisionally from the date of publication of this notice. Comments on the provisional procedures are sought from all interested parties. (b) Radio Standards Specification 215 (RSS-215), Issue 1 (Provisional), Analogue Scanner Receivers.

2. Notice is also given that the following minor revision has been made to the text in the section dealing with Receiver Spurious Emissions of documents RSS-123, 128, 133 and 170. The text "If the receiver incorporates a scanning mode of operation that can scan frequencies outside its authorized band of operation, refer to document RSS-135, Digital Scanner Receivers, since there are certain restrictions on their certification" is replaced by the following: "If the receiver incorporates a scanning mode of operation, refer to document RSS-135, Digital Scanner Receivers, or to RSS-215, Analogue Scanner Receivers, since there are certain restrictions on their certification."

3. The Radio Equipment Technical Standards List in the Industry Canada Web site is also being amended to reflect the above changes.
