Flat Hot-Rolled Carbon and Alloy Steel Sheet and Strip — Decision

On January 19, 2001, the Commissioner of Customs and Revenue initiated an investigation pursuant to subsection 31(1) of the Special Import Measures Act into the alleged injurious dumping into Canada of flat hot-rolled carbon and alloy steel sheet and strip, including secondary or non-prime material, originating in or exported from Brazil, Bulgaria, the People's Republic of China, Chinese Taipei, India, the Republic of Korea, the former Yugoslav Republic of Macedonia, New Zealand, Saudi Arabia, South Africa, Thailand, Ukraine and the Federal Republic of Yugoslavia, as well as the alleged injurious subsidizing of the same goods originating in or exported from India, in various widths from 3/4 in. (19 mm) and wider and:

(a) for product in coil form, in thicknesses from 0.054 in. to 0.625 in. (1.37 mm to 15.875 mm) inclusive;

(b) for product that is cut-to-length, in thicknesses from 0.054 in. up to but not including 0.187 in. (1.37 mm up to but not including 4.75 mm),

excluding flat-rolled stainless steel sheet and strip and flat hot-rolled, cut-to-length alloy steel products containing no less than 11.5 percent manganese, in thicknesses from 3 mm to 4.75 mm.

The Canada Customs and Revenue Agency will conduct an investigation into the alleged dumping and subsidizing and will render a preliminary decision within 90 days. In addition, the Canadian International Trade Tribunal (the Tribunal) will now conduct a preliminary inquiry into the question of injury to the Canadian industry. The Tribunal will make a decision within 60 days of the date of initiation. If the Tribunal concludes that the evidence does not disclose a reasonable indication of injury, the investigation will be terminated.

SPECIAL IMPORT MEASURES ACT

Pulp-dewatering Screw Presses — Decision

On January 19, 2001, pursuant to paragraph 35(2)(a) of the Special Import Measures Act, the Commissioner of Customs and Revenue terminated an investigation into the alleged injurious dumping of pulp-dewatering screw presses, assembled or unassembled, originating in or exported from Norway, produced by or on behalf of Kvaerner Pulping a.s., its affiliates, successors and assigns.

The Canada Customs and Revenue Agency has concluded all proceedings with regard to the dumping investigation.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

COMMENCEMENT OF INVESTIGATION

Woven Fabrics of Combed Wool

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) is satisfied that the request (Request No. TR-2000-005) received from Peerless Clothing Inc. (the requester) of Montréal, Quebec, is properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of woven fabrics, solely of combed wool or mixed solely with cotton, silk or man-made fibres, containing 95 percent or more by weight of worsted wool having an average fibre diameter of 18.5 microns or less, of a weight not exceeding 220 g/m, of tariff item No. 5112.11.90, for use in the manufacture of men's suits, jackets, blazers, vests (waistcoats) and trousers (the subject fabrics). The requester has asked the Tribunal to conduct its investigation expeditiously. The Tribunal has examined the request and is not persuaded that the circumstances constitute critical circumstances.

The Tribunal will conduct an investigation under section 19 of the Canadian International Trade Tribunal Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabrics, which are classified under tariff item No. 5112.11.90.

The Tribunal's investigation was commenced on January 24, 2001, and will be conducted by way of written submissions. To participate in the Tribunal's investigation, the requester or an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before February 21, 2001. The Tribunal's recommendations to the Minister of Finance are scheduled to be issued by May 24, 2001.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Flat Hot-Rolled Carbon and Alloy Steel Sheet and Strip

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on January 19, 2001, from the Acting Director General of the Anti-dumping and Countervailing Directorate at the Canada Customs and Revenue Agency (CCRA) stating that the Commissioner of the CCRA had initiated an investigation into a complaint respecting the alleged injurious dumping of certain flat hot-rolled carbon and alloy steel sheet and strip originating in or exported from Brazil, Bulgaria, the People's Republic of China, Chinese Taipei, India, the Republic of Korea, the former Yugoslav Republic of Macedonia, New Zealand, Saudi Arabia, South Africa, Thailand, Ukraine and the Federal Republic of Yugoslavia, and the alleged injurious subsidizing of certain flat hot-rolled carbon and alloy steel sheet and strip originating in or exported from India.

For the purpose of this investigation, certain flat hot-rolled carbon and alloy steel sheet and strip are defined as follows:

Flat hot-rolled carbon and alloy steel sheet and strip, including secondary or non-prime material, in various widths from 3/4 in. (19 mm) and wider, and

(a) for product in coil form, in thicknesses from 0.054 in. to 0.625 in. (1.37 mm to 15.875 mm) inclusive,
(b) for product that is cut-to-length, in thicknesses from 0.054 in. up to but not including 0.187 in. (1.37 mm up to but not including 4.75 mm),

excluding flat-rolled stainless steel sheet and strip and flat hot-rolled cut-to-length alloy steel products containing no less than 11.5 percent manganese, in thicknesses from 3 mm to 4.75 mm.

Pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), the Tribunal has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2000-006) to determine whether the evidence discloses a reasonable indication that the dumping and subsidizing of the subject goods have caused material injury or retardation or are threatening to cause material injury, as these words are defined in SIMA.

The Tribunal's inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the inquiry must file a notice of participation with the Secretary on or before February 2, 2001. Each counsel who intends to represent a party in the inquiry must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before February 2, 2001.

On February 8, 2001, the Tribunal will distribute the public information received from the Commissioner to all parties that filed notices of participation, and the confidential information to counsel who filed a declaration and undertaking with the Tribunal.

Submissions by parties opposed to the complaint must be filed on or before February 20, 2001. These submissions should include evidence, e.g. documents and sources which support the factual statements in the submissions, and argument concerning the questions of:

— whether there are goods produced in Canada, other than those identified in the Commissioner's statement of reasons for initiating the investigation, that are like goods to the allegedly dumped or subsidized goods;

— whether there is more than one class of allegedly dumped or subsidized goods;

— which domestic producers of like goods comprise the domestic industry; and

— whether the information before the Tribunal discloses a reasonable indication that the alleged dumping or subsidizing of the goods has caused material injury or retardation, or threatens to cause material injury.

The complainant may make submissions in response to the submissions of parties opposed to the complaint by February 28, 2001. At that time, other parties supporting the complaint may also make submissions to the Tribunal.

Pulp-dewatering Screw Presses

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on January 19, 2001, from the Acting Director General of the Anti-dumping and Countervailing Directorate at the Canada Customs and Revenue Agency (CCRA) stating that, pursuant to subparagraph 35(1)(a)(i) of the Special Import Measures Act (SIMA), the Commissioner of the CCRA was satisfied that there was insufficient evidence of dumping of pulp-dewatering screw presses, assembled or unassembled, originating in or exported from Norway and produced by or on behalf of Kvaerner Pulping a.s., its affiliates, successors and assigns to justify proceeding with the investigation. Accordingly, the Commissioner has caused the investigation to be terminated pursuant to paragraph 35(2)(a) of SIMA (Preliminary Injury Inquiry No. PI-2000-004).

The Tribunal, pursuant to subsection 35(3) of SIMA, hereby gives notice that it has terminated its preliminary injury inquiry as of January 19, 2001, with respect to pulp-dewatering screw presses, assembled or unassembled, originating in or exported from Norway and produced by or on behalf of Kvaerner Pulping a.s., its affiliates, successors and assigns.

PUBLIC NOTICE 2000-173-1

Proposals to Amend the Lists of Eligible Satellite Services Through the Inclusion of Additional Non-Canadian Services Eligible for Distribution on a Digital Basis Only

Following Public Notice CRTC 2000-173, the Commission received a proposal by the Canadian Cable Television Association (CCTA) to add a number of non-Canadian programming services to the lists of eligible satellite services (the lists). While the proposal was received by the deadline of January 12, 2001, the CCTA indicated it would be unable to file all of the required documentation before February 12, 2001. The Commission has approved the CCTA's request to extend the deadline until that date. The publication of all proposed additions to the lists, originally planned for January 26, 2001, is therefore delayed.

In Public Notice CRTC 2000-173, the Commission called for proposals to amend the lists of eligible satellite services through the inclusion of additional non-Canadian services eligible for distribution on a digital basis only. The deadline for receipt of proposals was January 12, 2001.

In the same notice, the Commission stated that, on or about January 26, 2001, it would issue a public notice providing a list of the proposals received and inviting comments from interested parties on the services that had been proposed.

On the deadline date of January 12, 2001, the CCTA filed a proposal to add a number of non-Canadian programming services to the new list of eligible satellite services, but was unable to file all of the required documentation for each of the services on that date. The CCTA indicated that it would provide the Commission with the remaining required documentation no later than February 12, 2001.

Considering the above, the Commission hereby informs interested parties that the publication of proposed additions to the lists will be delayed until after February 12, 2001.

The Commission wishes to state that the present notice is not an extension of the deadline date of the call for proposals to amend the lists. As part of the process outlined in Public Notice 2000-173, the Commission will consider only those proposals that had been received on January 12, 2001.

The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party", for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a work place, and includes

(a) a supplier of the controlled product;

(b) an employee at the work place;

(c) an employer at the work place;

(d) a safety and health professional for the work place;

(e) a safety and health representative or a member of a safety and health committee for the work place; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or
(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 200 Kent Street, Suite 9000, Ottawa, Ontario K1A 0M1.

Public Hearing

Pursuant to subsections 21(2), 23(1) and 23(2) of the Yukon Waters Act, the Yukon Territory Water Board will hold a public hearing on the following application for a water licence renewal on April 9, 2001, at Gold Rush Inn, Whitehorse, Yukon.
