CANCELLATION OF HEARING

Concrete Panels

On October 15, 2001, the Canadian International Trade Tribunal (the Tribunal) gave notice that, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), it would initiate an expiry review (Expiry Review No. RR-2001-004) of its finding made on June 27, 1997, in Inquiry No. NQ-96-004, concerning concrete panels, reinforced with fiberglass mesh, originating in or exported from the United States of America and produced by or on behalf of Custom Building Products, its successors and assigns, for use or consumption in the province of British Columbia or Alberta.

A public hearing was scheduled to take place in Vancouver, British Columbia, beginning on May 6, 2002.

In the course of its inquiry, the Tribunal concluded that the demand in the Alberta and British Columbia market is now, to a substantial degree, supplied by producers of like goods located elsewhere in Canada and, accordingly, this area no longer constitutes a regional market. Hence, the necessary precondition for a determination under subsection 76.03(10) of SIMA, that the expiry of the finding in Inquiry No. NQ-96-004 is likely to result in injury to the domestic industry, is no longer met.

As a result, the Tribunal has cancelled the hearing scheduled to begin on May 6, 2002, in Vancouver.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2002-002) from Tendering Publications Limited (the complainant), of Fredericton, New Brunswick, concerning a procurement by the Department of Public Works and Government Services (PWGSC). The procurement is in respect of the extension of the MERX online public sector tendering contract. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

It is alleged that PWGSC, by not using open tendering procedures for the subject procurement, failed to allow the complainant to compete for the requirement, contrary to the provisions of the applicable trade agreements.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2002-004) from COGNOS Incorporated, of Ottawa, Ontario, concerning a procurement (Solicitation No. T8086-010080/B) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Transport. The requirement is for the supply of business intelligence software. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

It is alleged that PWGSC improperly awarded the contract to a non-compliant bidder.

(the complainant), of Ottawa, Ontario, concerning a procurement (Solicitation No. W8486-021596/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The requirement is for the supply of lithium batteries for combat net radios. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

It is alleged that PWGSC improperly declared the complainant's bid non-compliant. It is further alleged that there is a reasonable apprehension of bias and that the successful bidder received preferential treatment.

SECOND AMENDMENT TO THE NOTICE OF COMMENCEMENT OF INVESTIGATION

Woven Fabrics of Cotton/Polyester and Polyester/Cotton

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice of a second amendment to the notice of commencement of investigation that was published in the June 30, 2001, edition of the Canada Gazette, Part I, following receipt of a request for tariff relief (Request No. TR-2000-006) from Doubletex (the requester). The amendment reflects a request by the requester to introduce a twist factor into the description of the fabrics.

The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of woven fabrics of cotton mixed solely with polyester staple fibres, unbleached or bleached, ring-spun, having a metric twist factor ([turns per metre] × [square root of tex] × 0.01) of 45 or more in the warp or the weft, of heading Nos. 52.08, 52.09, 52.10 or 52.11, for use by textile converters only to produce dyed and finished fabrics for the apparel and footwear industries; and woven fabrics of polyester staple fibres mixed solely with cotton, unbleached or bleached, ring-spun, having a metric twist factor ([turns per metre] x [square root of tex] × 0.01) of 45 or more in the warp or the weft, of heading Nos. 55.12, 55.13 or 55.14, for use by textile converters only to produce dyed and finished fabrics for the apparel and footwear industries (the subject fabrics).

The Tribunal is conducting an investigation under section 19 of the Canadian International Trade Tribunal Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabrics.

The Tribunal's investigation was commenced on June 19, 2001, and is being conducted by way of written submissions. To participate in the Tribunal's investigation, which will be based on the amended product description, an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before April 30, 2002. Interested parties that have already filed notices of appearance with the Tribunal in this investigation continue to be considered parties to the investigation and need not file additional notices of appearance.

Parties to the investigation may provide new or additional information to the Tribunal not later than April 30, 2002. On May 3, 2002, the Tribunal will distribute any new information on the record of the investigation. Parties, other than the requester, may file submissions with the Tribunal not later than May 10, 2002. The requester may then respond not later than May 17, 2002.

The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the Screening Officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party," for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a work place, and includes

(a) a supplier of the controlled product;
(b) an employee at the work place;
(c) an employer at the work place;
(d) a safety and health professional for the work place;
(e) a safety and health representative or a member of a safety and health committee for the work place; and
(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or
(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3.

Notice is hereby given, pursuant to rule 70 of the NAFTA Article 1904 Panel Rules, that the panel established to review the final determination made by the Commissioner of Canada Customs and Revenue Agency, respecting Certain Top-Mount Electric Refrigerators, Electric Household Dishwashers, and Gas or Electric Laundry Dryers, Originating in or Exported from the United States of America and Produced by, or on behalf of, White Consolidated Industries, Inc. and Whirlpool Corporation, their respective affiliates, successors and assigns, issued its decision on April 15, 2002 (Secretariat File No. CDA-USA-2000-1904-03).

In the April 15, 2002 decision, the binational panel affirmed the investigating authority's determination respecting Certain Top-Mount Electric Refrigerators, Electric Household Dishwashers, and Gas or Electric Laundry Dryers, Originating in or Exported from the United States of America and Produced by, or on behalf of, White Consolidated Industries, Inc. and Whirlpool Corporation, their respective affiliates, successors and assigns.

Explanatory Note

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in anti-dumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to expeditiously review final determinations to determine whether they are in accordance with the anti-dumping or countervailing duty law of the country that made the determination.

Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.

NATIONAL ENERGY BOARD

APPLICATION FOR AUTHORIZATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Exelon Generation Company, LLC

Notice is hereby given that, by an application dated April 26, 2002, Exelon Generation Company, LLC (the "Applicant") has applied to the National Energy Board (the "Board"), under Division II of Part VI of the National Energy Board Act (the "Act"), for authorization to export up to 500 megawatts annually of firm and interruptible power, up to 5 000 gigawatt-hours annually of firm energy and up to 1 000 gigawatt-hours annually of interruptible energy for a 15-year period.

The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The Directions on Procedure that follow explain in detail the procedure that will be used.

1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at 300 Exelon Way, Kennett Square, PA 19348, U.S.A., (610) 765-6649, and provide a copy of the application to any person who requests a copy. A copy of the application is also available for viewing during normal business hours in the Board's Library, 444 Seventh Avenue SW, Room 1002, Calgary, Alberta T2P 0X8.

2. Submissions that any party wishes to present shall be filed with the Secretary, National Energy Board, 444 Seventh Avenue SW, Room 1002, Calgary, Alberta T2P 0X8, (403) 292-5503 (Facsimile), and the Applicant by May 27, 2002.

3. Pursuant to subsection 119.06(2) of the Act, the Board shall have regard to all considerations that appear to it to be relevant. In particular, the Board is interested in the views of submittors with respect to:

(a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported;
(b) the impact of the exportation on the environment; and
(c) whether the Applicant has

(i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
(ii) given an opportunity to purchase electricity on terms and conditions as favorable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.

4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this Notice of Application and Directions on Procedure shall be filed with the Secretary of the Board and served on the party that filed the submissions, by June 11, 2002.

5. Any reply that submittors wish to present in response to item 4 of this Notice of Application and Directions on Procedure shall be filed with the Secretary of the Board and served on the Applicant by June 21, 2002.
