The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-99-043) from Navatar, of Ottawa, Ontario, concerning a procurement (Solicitation No. W8480-9-0235/A) by the Department of Public Works and Government Services. The solicitation is for a National Individual Standing Offer for human resources consulting services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into this complaint.
It is alleged that the award process has not been conducted according to the Request for Proposal.

There were no submissions from affected parties to the Screening Officer with respect to any of the above claims for exemption and related MSDSs.
Each of the claims for exemption listed above was found to be valid. The Screening Officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. After consultation with officials of the Department of Health, and having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the claims bearing Registry Numbers 4122 and 4271 complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.
After consultation with officials of the Department of Health, and having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the remaining claims did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.
Registry Numbers 3706 and 3707
The claimant has been ordered to amend certain aspects of the content of the MSDS.
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.
1. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2A;
2. Disclose that grounded equipment be used when handling the controlled product;
3. Disclose an LC50 (4 hours, male rat) value of 6 700 ppm for xylene;
4. Disclose that chronic dermal exposure to an ingredient in the controlled product has been shown to cause dermatitis;
5. Disclose that an ingredient in the controlled product has been shown to cause fetotoxicity in laboratory animals.
Acknowledgement: Subsequent to the review of the MSDSs-of-Record respecting these particular claims, the claimant provided the Commission with copies of revised versions. These revised versions of the MSDSs were not, however, reviewed by the Screening Officer.
Registry Number 3912
The claimant has been ordered to amend certain aspects of the format of the MSDS.
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.
1. Disclose an LD50 (oral, rat) value of < 5 g/kg, an LD50 (dermal, rabbit) value of > 2 g/kg and an LC50 (4 hours, rat) value of 7.64 mg/L for the hydrocarbon solvent;
2. Disclose oxides of carbon and nitrogen as hazardous combustion products;
3. Disclose a statement to the effect that repeated dermal application of an ingredient in the controlled product has been shown to produce skin tumours in laboratory animals.
Registry Number 3938
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.
1. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be flushed continuously with lukewarm, gently flowing water for at least 20–60 minutes.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.
1. Disclose that skin contact can cause corrosion;
2. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be flushed with water for at least 20 minutes and that medical advice should be sought immediately;
3. In relation to the first aid information shown on the MSDS for ingestion, delete the current reference to "a minimum of 500 mL of water" and disclose that 250–300 mL of water be administered to the casualty to dilute the material in the stomach;
4. In relation to the first aid information shown on the MSDS for eye contact, disclose a statement to the effect that the eyes should be flushed continuously with lukewarm, gently flowing water for at least 20–30 minutes while taking care not to rinse contaminated water into the unaffected eye;
5. Add oxides of potassium, sulphur, nitrogen and carbon to the list of hazardous combustion products;
6. In the MSDS subsection concerning irritancy of the material, replace the word irritant with the word corrosive.
Acknowledgement: Subsequent to the review of the MSDS-of-Record respecting this particular claim, the claimant provided the Commission with a copy of a revised version. This revised version of the MSDS was not, however, reviewed by the Screening Officer.
Registry Numbers 4060 to 4062, inclusive
The claimant has been ordered to amend certain aspects of the content of the MSDS.
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.
1. Indicate that the MSDS pertains to all three controlled products;
2. Clearly disclose which ingredients are contained in each controlled product;
3. Disclose an LD50 (oral, rat) value of 3 160 mg/kg for silicon dioxide, amorphous;
4. Disclose a lower LD50 value for one of the confidential hazardous ingredients;
5. Disclose an LC50 (4 hours, rat) value of 14 250 mg/m3 for methylene chloride;
6. Disclose that ingredients in the controlled product are considered to be somatic cell mutagens based on positive results in in vivo screening tests;
7. Disclose that ingredients in the controlled product have shown positive results in screening tests for mutagenicity.
Registry Number 4121
The claimant has been ordered to amend certain aspects of the content of the MSDS.
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.
1. Disclose the presence of an additional confidential hazardous ingredient in the controlled product by deleting the words "WHMIS : not hazardous" in relation to the ingredient referred to on the MSDS as carboxylic acid, and by clearly indicating that the chemical identity and CAS Registry Number of that ingredient are included in the claim for exemption;
2. Disclose an LD50 range value for one of the confidential hazardous ingredients;
3. Disclose that an ingredient in the controlled product has been shown to cause skin irritation in laboratory animals;
4. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be flushed with water for at least 20 minutes or until the chemical is removed, contaminated clothing, footwear and leather goods should be removed under running water and medical advice obtained immediately.
Registry Number 4123
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.
1. Disclose that an ingredient in the controlled product has shown positive results in a screening test for mutagenicity.

The claimant has been ordered to amend certain aspects of the format of the MSDS.
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.
1. Disclose the percent concentration of one of the confidential hazardous ingredients in an acceptable manner;
2. Add carbon dioxide and oxides of nitrogen to the list of hazardous combustion products;
3. Disclose skin contact, eye contact, inhalation and ingestion as routes of entry;
4. Disclose an LD50 value for one of the confidential hazardous ingredients in an acceptable manner;
5. Disclose LD50 values and an LC50 value for one of the confidential hazardous ingredients in an acceptable manner.
Acknowledgement: Subsequent to the review of the MSDS-of-Record respecting this particular claim, the claimant provided the Commission with a copy of a revised version. This revised version of the MSDS was not, however, reviewed by the Screening Officer.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.
1. Disclose the presence of an additional confidential hazardous ingredient in the controlled product by deleting the words "WHMIS : not hazardous" in relation to the ingredient referred to on the MSDS as polyalkylene glycol, and by clearly indicating that the chemical identity and CAS Registry Number of that ingredient are included in the claim for exemption;
2. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause adverse effects on the kidneys of laboratory animals;
3. Disclose that chronic absorption of an ingredient in the controlled product has been shown to cause adverse effects on the heart muscles and brain and also anaemia in laboratory animals.
Registry Number 4134
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.
1. Disclose an LD50 value for one of the confidential hazardous ingredients in an acceptable manner;
2. Disclose that chronic ingestion of an ingredient in the controlled product has been shown to cause adverse effects on sperm production in laboratory animals.

