SPECIAL IMPORT MEASURES ACT

Corrosion-Resistant Steel Sheet — Decision

On December 4, 2000, the Commissioner of Customs and Revenue initiated an investigation under the Special Import Measures Act into the alleged injurious dumping of flat-rolled steel sheet products of a thickness not exceeding 0.176 in. (4.47 mm), coated or plated with zinc or an alloy wherein zinc and iron are the predominant metals, excluding corrosion-resistant steel sheet products for use in the manufacture of passenger automobiles, buses, trucks, ambulances or hearses or chassis therefor, or parts, accessories or parts thereof, for which the proper Harmonized System tariff item is 9959.00.00, originating in or exported from the People's Republic of China, India, Malaysia, Portugal, the Russian Federation, South Africa and Chinese Taipei and the alleged subsidizing of the same goods originating in or exported from India.

The Canada Customs and Revenue Agency will conduct an investigation into the alleged dumping and subsidizing. In addition, the Canadian International Trade Tribunal (the Tribunal) will now conduct a preliminary inquiry into the question of injury to the Canadian industry. Call for Comments: Contents of the Public File for Upcoming Television Ownership Group Renewal Hearings

Background

1. Television renewal applications are scheduled for consideration at two upcoming public hearings. Applications to renew the network and Montréal licences held by the TVA television group will be heard at a public hearing to be held in March 2001. Renewal applications for the licences held by the CTV and Global television groups will be heard at a public hearing to be held in April 2001.

2. In order to foster open and informed public discussion, the Commission considers that it may be appropriate to place certain information concerning each of these television groups on the public files for these hearings. This additional information would include details that the Commission has not generally made publicly available in the past. The Commission did, however, place similar information on the public file pertaining to Public Notice CRTC 1998-44 dated May 6, 1998, entitled Canadian Television Policy Review — Call for Comments.

3. The Commission invites interested parties to comment on the proposal outlined below.

The Notice of Filing published in the Canada Gazette, Part I, on June 28, 1997, listed the subject of the claim bearing Registry Number 4003 to be the chemical identity and concentration of nine ingredients. It has since been established that the subject of the claim is the chemical identity and concentration of fifteen ingredients.

7. The Notice of Filing published in the Canada Gazette, Part I, on April 25, 1998, listed the subject of the claim bearing Registry Number 4192 to be the chemical identity and concentration of three ingredients. It has since been established that the subject of the claim is the chemical identity and concentration of four ingredients.

8. The Notice of Filing published in the Canada Gazette, Part I, on August 8, 1998, listed the subject of the claim bearing Registry Number 4236 to be the chemical identity and concentration of two ingredients. It has since been established that the subject of the claim is the chemical identity and concentration of three ingredients.

9. The Notice of Filing published in the Canada Gazette, Part I, on January 30, 1999, listed the subject of the claim bearing Registry Number 4272 to be the chemical identity and concentration of two ingredients. It has since been established that the subject of the claim is the chemical identity and concentration of three ingredients.

10. The Notice of Filing published in the Canada Gazette, Part I, on January 30, 1999, listed the subject of the claim bearing Registry Number 4292 to be the chemical identity of one ingredient. It has since been established that the subject of the claim is the chemical identity of two ingredients.

There were no submissions from affected parties to the Screening Officer with respect to any of the above claims for exemption and related MSDSs.

Each of the claims for exemption listed above was found to be valid. The Screening Officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. After consultation with officials of the Department of Health, and having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the claims bearing Registry Numbers 3762, 3763, 3764, 4236, 4304, 4305 and 4306 complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

After consultation with officials of the Department of Health, and having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the remaining claims did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Registry Numbers 3760 and 3761

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose the presence of an additional confidential hazardous ingredient in the controlled product.

Registry Number 3765

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. Disclose an LD50 value for one of the confidential hazardous ingredients in an acceptable manner.

Registry Numbers 3995 to 4011, inclusive

The claimant has been ordered to amend certain aspects of the format and content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose the Exposure Limit Values for three of the confidential hazardous ingredients;

2. Disclose LD50 values for two of the confidential hazardous ingredients in an acceptable manner;

3. Disclose an LD50 (dermal, rabbit) value and a lower bound to the oral LD50 value for one of the confidential hazardous ingredients;

4. Registry Number 4000:

(a) Disclose the Exposure Limit Values for one of the confidential hazardous ingredients;

(b) Disclose an LC50 value for one of the confidential hazardous ingredients in an acceptable manner;

(c) Disclose that an ingredient in the controlled product has been shown to be mutagenic, in vivo;

5. Registry Number 4003: Disclose the presence of six additional hazardous ingredients in the controlled product, together with their percent concentrations;

6. Registry Numbers 3997, 3999 and 4004: Disclose the presence of five additional hazardous ingredients in the controlled product, together with their percent concentrations;

7. Registry Numbers 4000, 4001, 4005 and 4009: Disclose that an ingredient in the controlled product has been classified as possibly carcinogenic to humans (Group 2B) by the International Agency for Research on Cancer (IARC);

8. Registry Numbers 3995, 3996, 3998, 4000, 4001, 4002, 4005, 4006, 4007, 4008, 4009, 4010 and 4011: Disclose the presence of four additional hazardous ingredients in the controlled product, together with their percent concentrations.

