Notice of Report

Whereas on February 2, 2002, the Minister of the Environment published in Part I of the Canada Gazette, pursuant to subsection 9(2) of the Canadian Environmental Protection Act, 1999, the proposed Canada-wide Standards for Dioxins and Furans for Iron Sintering Plants and Steel Manufacturing Electric Arc Furnaces,

Whereas the proposed agreements were developed by the Canadian Council of Ministers of the Environment under the framework of the Canada-wide Accord on Environmental Harmonization and the Canada-wide Environmental Standards Sub-Agreement,

Whereas the Minister of the Environment has received comments in respect thereto,

Now therefore, pursuant to subsection 9(4) of the Act, the Minister of the Environment hereby publishes the attached report that summarizes how any comments were dealt with.

Response to Comments Received on Proposed Agreements Respecting Canada-wide Standards for Dioxins and Furans: (I) Iron Sintering Plants; and (II) Steel Manufacturing Electric Arc Furnaces

Introduction

In accordance with subsection 9(2) of the Canadian Environmental Protection Act, 1999 (CEPA 1999), the Minister of the Environment published the proposed agreements respecting Canada-wide Standards (CWS) for Dioxins and Furans: (I) Iron Sintering Plants; and (II) Steel Manufacturing Electric Arc Furnaces (EAF). The proposed agreements were published in the Canada Gazette, Part I, on February 2, 2002, for a 60-day comment period. The proposed agreements were developed by the Canadian Council of Ministers of the Environment (CCME) under the framework of the Canada-wide Accord on Environmental Harmonization and the Canada-wide Environmental Standards Sub-Agreement. The CCME Ministers (except Quebec) intend to sign the agreements at their next meeting, expected in early 2003.

In accordance with subsection 9(4) of CEPA 1999, this report summarizes how the comments received were dealt with. No Notices of Objection were filed.

Response to Comments

Only one comment, from an industry stakeholder, was received pertaining to the Steel Manufacturing Electric Arc Furnaces CWS. No comments were received with respect to the Iron Sintering Plants CWS. The following table summarizes the comment received and Environment Canada's response.

Comments Response
The stakeholder does not oppose the signing of the proposed standard by Canadian Ministers of the Environment.
The stakeholder takes issue with a remark in the Preamble to the standard under the section entitled Development of the Canada-wide Standard that states that the standard has taken socio-economic impacts into account. The stakeholder points out that a full
socio-economic analysis was not done.
Environment Canada (EC) recognizes the importance of identifying the
socio-economic impacts of its decisions/ commitments. EC believes that the cost-benefit analyses that were conducted during the CWS development process have addressed this need, particularly bearing in mind that the CWS specifies that further socio-economic analyses will be undertaken as part of the 2003 review of the standard.

OTHER THAN STATUTORY AUTHORITY

Order Designating Controlled Access Zones (Halifax, Esquimalt and Nanoose Harbours)

Whereas it is reasonably necessary to designate as controlled access zones certain areas or parts of areas of water described in the schedule to the Controlled Access Zone Order (Halifax, Esquimalt and Nanoose Harbours), made by Order in Council P.C. 2002-2190 of December 12, 2002 (see footnote a) , to ensure the safety or security of anything referred to in paragraphs 3(1)(a) to (c) or a person referred to in paragraph 3(1)(d) of that Order;

And whereas the dimensions of the controlled access zones being designated in the annexed order are not greater than is reasonably necessary to ensure the safety or security of such a thing or person;

Therefore, the Minister of National Defence, on the recommendation of the Chief of the Defence Staff, pursuant to section 2 of the Controlled Access Zone Order (Halifax, Esquimalt and Nanoose Harbours) (see footnote b) , hereby makes the annexed Order Designating Controlled Access Zones (Halifax, Esquimalt and Nanoose Harbours).

1. The areas of water described in the schedule are hereby designated as controlled access zones for an indeterminate period.

2. In the schedule, "ship" means any of Her Majesty's Canadian Ships as defined in subsection 2(1) of the National Defence Act or any ship under the control of a visiting force that is legally in Canada by virtue of the Visiting Forces Act or otherwise.

Belledune Port Authority — Supplementary Letters Patent

BY THE MINISTER OF TRANSPORT

WHEREAS Letters Patent were issued by the Minister of Transport for the Belledune Port Authority (the "Authority") under the authority of the Canada Marine Act effective March 29, 2000;

WHEREAS the Authority has requested Supplementary Letters Patent be issued to replace section 2.2 of the Letters Patent to change the street address for the registered office of the Authority;

NOW THEREFORE under the authority of section 9 of the Canada Marine Act, the Letters Patent are amended by replacing section 2.2 of the Letters Patent with the following:
