Special Arrangement — Radioactive Material — Package and Shipment

Pursuant to section 4 of the Transport Packaging of Radioactive Materials Regulations, the Atomic Energy Control Board issued the authorization numbered CDN/5225/X (Rev. 0) on November 24, 1999, to MDS Nordion Inc., authorizing the transportation of radioactive material in a packaging that does not conform to the requirements of these Regulations. The reasons for issuing this authorization were:

1. conformity with some of the requirements of these Regulations would be impractical; and

2. the terms and conditions of the authorization ensure a level of health and safety during transport at least equivalent to that which would exist if the packaging conformed to the applicable requirements of these Regulations.

ADVICE

Hot-rolled Carbon Steel Plate

In the matter of a reference (Reference No. RE-99-002), under paragraph 34(1)(b) of the Special Import Measures Act, made by Steel Authority of India Limited to the Canadian International Trade Tribunal;

And in the matter of an advice rendered by the Canadian International Trade Tribunal under section 37 of the Special Import Measures Act;

Respecting the dumping in Canada of certain hot-rolled carbon steel plate originating in or exported from Brazil, Finland, India, Indonesia, Thailand and the Ukraine and the subsidizing of certain hot-rolled carbon steel plate originating in or exported from India, Indonesia and Thailand.

The Canadian International Trade Tribunal hereby concludes that the evidence before the Deputy Minister of National Revenue discloses a reasonable indication that the dumping of certain hot-rolled carbon steel plate originating in or exported from Brazil, Finland, India, Indonesia, Thailand and the Ukraine and the subsidizing of certain hot-rolled carbon steel plate originating in or exported from India, Indonesia and Thailand have caused material injury or are threatening to cause material injury to the domestic industry.

Machinery and Tools

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-99-036) from Unisource Technology Inc. (the complainant), of Montréal, Quebec, concerning a procurement (Solicitation No. W8486-0-0916/A) by the Department of Public Works and Government Services (the Department) on behalf of the Department of National Defence. The solicitation is for the supply of various items for laundry and bath services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into this complaint.

It is alleged that the Department has improperly withheld the contract award from the complainant.

1. Clearwater, British Columbia
The Thompson Valley Television Society

The Thompson Valley Television Society is requesting authority to acquire the assets of the radiocommunication distribution undertaking serving Clearwater. The applicant is also requesting to obtain a broadcasting licence to continue the operation of this undertaking, upon surrender of the current licence issued to Clearwater and District Chamber of Commerce.

2. Fraser Valley Region, British Columbia
Trinity Television Inc.

For a broadcasting licence to carry on an English-language religious television programming undertaking in the Fraser Valley region. The new station would operate on channel 66 with an effective radiated power of 18 000 watts.

3. Vancouver, British Columbia
CFMT-TV, a division of Rogers Broadcasting Limited

For a broadcasting licence to carry on a multilingual ethnic television programming undertaking at Vancouver. The new station would operate on channel 42 with an effective radiated power of 30 700 watts.

4. Vancouver, British Columbia
CHUM Limited

For a broadcasting licence to carry on an English-language television programming undertaking at Vancouver. The new station would operate on channel 42 with an effective radiated power of 430 000 watts.

5. Vavenby, British Columbia
The Thompson Valley Television Society

The Thompson Valley Television Society is requesting authority to acquire the assets of the radiocommunication distribution undertaking serving Vavenby. The applicant is also requesting to obtain a broadcasting licence to continue the operation of this undertaking, upon surrender of the current licence issued to Vavenby Community Club and Recreation Commission.

6. Victoria, British Columbia
CHUM Limited

For a broadcasting licence to carry on an English-language television programming undertaking at Victoria. The new station would operate on channel 53 with an effective radiated power of 12 000 watts.

7. Victoria, British Columbia
Craig Broadcast Systems Inc., on behalf of a company to be incorporated, to be known as A-Channel B.C. Inc.

For a broadcasting licence to carry on an English-language television programming undertaking at Victoria. The new station would operate on channel 53 with an effective radiated power of 779 300 watts. In addition, the applicant has proposed a digital television rebroadcasting transmitter in Victoria on channel 43 with an effective radiated power of 3 000 watts. The Commission notes that it is not in a position to consider issues relating to digital television broadcasting at this time. Consequently, the Commission will not consider this aspect of the application at the hearing.

8. Victoria, Vancouver, Abbotsford, Chilliwack, Penticton, Kelowna and Vernon, British Columbia
Craig Broadcast Systems Inc., on behalf of a company to be incorporated, under the name of SkyCable Pacific Inc.

The applicant is requesting a broadcasting licence for a radiocommunication distribution undertaking to serve the above-mentioned localities. The applicant proposes to transmit the services, using a digital Multipoint Distribution System (MDS).

