On November 23, 2001, the Canadian International Trade Tribunal gave notice that it had initiated a review (Review No. TA-2001-001) of its recommendation to the Minister of Finance in Review No. TA-98-004, concerning certain ring-spun yarns, as implemented by Order in Council P.C. 1999-1342 dated July 28, 1999.

The Notice of Review indicated that a public hearing would be held in the Canadian International Trade Tribunal Hearing Room, Standard Life Centre, 18th Floor, 333 Laurier Avenue W, Ottawa, Ontario, commencing on March 13, 2002, at 9:30 a.m.

Notice is hereby given that the date of the commencement of the public hearing is changed to March 6, 2002, at 9:30 a.m.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2001-031) on January 9, 2002, with respect to a complaint filed by C.F. Industrial Products Inc. (the complainant), of Leamington, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. 23232-022002/A) by the Department of Public Works and Government Services on behalf of the Department of Agriculture and Agri-food. The solicitation was for the supply, installation, testing, commissioning and demonstration of two diesel engine generator units, complete with ancillary devices servicing.

The complainant alleged that the evaluation process was not conducted in accordance with the Request for Proposal.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement and the Agreement on Government Procurement, the Tribunal determined that the complaint was not valid.

PRELIMINARY DETERMINATION OF INJURY

Fresh Tomatoes

In the matter of a preliminary injury inquiry, under subsection 34(2) of the Special Import Measures Act, respecting the dumping of fresh tomatoes originating in or exported from the United States of America, excluding tomatoes for processing

The Canadian International Trade Tribunal, under the provisions of subsection 34(2) of the Special Import Measures Act, has conducted a preliminary injury inquiry (Inquiry No. PI-2001-002) into whether the evidence discloses a reasonable indication that the dumping of fresh tomatoes originating in or exported from the United States of America, excluding tomatoes for processing, has caused injury or retardation or is threatening to cause injury to the domestic industry.

This preliminary injury inquiry is pursuant to the notification, on November 9, 2001, by the Canada Customs and Revenue Agency, that an investigation had been initiated into the alleged injurious dumping of the above-mentioned goods.

Pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby determines that the evidence discloses a reasonable indication that the dumping of the above-mentioned goods has caused injury to the domestic industry.

The statement of reasons will be issued within 15 days.

C-34 (the "Act"), was filed with the undersigned at the Competition Tribunal by the Commissioner of Competition appointed under the Competition Act, in the matter of the proposed acquisition by Astral Media Inc. of all radio broadcasting operations of Telemedia Radio Inc. in the province of Quebec and the Maritimes, and of the 50 percent interest held by Telemedia Inc. in Radiomedia Inc. The respondents in this application are Astral Media Inc. ("Astral"), Telemedia Radio Inc. ("Telemedia") and Radiomedia Inc. ("Radiomedia").

The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the Screening Officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party," for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a work place, and includes

(a) a supplier of the controlled product;

(b) an employee at the work place;

(c) an employer at the work place;

(d) a safety and health professional for the work place;

(e) a safety and health representative or a member of a safety and health committee for the work place; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or

(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3.

APPLICATION FOR AUTHORIZATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Conectiv Energy Supply Inc.

Notice is hereby given that by an application dated January 11, 2002, Conectiv Energy Supply Inc. (the "Applicant") has applied to the National Energy Board (the "Board"), under Division II of Part VI of the National Energy Board Act (the "Act"), for authorization to export, over a 10-year term, up to 5 000 gigawatt-hours of firm and interruptible power and 5 000 gigawatt-hours of firm and interruptible energy in each year of the term. The electricity to be exported will be purchased by the Applicant from Canadian utility and independent generators, and others, who have excess electrical power and energy available on a firm of interruptible basis. The Applicant plans to undertake marketing activities throughout North America and the electricity to be exported may originate from any Canadian province.

The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending the Governor in Council that a public hearing be held. The Directions on Procedure that follow explain in detail the procedure that will be used.

1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at 252 Chapman Road, Newark, Delaware 19714, U.S.A. and provide a copy of the application to any person who requests a copy. (b) the impact of the exportation on the environment; and

(c) whether the Applicant has:

(i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and

(ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.

4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this Notice of Application and Directions on Procedure shall be filed with the Secretary of the Board and served on the party that filed the submission, by March 6, 2002.

5. Any reply that submitters wish to present in response to item 4 of this Notice of Application and Directions on Procedure shall be filed with the Secretary of the Board and served on the Applicant by March 18, 2002.

Notice is hereby given that, by application dated December 6, 2001, Direct Energy Marketing Limited (the "Applicant") has applied to the National Energy Board ("the "Board") under Division II of Part VI of the National Energy Board Act (the "Act") for authorization to export 1 000 megawatts of firm power; 2 000 megawatts per hour of combined firm and interruptible power; 8 760 gigawatt-hours per year of firm energy and 8 760 gigawatts per year of interruptible energy for a period of ten years commencing on the date that the Application is approved by the Board.

The Board wished to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The Directions on Procedure that follow explain in detail the procedure that will be used.

PUBLIC HEARING

Cedars Rapids Transmission Co.

The National Energy Board (the "Board") has issued Hearing Order EH-1-2002 and directions on procedure with respect to the Cedars Rapids Transmission Co. (CRT) July 20, 2001 application (revised December 7, 2001). This application is made pursuant to Part III.1 of the National Energy Board Act (the "Act"), for the reconstruction of a 120-kV international power line to a 230-kV international power line, and the dismantling of the existing power line. The proposed power line is approximately 71 kilometres in length and runs from the Les Cèdres generating station in Quebec, to a point on the international border near Cornwall, Ontario.