Registry Number 4179

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Remove the declaration that the percent concentrations of the confidential hazardous ingredients are “<100”;

2. Disclose the percent concentration of diphenylamine in an acceptable manner;

3. In relation to the first aid information shown on the MSDS for eye contact, disclose that flushing should continue for at least 20 minutes or until the chemical is removed;

4. Disclose that the ingredient alkylated diphenylamines has been shown to cause dermal sensitization in laboratory animals.

Registry Number 4186

The claimant has been ordered to amend certain aspects of the content and wording of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose an LC50 (1 hour, rat) range of 1.26 mg/L to 2.83 mg/L for synthetic amorphous silica;

2. Add oxides of nitrogen to the list of hazardous combustion products;

3. Disclose that one of the methacrylate esters has been shown to cause dermal sensitization in laboratory animals;

4. Disclose that an ingredient in the controlled product has been shown to be mutagenic, in vivo.

Acknowledgement: Subsequent to the review of the MSDS-of-Record respecting this particular claim, the claimant provided the Commission with a copy of a revised version. This revised version of the MSDS was not, however, reviewed by the Screening Officer.

Registry Number 4187

The claimant has been ordered to amend certain aspects of the content and wording of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose an LD50 value for one of the confidential hazardous ingredient;

2. Disclose an LC50 (1 hour, rat) range of 1.26 mg/L to 2.83 mg/L for synthetic amorphous silica;

3. Add oxides of nitrogen to the list of hazardous combustion products;

4. Disclose that acute ingestion of an ingredient in the controlled product has been shown to cause adverse CNS effects in laboratory animals;

5. Revise the MSDS to show that crystalline silica has been classified as carcinogenic to humans (Group 1) by the International Agency for Research on Cancer (IARC);

6. Disclose that an ingredient in the controlled product has shown positive results in screening tests for mutagenicity;

7. Disclose that the methacrylate esters have been shown to cause dermal sensitization in laboratory animals.

Acknowledgement: Subsequent to the review of the MSDS-of-Record respecting this particular claim, the claimant provided the Commission with a copy of a revised version. This revised version of the MSDS was not, however, reviewed by the Screening Officer.

2. In relation to the first aid information shown on the MSDS for eye contact, disclose that flushing should continue for at least 20-30 minutes;

3. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be flushed continuously with lukewarm, gently flowing water for at least 20-30 minutes.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. Disclose that asthma-like responses are possible effects of exposure to methyl methacrylate;

2. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be flushed with water for 20-30 minutes or until the chemical is removed;

3. Disclose that an ingredient in the controlled product has shown positive results in a screening test for mutagenicity.

Registry Number 4292

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. Delete the statement “Not hazardous” from the entry for the confidential hazardous ingredient alkyl alkoxy alcohol and indicate that it is an ingredient required to be disclosed in the hazardous ingredient section of the MSDS;

2. Disclose that asthma-like responses are possible effects of exposure to methyl methacrylate;

3. Disclose an LC50 (4 hours, rat) value of 7.1 mg/L for methacrylic acid;

4. Disclose that an ingredient in the controlled product has shown positive results in a DNA-cell-binding assay screening test for mutagenicity;

5. Disclose that an ingredient in the controlled product has shown positive results in screening tests for mutagenicity.

Registry Number 4293

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. Disclose that asthma-like responses are possible effects of exposure to methyl methacrylate;

2. Disclose an LC50 (4 hours, rat) value of 7.1 mg/L for methacrylic acid;

3. Disclose that an ingredient in the controlled product has shown positive results in a DNA-cell-binding assay screening test for mutagenicity;

4. Disclose that an ingredient in the controlled product has shown positive results in screening tests for mutagenicity.

Registry Number 4297

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be washed with water for 20 minutes or until the chemical is removed.

Registry Numbers 4333 and 4334

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose Exposure Limit Values for two of the confidential hazardous ingredients;

2. Disclose a more precise pH for the controlled product;

3. Disclose that an ingredient in the controlled product has been shown to cause adverse reproductive effects in laboratory animals;

4. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be washed with water for 20 minutes or until the chemical is removed;

5. In relation to the first aid information shown on the MSDS for ingestion, disclose a statement such as the following: Never give anything by mouth if the casualty is rapidly losing consciousness, or is unconscious or convulsing. Have casualty drink 250-300 mL of water to dilute the ingested material.

Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the Screening Officer has, for each of the above-noted claims, with the exceptions of those claims bearing Registry Numbers 3762, 3763, 3764, 4236, 4304, 4305 and 4306, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the Screening Officer within 40 days of expiry of the appeal period.

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the Screening Officer, should have been shown on the relevant MSDS.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal any decision or order of a Screening Officer. To initiate the appeal process, a Statement of Appeal (Form 1) as prescribed by the Hazardous Materials Information Review Act Appeal Board Procedures Regulations must be completed and delivered within 45 days of the publication of this notice in the Canada Gazette, Part I, to the Chief Appeals Officer at the following address: Hazardous Materials Information Review Commission, 200 Kent Street, Suite 9000, Ottawa, Ontario K1A 0M1, (613) 993-4472.