9. Victoria, Vancouver and the Lower Mainland, Abbotsford, Chilliwack, Kamloops, Vernon, Kelowna and Penticton, British Columbia
Look Communications Inc.

The applicant is requesting a broadcasting licence for a radiocommunication distribution undertaking to serve the above-mentioned localities. The applicant proposes to transmit the services, using a digital Multipoint Distribution System (MDS).

10. Edmonton, Alberta
The partners of The CJCA Limited Partnership (Rosedale Meadows Development Inc., Touch Canada Broadcasting Ltd. and C.R.A. Investments Ltd.)

The applicant is requesting authority to acquire the assets of the radio programming undertaking CJCA Edmonton. The transaction occurred due to the introduction of C.R.A. Investments Ltd. as a new partner in the limited partnership. The applicant is also requesting to obtain a broadcasting licence to continue the operation of this undertaking, upon surrender of the current licence issued to the partners of The CJCA Limited Partnership.

11. Canadian Forces Base (CFB) Suffield, Alberta
The Base Commander of Canadian Forces Base Suffield Alberta, Lieutenant-Colonel C. H. Watson, and his successors in the position, Canadian Forces Base Suffield

For a broadcasting licence to carry on an English-language FM radio programming undertaking at Suffield. The new station would operate on frequency 104.1 MHz (channel 281A) with an effective radiated power of 1 524 watts. The programming of this non-commercial undertaking will be directed to the members of the British Armed Forces stationed at CFB Suffield and their dependents. The station will provide a minimum of 50 hours of locally produced programming for use of the personnel at Suffield only. The remaining programming will be provided via satellite by the Services Sound and Vision Corporation (SSVC).

The applicant is also requesting to be exempted, by condition of licence, of the content requirements of section 2 of the Radio Regulations, 1986 regarding the broadcast of Canadian musical selections.

12. North Battleford, Saskatchewan
The Partners of Northwestern Radio Partnership (Dekkerco Holdings Ltd.)

For for a broadcasting licence to carry on an English-language FM radio programming undertaking at North Battleford. The new station would operate on frequency 97.9 MHz (channel 250C1) with an effective radiated power of 100 000 watts. The applicant is proposing a popular contemporary music format.

13. Prince Albert, Saskatchewan
Central Broadcasting Company Limited

For a broadcasting licence to carry on an English-language FM radio programming undertaking at Prince Albert. The new station would operate on frequency 101.5 MHz (channel 268C1) with an effective radiated power of 100 000 watts. The applicant is proposing a country music format.

14. Opaskwayak Cree Nation (The Pas), Manitoba
Russel C. Cook, on behalf of a non-profit organization to be incorporated

For a broadcasting licence to carry on an English- and Native-language FM (Type B) native radio programming undertaking at Opaskwayak Cree Nation, near The Pas. The new station would operate on frequency 96.1 MHz (channel 241LP) with an effective radiated power of 42.2 watts.

15. Pine Falls, Powerview and St. George, Manitoba
Regional Cable Tv (Western) Inc. (Regional)

Regional is requesting authority to acquire the assets of the cable distribution undertaking serving the above-mentioned localities. The applicant is also requesting to obtain a broadcasting licence to continue the operation of this undertaking, upon surrender of the current licence issued to Winnipeg River CATV Ltd., under the same terms and conditions as the current licence.

Alliance Atlantis Communications Inc. (AACI), on behalf of a company to be incorporated

For a broadcasting licence to carry on an English-language national programming undertaking (television specialty service) to be distributed on a discretionary basis via directto-home (DTH) satellite and cable broadcasting distribution undertakings (BDUs) in either analog or digital mode. The service would provide programming about food and nutrition.

Food Network Canada Inc. is the result of a tripartite agreement between AACI, Corus Entertainment Inc. (Corus) and Television Food Network G.P. (TVFN).

As part of the agreement, TVFN, which owns the American specialty service Food Network, has committed to request removal of its service, which is currently carried by some broadcasting distribution undertakings, from the Eligible Lists of Satellite Services once the proposed Canadian service launches.

According to the applicant, the proposed service is in the same genre as, and is intended to replace, the Food Network (United States) service.

The applicant proposes that the access rules apply insofar as they may be used to ensure analog carriage on all Class 1 BDUs which are carrying Food Network (United States) in analog mode at the time the proposed service is licensed.

With respect to those Class 1 BDU systems which are not carrying the American service in analog mode at that time, the applicant proposes to waive the benefit of the access rules and not enforce analog carriage on such systems. However, the applicant expects to be accorded the benefit of any access policy with respect to digital carriage on all BDU systems.

If the service is licensed, the applicant proposes to charge a basic carriage wholesale rate of $0.12 per subscriber per month.

The Commission heard an application by Power to establish a new FM station at Rimouski, which would replace the existing CFLP-AM station at Rimouski. The decision is still pending.
