Xanthates — Decision

On February 3, 2003, the Commissioner of Customs and Revenue made a final determination of dumping, pursuant to paragraph 41(1)(a) of the Special Import Measures Act respecting xanthates of all grades in dry or liquid forms, excluding cellulose xanthates, originating in or exported from the People's Republic of China.

The goods in question are usually classified under the following Harmonized System classification numbers:

2930.10.10.10    2930.10.10.20     2930.10.10.90     2930.10.90.00

The Canadian International Trade Tribunal (the Tribunal) is continuing its inquiry into the question of injury and will make its order or finding by March 4, 2003. Provisional duty will continue to apply until this date.

If the Tribunal finds that the dumping has caused injury or is threatening to cause injury, future imports of subject goods will be subject to an anti-dumping duty equal to the margin of dumping. In that event, the importer in Canada shall pay all such duty. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping duty.

COMMENCEMENT OF INTERIM REVIEW

Refrigerators, Dishwashers and Dryers

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that, pursuant to subsection 76.01(1) of the Special Import Measures Act, it has initiated an interim review of its findings (Interim Review No. RD-2002-005) made on August 1, 2000, in Inquiry No. NQ-2000-001, concerning certain top-mount electric refrigerators, electric household dishwashers and gas or electric laundry dryers originating in or exported from the United States of America and produced by, or on behalf of, White Consolidated Industries, Inc. and Whirlpool Corporation, their respective affiliates, successors and assigns.

On December 5, 2002, the Tribunal received a request from Whirlpool Corporation and Whirlpool Canada Inc. (Whirlpool) to rescind the application of the findings, effective January 1, 2003, with respect to "top-mount electric refrigerators, in sizes greater than 14.5 cubic feet and less than 18.5 cubic feet, originating in or exported from the United States of America and produced by, or on behalf of, White Consolidated Industries, Inc. and Whirlpool Corporation, their respective affiliates, successors and assigns". Whirlpool submitted that Camco Inc. (Camco), the sole domestic producer of the subject refrigerators at the time of the findings, has ceased production of such refrigerators.

The Tribunal decided that the request was properly documented and, accordingly, pursuant to subrule 70(2) of the Canadian International Trade Tribunal Rules (the Rules), on January 13, 2003, provided the parties to the 2000 inquiry with a copy of Whirlpool's request. On January 27, 2003, Electrolux Home Products North America and Electrolux Home Products (Electrolux) filed a submission supporting the request, but contended that the Tribunal should consider an earlier rescission date. Camco filed a reply dated January 28, 2003, confirming that it had stopped producing the refrigerators covered by the findings.

In light of the applicant's request, the domestic producer's submission and the replies of the applicant and Electrolux, the Tribunal decided that an interim review was warranted. The purpose of this interim review is to determine if the application of the findings with respect to the subject refrigerators should be rescinded. If, because of this review, the Tribunal decides to rescind the application of the findings with respect to the subject refrigerators, the effective date of rescission would be January 1, 2003. In the normal course of events, the findings would expire on August 5, 2005.

Submissions already filed by parties have been placed on the record of the interim review. Any further submissions by interested parties should be filed no later than March 5, 2003. Submissions should be based exclusively on public information. However, confidential information relevant to the issues before the Tribunal may be filed, if necessary, along with a comprehensive public summary or public edited version of the confidential information. Confidential submissions will be made available to counsel who have filed the relevant declarations and undertakings. In accordance with paragraph 25(c) of the Rules, the Tribunal has decided to proceed with its review by way of written submissions.

The Tribunal has notified the Commissioner of the Canada Customs and Revenue Agency, as well as other interested persons, of the commencement of an interim review. The Tribunal will make its decision on whether to amend its findings in Inquiry No. NQ-2000-001 no later than March 19, 2003.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2002-037) on February 10, 2003, with respect to a complaint filed by Huron Consulting (the complainant), of Barrie, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. W0113-02A064/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of computer software training services.

