CANADIAN INTERNATIONAL TRADE TRIBUNAL

DETERMINATION

Communications, Detection and Fibre Optics

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2000-010) on October 12, 2000, with respect to a complaint filed by Thomson-CFS Systems Canada Inc. (the complainant), of Nepean, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. F7018-9-0073/A) by the Department of Public Works and Government Services (the Department) on behalf of the Canadian Coast Guard. The solicitation was for the provision of a Very High Frequency Digital Selective Calling (VHF DSC) Global Maritime Distress and Safety System and related equipment, material and services.

The complainant alleged that the Department improperly evaluated several proposals as being compliant.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was not valid.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2000-035) from TELUS Integrated Communications Inc., of Ottawa, Ontario, concerning a procurement (Solicitation No. 21120-00-7510) by the Correctional Service of Canada (CSC). The solicitation is for the installation and operation of a telephone system to be used by inmates in federal correctional facilities. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into this complaint.

It is alleged that the CSC has improperly evaluated a submission from another bidder as being compliant.

PRELIMINARY DETERMINATION OF INJURY

Dumping and Subsidizing of Certain Grain Corn

In the matter of a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2000-001), under subsection 34(2) of the Special Import Measures Act, respecting the dumping and subsidizing of certain grain corn originating in or exported from the United States of America and imported into Canada for use or consumption west of the Manitoba-Ontario border

On August 9, 2000, the Acting Director General, Anti-dumping and Countervailing Directorate, Canada Customs and Revenue Agency, notified the Canadian International Trade Tribunal that an investigation had been initiated into the alleged injurious dumping and subsidizing of grain corn in all forms, excluding white dent corn imported by snack food and tortilla manufacturers for use by them in the manufacture of snack food and tortillas, seed corn (used for reproductive purposes), sweet corn and popping corn, originating in or exported from the United States of America and imported into Canada for use or consumption west of the Manitoba-Ontario border.

Following receipt of the notice, the Canadian International Trade Tribunal, under the provisions of subsection 34(2) of the Special Import Measures Act, has conducted a preliminary inquiry into whether the evidence discloses a reasonable indication that the dumping and subsidizing of the above-mentioned grain corn have caused injury to the domestic industry.

Pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby determines that the evidence discloses a reasonable indication that the dumping and subsidizing of the above-mentioned grain corn have caused injury to the domestic industry.

The statement of reasons will be issued within 15 days.

Applications for the re-issuance of all of the broadcasting licences currently held by the partners of Canal Indigo to reflect the replacement of TQS Inc. with Commandité TQS as a Canal Indigo licensee. The transfer of the Canal Indigo licenses from TQS to Commandité TQS is not intended to change any of the existing terms and conditons of the said licenses.

PUBLIC NOTICE 2000-141

Amendments to CRTC Rules of Procedure

The Commission hereby announces that it has made amendments to the CRTC Rules of Procedure (the Rules), rules that govern procedure in broadcasting matters. The amendments reduce the minimum period that must elapse between the time that notice of an application is published in the Canada Gazette and the date of a public hearing to consider the application. Before the amendments, the Rules specified that this minimum period was 50 days; now the minimum period is 30 days.

The amendments, adopted as proposed, are set out in Rules Amending the CRTC Rules of Procedure, a copy of which is appended to the notice.

As the Commission stated in Public Notice CRTC 2000-111, in which it proposed the amendment, a 50-day minimum publication period is appropriate in many cases. In other cases, however, it has limited the flexibility and planning ability of the Commission.

The Commission stresses that it will not utilize the shorter publication period without considering whether it is warranted, taking into account all of the circumstances surrounding an application.

The Commission called for comments on the proposed amendments in Public Notice CRTC 2000-111 on August 3, 2000. The deadline for receipt of comments was September 5, 2000. Twelve comments were received, including one that opposed the proposed amendments. The Commission acknowledges those who filed comments and thanks them for their interest.

CANADIAN RADIO-TELEVISION AND TELECOMMUNICATIONS COMMISSION

PUBLIC NOTICE 2000-142

Amendments to section 10 of the Broadcasting Distribution Regulations for the purpose of implementing a revised policy on access to inside wire

The Commission hereby announces that it has made amendments to section 10 of the Broadcasting Distribution Regulations thereby giving effect to its revised policy concerning access to inside wire announced in Public Notice CRTC 2000-81 dated June 9, 2000.

The amendments, adopted as originally proposed by the Commission in its June 2000 notice, were made on September 15, 2000 and came into force upon their registration with the Clerk of the Privy Council on September 18, 2000 (SOR/2000-356). They were published in the Canada Gazette, Part II, on September 27, 2000. A copy of the amendments is appended to the notice.

In its call for comments on the proposed amendments, the Commission had set a deadline of July 10, 2000, for the receipt of submissions. The Commission, in Public Notice CRTC 2000- 81-1 dated July 17, 2000, subsequently extended this deadline to August 21, 2000. The Commission acknowledges the comments contained in the 18 submissions filed in response to the call. It notes, however, that relatively few of the parties commented on the specific wording of the proposed amendments. Rather, many parties addressed their comments to the revised policy concerning inside wire, as announced in Public Notice 2000-81. The Commission nonetheless thanks all parties for their interest.

With respect to the specific wording of the amendment, the CCTA (Canadian Cable Television Association) submitted that the proposed amendment appears to require a licensee to respond to a request by any third party for the use of the inside wire, regardless of whether or not the third party is acting on behalf of the subscriber. The CCTA submitted that the wording be revised to clarify that a request under subsection 10(1) must be made by a subscriber, or an agent acting on behalf of the subscriber, for the provision of service.

The Commission is of the view that such an amendment is not necessary. It can be expected that a third party seeking to use the inside wire would do so for the purpose of providing services to subscribers.

Certain parties also suggested that section 10 of the Regulations should stipulate that, in single unit dwellings, there would be no charge for use of the inside wire and, in multi-unit dwellings, there would be no charge for use of inside wire more than five years old.

The Commission considers these proposed amendments to be unnecessary. In Public Notice 2000-81, the Commission noted that the cable industry has generally advocated a charge only for wiring in multi-unit dwellings and only for wiring that is less than five years old. Accordingly, in that notice, the Commission requested that the CISC (CRTC Interconnection Steering Committee) cable working group meet to develop an appropriate rate for such wiring, and that the rate be put in place within two months of the coming into effect of the regulatory amendment. Alternatively, if consensus was not reached within that period, the Commission indicated that the CISC should submit any dispute to the Commission for resolution.

Persons who wish to participate in the working group or who otherwise wish to receive the documentation relating to the work of the group must notify the Commission of their interest within ten days of the date of this Public Notice.