2. Disclose the Exposure Limit Value NIOSH IDLH = 25 mg/m3 for calcium oxide;
3. Disclose the ACGIH TLV-TWA value (respirable fraction) = 3 mg/m3 for diatomaceous earth containing less than 1 percent crystalline silica;
4. Disclose that an ingredient in the controlled product is incompatible with bromine pentafluoride.
Acknowledgement: Subsequent to the review of the MSDS-of-Record respecting this particular claim, the claimant provided the Commission with a copy of a revised version. This revised version of the MSDS was not, however, reviewed by the Screening Officer.

The claimant has been ordered to amend certain aspects of the content of the MSDS.
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.
1. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause auto-immune disease;
2. Revise the MSDS to show that crystalline silica has been classified as carcinogenic to humans (Group 1) by the International Agency for Research on Cancer (IARC);
3. Disclose that an ingredient in the controlled product has been shown to cause mutagenic effects in mammalian and human cells, in vitro;
4. Disclose the Exposure Limit Value NIOSH IDLH = 25 mg/ m3 for calcium oxide;
5. Disclose that an ingredient in the controlled product is incompatible with bromine pentafluoride.

Registry Numbers 4161, 4209 and 4210

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.
1. Registry Number 4209: Disclose the presence of an additional confidential hazardous ingredient in the controlled product.
Acknowledgement: Subsequent to the review of the MSDSs-of-Record respecting these particular claims, the claimant provided the Commission with copies of revised versions. These revised versions of the MSDSs were not, however, reviewed by the Screening Officer.
Registry Number 4180
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.
1. Disclose the presence of amorphous silicon dioxide in the controlled product, its CAS Registry Number, and its percent concentration.
2. Disclose the presence of phenol in the controlled product, its CAS Registry Number and its percent concentration;
3. Disclose the percent concentrations of "dimer/TOFA, reaction products with TETA", triethylenetetramine and carbon black in an acceptable manner;
4. Disclose the Exposure Limit Value AIHA WEEL-TWA = 1 ppm (skin) for triethylenetetramine;
5. Add inhalation as a primary route of entry;
6. In relation to the first aid information shown on the MSDS for inhalation, add that immediate medical assistance should be obtained;
7. In relation to the first aid information shown on the MSDS for ingestion, delete the current reference to "lots" of milk or water and disclose that 250–300 mL of water be administered to the casualty to dilute the material in the stomach. Add information to the effect that no attempt should be made to give anything by mouth to a person who is rapidly losing consciousness, or is unconscious or convulsing, and that if vomiting occurs naturally, have the casualty lean forward to reduce the risk of aspiration and repeat the administration of water;
8. Disclose an LD50 (oral, rat) value of 340 mg/kg, an LD50 (dermal, rabbit) value of 0.625 mL/kg and an LC50 (8 hours, rat) value of > 1 800 mg/m3 for phenol;
9. Disclose an LC50 (1 hour, rat) value of 27 000 mg/m3 for carbon black;
10. Disclose a lower LD50 (dermal, rabbit) value for triethylenetetramine;
11. Replace the LD50 (oral, rat) value for tetraethylenepentamine with a value of 3 224 mg/kg;
12. Disclose that an ingredient in the controlled product has been shown to cause fetotoxic effects in laboratory animals;
13. Disclose that an ingredient in the controlled product is considered to be a germ cell mutagen based on positive results in in vivo screening tests and that an ingredient in the controlled product is considered to be a somatic cell mutagen based on positive results in an in vivo screening test;
14. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D1B.
Registry Numbers 4198, 4199 and 4254
The claimant has been ordered to amend certain aspects of the content of the MSDS.
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.
1. Disclose LD50 values for one of the confidential hazardous ingredients.
Registry Number 4253
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.
1. Disclose oral LD50 values and the values of lower bounds for the dermal LD50 for two of the confidential hazardous ingredients;
2. Disclose the value of a lower bound for the LC50 value for one of the confidential hazardous ingredients;
3. Disclose that an ingredient in the controlled product has shown positive results in a screening test for mutagenicity;
4. Correct the impression that alkylated phenol is a regulated component of the controlled product;
5. Remove the inference from section 16 of the MSDS that diphenylamine is not a WHMIS hazardous ingredient.
Registry Numbers 4263 and 4264
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.
1. Add oxides of nitrogen to the list of hazardous thermal decomposition products;
2. Disclose the value of a lower bound for the LC50 value for the controlled product.
Registry Number 4265
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.
1. Disclose the presence of an additional confidential hazardous ingredient in the controlled product;
2. Correct the impression that alkylated phenol is a regulated component of the controlled product.
Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the Screening Officer has, for each of the above-noted claims, with the exceptions of those claims bearing Registry Numbers 4122 and 4271, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the Screening Officer within 40 days of expiry of the appeal period.
Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the Screening Officer, should have been shown on the relevant MSDS.
Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.
Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal any decision or order of a Screening Officer. To initiate the appeal process, a Statement of Appeal (Form 1) as prescribed by the Hazardous Materials Information Review Act Appeal Board Procedures Regulations must be completed and delivered within 45 days of the publication of this notice in the Canada Gazette, Part I, to the Chief Appeals Officer at the following address: Hazardous Materials Information Review Commission, 200 Kent Street, Suite 9000, Ottawa, Ontario K1A 0M1, (613) 993-4472.