The complainant alleged that PWGSC applied an unfair evaluation process, gave preferential treatment to certain bidders and improperly applied the contractor selection formula.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2002-055) from Questcom Consulting Inc., of Ottawa, Ontario, concerning a procurement (Solicitation No. W7714-020009/A) by the Department of Public Works and Government Services on behalf of the Department of National Defence. The solicitation is for the provision of a simulation network computer system. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

It is alleged that the procurement required the products of particular suppliers, with no provision for equivalent products.

There were no submissions from affected parties to the Screening Officer with respect to any of the above claims for exemption and related MSDSs.

Each of the claims for exemption listed above was found to be valid. The Screening Officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the claims bearing Registry Numbers 4311 and 5266 complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

In the case of the claims bearing Registry Numbers 4315 and 4335, being claims from employers in the province of Alberta, the Screening Officer found that the respective MSDS relating to each claim did not comply with the applicable disclosure requirements of the Occupational Health and Safety Act of the Province of Alberta.

Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the remaining claims did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Registry Number 4284

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose the presence of isopropyl alcohol in the controlled product, its CAS Registry Number, and its percent concentration;

2. Correct the information pertaining to the subheading sensitization by disclosing that the material is a sensitizer;

3. In relation to the first aid information shown on the MSDS for ingestion, add a statement such as the following: If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration;

4. Disclose the Exposure Limit Values ACGIH TLV-TWA = 400 ppm and ACGIH TLV-STEL = 500 ppm for isopropyl alcohol;

5. Disclose the Exposure Limit Values ACGIH TLV-TWA = 5 ppm and ACGIH TLV-STEL = 15 ppm for monomethylamine;

6. Disclose that an ingredient in the controlled product has been shown to cause fetal injury in laboratory animals;

7. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2A.

Registry Number 4285

The claimant has been ordered to amend certain aspects of the format and content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. In relation to the first aid information shown on the MSDS for ingestion, add a statement such as the following: If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration;

2. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that contaminated clothing and footwear should be removed under running water;

3. Disclose the lower LD50 (oral, rat) value of 530 mg/kg and disclose an LD50 (oral, rabbit) value of 320 mg/kg for 2-butoxyethanol;

4. Disclose an LD50 (dermal, rabbit) value of 220 mg/kg and an LC50 (4 hour, rat) value of 468 ppm for 2-butoxyethanol;

5. Disclose the value of a lower bound for the dermal LD50 value for the confidential hazardous ingredient;

6. Disclose that exposure to an ingredient in the controlled product has been shown to cause CNS effects in laboratory animals;

7. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause lung tumours in laboratory animals;

8. Disclose that the substituted alkylamine is a skin sensitizer;

9. Disclose that ingredients in the controlled product has been shown to cause mutagenic effects in mammalian cells, in vitro;

10. If the WHMIS classifications are stated on the MSDS, replace the classification of D1B with that of class D1A.

Registry Number 4290

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose the presence of an additional confidential hazardous ingredient in the controlled product;

2. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be washed with water for 20 minutes or until the chemical is removed;

3. In relation to the first aid information shown on the MSDS for eye contact, disclose a statement to the effect that the skin should be washed with water for 20 minutes or until the chemical is removed;

4. Add oxides of nitrogen to the list of hazardous combustion products;

5. Disclose information on the irritancy of the controlled product in a consistent manner;

6. Disclose that an ingredient in the controlled product has been shown to cause teratogenic effects in laboratory animals;

7. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2A.

Registry Numbers 4309 and 4310

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. Add oxides of nitrogen to the list of hazardous combustion products;

2. Add oxides of nitrogen to the list of hazardous decomposition products;

3. Registry Number 4310:

(a) Amend the MSDS to show the LD50 for the hazardous ingredient potassium iodide;
(b) If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2A.

