SPECIAL IMPORT MEASURES ACT

Garlic — Decision

On October 31, 2000, the Commissioner of Customs and Revenue initiated an investigation under the Special Import Measures Act into the alleged injurious dumping of garlic, fresh or frozen, originating in or exported from the People's Republic of China and Vietnam, excluding fresh garlic subject to the finding made in the Canadian International Trade Tribunal Inquiry No. NQ-96-002.

The goods in question are usually classified under the following Harmonized System classification numbers: 0703.20.00.00 and 0710.80.90.90.

The Canada Customs and Revenue Agency (CCRA) will conduct the investigation into the alleged dumping. In addition, the Canadian International Trade Tribunal will now conduct a preliminary inquiry into the question of injury to the Canadian industry. The Tribunal will make a decision within 60 days of the date of initiation. If the Tribunal concludes that the evidence does not disclose a reasonable indication of injury, the investigation will be terminated.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Garlic

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on October 31, 2000, from the Acting Director General of the Anti-dumping and Countervailing Directorate at the Canada Customs and Revenue Agency (CCRA) stating that the Commissioner of the CCRA had initiated an investigation into a complaint respecting the alleged injurious dumping in Canada of garlic, fresh or frozen, originating in or exported from the People's Republic of China and Vietnam, excluding fresh garlic subject to the finding made in the Canadian International Trade Tribunal Inquiry No. NQ-96-002.

Pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), the Tribunal has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2000-002) to determine whether the evidence discloses a reasonable indication that the dumping of the subject goods has caused material injury or retardation or is threatening to cause material injury, as these words are defined in SIMA.

The Tribunal's inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the inquiry must file a notice of participation with the Secretary on or before November 15, 2000. Each counsel who intends to represent a party in the inquiry must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before November 15, 2000.

On November 21, 2000, the Tribunal will distribute the public information received from the Commissioner to all parties that filed notices of participation, and the confidential information to counsel who filed a declaration and undertaking with the Tribunal.

Submissions by parties opposed to the complaint must be filed on or before November 30, 2000. These submissions should include evidence, e.g. documents and sources which support the factual statements in the submissions, and argument concerning the questions of:

— whether there are goods produced in Canada, other than those identified in the Commissioner's statement of reasons for initiating the investigation, that are like goods to the allegedly dumped or subsidized goods;

— whether there is more than one class of allegedly dumped or subsidized goods;

— which domestic producers of like goods comprise the domestic industry; and

— whether the information before the Tribunal discloses a reasonable indication that the alleged dumping or subsidizing of the goods has caused material injury or retardation, or threatens to cause material injury.

The complainant may make submissions in response to the submissions of parties opposed to the complaint by December 8, 2000. At that time, other parties supporting the complaint may also make submissions to the Tribunal.

Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made. The Canadian International Trade Tribunal Rules govern these proceedings.

All submissions must be filed with the Tribunal in 20 copies. The Tribunal will distribute the public submissions to all parties that filed notices of participation and any confidential submissions to counsel who have filed a declaration and undertaking.

Along with the notice of commencement of preliminary injury inquiry, the Secretary has sent a letter to the domestic producers, to importers and to exporters with a known interest in the inquiry which provides details on the procedures and the schedule for the inquiry. Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2000-028) on November 1, 2000, with respect to a complaint filed by Global Upholstery Co. Inc. (the complainant), of Downsview, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985, (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. 19150-00T120/B) of the Department of Public Works and Government Services (the Department) on behalf of the Department of Justice. The solicitation was for the supply, delivery and installation of free-standing desk product components.

The complainant alleged that the Department has included a mandatory delivery time frame that is not essential to the requirement.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement and the Agreement on Government Procurement, the Tribunal determined that the complaint was not valid.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File Nos. PR-2000-017 and PR-2000-035) on November 2, 2000, with respect to two complaints filed by TELUS Integrated Communications Inc. (the complainant), of Ottawa, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. 21120-00-7510) by the Correctional Service of Canada (CSC). The solicitation was for the installation and operation of a telephone system to be used by inmates in federal correctional facilities.

The complainant alleged that the CSC had violated a number of the provisions of the Agreement on Internal Trade.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaints were valid.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2000-037) from Computer Talk Technology, Inc., of Richmond Hill, Ontario, concerning a procurement (Solicitation No. V9345-000020/A) by the Department of Public Works and Government Services (the Department). The solicitation is for the provision, maintenance and operation of a network of integrated Interactive Voice Response Systems, Computer Telephony Integration applications and toll-free services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into this complaint.

Access by Canadian Treaty Co-productions to Funding from Certified Independent Production Funds — Call for Comments on a Proposed Amendment to the Eligibility Criteria

Background

The Broadcasting Distribution Regulations set out requirements for contributions by licensees to local expression and to Canadian programming. They stipulate that Class 1 and Class 2 licensees, and licensees of direct-to-home satellite distribution undertakings, may direct up to 20 percent of their required Canadian programming contributions to one or more independently administered production funds.

In order to qualify as "independently administered," production funds must meet the criteria set out in Public Notices CRTC 1997-98 and 1999-29. One of the criteria identified in Public Notice 1997-98 is that productions receiving funding must generally earn at least eight out of ten points related to various key creative program elements.

Treaty co-productions are programs produced under treaties between Canada and other countries. They are not subject to the eight-out-of-ten point requirement. Instead, under an amendment announced by the Commission in Public Notice CRTC 1996-51, Canadian treaty co-productions approved as such by Telefilm Canada may qualify for access to funding provided 65 percent or more of their financing is by a Canadian company (the 65 percent financing requirement).

Proposal for an amendment to the criteria in respect of treaty co-productions

In July of this year, the Commission received a letter on behalf of the Independent Production Fund, the Bell Broadcast and New Media Fund, and the Cogeco Program Development Fund. The letter contains a proposal that the Commission amend the criteria related to Canadian treaty co-productions by removing the 65 percent financing requirement. To qualify for access to funding under this proposal, a Canadian treaty co-production would simply require approval as such by Telefilm Canada.

This amendment would be in addition to the requirements with respect to each of the other criteria identified in Public Notices 1997-98 and 1999-29. The letter notes that the proposed change would be consistent with the eligibility requirements concerning access by co-productions to the Canadian Television Fund.

Call for comments

The Commission seeks comments on the above proposal and will accept comments received on or before December 1, 2000.

Although the Commission will not formally acknowledge receipt of written comments, it will give full consideration to each, and they will form part of the public file, provided that the filing procedures set out below are followed.

Procedures for filing comments

Interested parties can file their comments on paper or electronically. Submissions longer than five pages should include a summary.
