CANADIAN INTERNATIONAL TRADE TRIBUNAL

COMMENCEMENT OF INQUIRY

Xanthates

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on November 4, 2002, from the Director General of the Anti-dumping and Countervailing Directorate at the Canada Customs and Revenue Agency, stating that a preliminary determination had been made respecting the dumping of xanthates of all grades in dry or liquid forms, excluding cellulose xanthates, originating in or exported from the People's Republic of China.

Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry (Inquiry No. NQ-2002-003) to determine whether the dumping of the above-mentioned goods has caused injury or retardation, or is threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.

Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.

Public Hearing

A public hearing relating to this inquiry will be held in the Tribunal Hearing Room, 18th Floor, Standard Life Centre, 333 Laurier Avenue W, Ottawa, Ontario, commencing February 3, 2003, at 9:30 a.m.

Each person or government wishing to participate in the inquiry and at the hearing as a party must file a notice of participation with the Secretary on or before November 21, 2002. Each counsel who intends to represent a party in the inquiry and at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before November 21, 2002.

To allow the Tribunal to determine whether simultaneous interpretation will be required for the hearing, each interested party and each counsel filing a notice of participation or representation must advise the Secretary, at the same time that they file the notice, whether they and their witnesses will be using French or English or both languages at the hearing.

In the event of an injury finding, a request for a public interest inquiry conducted pursuant to subsection 45(1) of SIMA may be made by any party to the injury inquiry or by any other group or person affected by the injury finding. Such a request must be filed with the Tribunal within 45 days of the injury finding. A public interest inquiry is completely separate from an injury inquiry. However, the Tribunal invites all persons who anticipate that they will have public interest concerns in the event of a material injury finding to simply notify the Tribunal by November 21, 2002. The Tribunal is not seeking and does not expect submissions on public interest issues during the injury inquiry.

The Canadian International Trade Tribunal Rules govern these proceedings.

In order to observe and understand production processes, the Tribunal, accompanied by its staff, may conduct plant visits.

Along with the notice of commencement of inquiry, the Secretary has sent a letter to the domestic producers, importers and certain purchasers with a known interest in the inquiry providing details on the procedures, as well as the schedule for the inquiry. The letter specifies, among other things, the date for filing replies to Tribunal questionnaires, the date that information on record will be made available by the Tribunal to interested parties and counsel that have filed notices of participation or representation, and the dates for the filing of submissions by interested parties.

INQUIRY

Electrical and Electronics

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2002-035) from CVDS Inc., of Dollard-des-Ormeaux, Quebec, concerning a procurement (Solicitation No. 21120-016613/A) by the Department of Public Works and Government Services on behalf of the Correctional Service of Canada (CSC). The solicitation is for the acquisition of a digital voice logging recorder. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

It is alleged that the successful bidder's product does not meet a particular electronic specification, under CSC's Electronic Engineering Standards, included as an attachment to the Request for Proposal.

Call for Applications for a Broadcasting Licence to Carry On a Television Programming Undertaking to Serve All or Any One of Edmonton, Calgary, and Red Deer, Alberta

The Commission announces that it has received applications for broadcasting licences to carry on television programming undertakings to provide television services to serve Calgary and Edmonton, with a transmitter of the latter in Red Deer.

The Commission hereby calls for applications from other parties wishing to obtain broadcasting licences to provide television services to all or any one of Calgary, Edmonton, and Red Deer.

Persons interested in submitting such applications are required to file the applications to the Commission no later than February 5, 2003, and are also required to submit all necessary technical documentation to the Department of Industry by the same date.

It should be noted that, in making this call, the Commission has not reached any conclusion with respect to the licensing of such a service, nor should it necessarily be construed that the Commission will, by virtue of having called for applications, authorize such a service at this time.

Applicants will be required to provide evidence giving clear indication that there is a demand and a market for the station and for the proposed service. Without restricting the scope of the issues to be considered, the following should be addressed:

1. The contribution that the proposed service will make to achieving the objectives established in the Broadcasting Act and, in particular, to the production of local and regional programming.

2. The expected audience of the proposed service.

3. The proposed expenditures and the means by which the applicant will promote the development of Canadian talent, including local and regional talent.

4. An analysis of the markets involved and potential advertising revenues, taking into account the results of any survey undertaken supporting the estimates.

5. An indication of possible shared investment or co-operative program buying arrangements with Canadian or foreign broadcasters.

6. Evidence as to the availability of financial resources consistent with the requirements established in the financial projections of the applicant's business plan. For the convenience of applicants, the Commission has available upon request a document entitled "Commission Policy Regarding Documentary Evidence to Confirm the Availability of Financing."

The Commission also reminds applicants that they must comply with the eligibility requirements set out in the Direction to the CRTC (Ineligibility of Non-Canadians), SOR/97-192, dated April 8, 1997, as amended by SOR/98-1268, dated July 15, 1998, and the Direction to the CRTC (Ineligibility to Hold Broadcasting Licences), SOR/85-627, dated June 27, 1985, as amended by SOR/97-231, dated April 22, 1997.

The Commission will announce at a later date the public process where applications will be considered and where they may be examined by the public.

Notice of each application will also be published in newspapers of general circulation within the area to be served.

The public will be given the opportunity to comment on any application by submitting written intervention(s) to the Secretary General of the Commission (Canadian Radio-Television and Telecommunication Commission, Ottawa K1A 0N2) and by serving a true copy of the intervention(s) on the applicant(s) at least 25 days before the date of the hearing.

TransCanada PipeLines Limited 2003 Tolls and Tariff Application

The National Energy Board (the Board) has issued Hearing Order RH-1-2002 and Directions on Procedure with respect to an Application filed by TransCanada PipeLines Limited (the Applicant), pursuant to Part IV of the National Energy Board Act, for orders fixing and approving tolls that TransCanada shall charge for transportation services provided on its Mainline between January 1, 2003, and December 31, 2003. A copy of the application is available for viewing during normal business hours at the Applicant's offices, at the Board's library and on the Board's Internet site at www.neb-one.gc.ca.

The Board has decided to convene an oral public hearing to consider the application. The oral public hearing is scheduled to commence on Monday, February 24, 2003.