Registry Number 4314

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. In relation to the first aid information shown on the MSDS for ingestion, remove the statement to give two glasses of water to drink;

2. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be washed with water for 15 minutes or until the chemical is removed;

3. Disclose LD50 values for one of the confidential hazardous ingredients in an acceptable manner;

4. Disclose that an ingredient in the controlled product has been shown to cause eye irritation in laboratory animals;

5. Remove the statement that the material does not meet the D2B criteria for eye irritation;

6. Disclose that an ingredient in the controlled product has been shown to cause skin irritation in laboratory animals.

Registry Number 4315

The claimant has been ordered to amend certain aspects of the format and content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose ingestion as a route of entry;

2. In relation to the first aid information shown on the MSDS for ingestion, delete the statement "give victim plenty of water" and disclose a statement such as the following: Never give anything by mouth if the casualty is rapidly losing consciousness, or is unconscious or convulsing. If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration.

Registry Number 4318

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. In relation to the first aid information shown on the MSDS for ingestion, remove the statement to give two glasses of water to drink;

2. Disclose an LD50 (dermal, rabbit) value of 2 640 mg/kg for isobutyl alcohol;

5. Disclose the Exposure Limit Values ACGIH TLV-TWA = 100 ppm and ACGIH TLV-STEL = 150 ppm for xylene;

6. Disclose the Exposure Limit Value ACGIH TLV-TWA = 0.05 mg/m3 for crystalline silica;

7. Disclose the Exposure Limit Values OSHA-PEL = 30 mg/m3 divided by the value "%SiO2+2" (total dust) and 10 mg/m3 divided by the value "%SiO2+2" (respirable fraction) for crystalline silica;

6. In relation to the first aid information shown on the MSDS for ingestion, remove the statement to give two glasses of water and induce vomiting and add a statement such as the following: If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration;

7. Amend the ACGIH and OSHA Exposure Limit Values disclosed for talc to the effect that the value is applicable only if no asbestiform fibres are present and the material contains less than one percent crystalline silica;

8. Disclose that the controlled product is incompatible with sodium hypochlorite;

9. Disclose the lower LD50 (oral, female rat) value of 4 000 mg/kg for ethylene glycol;

10. Disclose that an ingredient in the controlled product has been shown to cause teratogenic effects in laboratory animals.

Registry Numbers 5180, 5181, 5192 and 5193

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose that acute ingestion of an ingredient in the controlled product has been shown to cause neurological impairment;

2. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause adverse effects on the liver, bone marrow and sperm of laboratory animals;

3. In relation to the first aid information shown on the MSDS for ingestion, remove the statement to give two glasses of water and induce vomiting and add a statement such as the following: If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration;

4. Amend the ACGIH and OSHA Exposure Limit Values disclosed for talc to the effect that the value is applicable only if no asbestiform fibres are present and the material contains less than one percent crystalline silica;

5. Disclose that the controlled product is incompatible with sodium hypochlorite;

6. Disclose the lower LD50 (oral, female rat) value of 4 000 mg/kg for ethylene glycol;

7. Registry Numbers 5180 and 5192: Disclose oxides of nitrogen and sulphur as hazardous combustion products;

8. Registry Numbers 5181 and 5193: Disclose that an ingredient in the controlled product has been shown to cause teratogenic effects in laboratory animals at maternally toxic dose levels.

Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the Screening Officer has, for each of the above-noted claims, with the exceptions of those claims bearing Registry Numbers 4311 and 5266, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the Screening Officer within 40 days of expiry of the appeal period.

In the case of the claims bearing Registry Numbers 4315 and 4335, the Screening Officer has ordered the claimant to comply with the provisions of the Occupational Health and Safety Act of the Province of Alberta, and to provide a copy of the amended MSDS to the Screening Officer, within the respective time period specified in the foregoing paragraph.

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the Screening Officer, should have been shown on the relevant MSDS.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal any decision or order of a Screening Officer. To initiate the appeal process, a Statement of Appeal (Form 1) as prescribed by the Hazardous Materials Information Review Act Appeal Board Procedures Regulations must be completed and delivered within 45 days of the publication of this notice in the Canada Gazette, Part I, to the Chief Appeals Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3, (613) 993-4429.
