COMMENCEMENT OF INVESTIGATION

Woven Viscose Rayon Fabrics

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) is satisfied that the request (Request No. TR-2002-010) received from Ballin Inc. (the requester) of Ville Saint-Laurent, Quebec, is properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of woven fabrics of viscose rayon staple fibres mixed mainly or solely with polyester filaments, polyester staple fibres and elastomeric monofilaments, dyed or of yarns of different colours, of subheading No. 5516.22 or 5516.23, for use in the manufacture of trousers, shorts and jackets (the subject fabrics).

The Tribunal will conduct an investigation under section 19 of the Canadian International Trade Tribunal Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabrics, which are classified in subheading No. 5516.22 or 5516.23.

The Tribunal's investigation commenced on May 15, 2003, and will be conducted by way of written submissions. To participate in the Tribunal's investigation, the requester or an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before June 5, 2003. The Tribunal's recommendations to the Minister of Finance are scheduled to be issued by September 12, 2003.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

DETERMINATION

Communications, Detection and Fibre Optics

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2002-059) on May 13, 2003, with respect to a complaint filed by Panavidéo inc. (the complainant), of Québec, Quebec, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. W0130-02450L/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the supply of closed-circuit television equipment for installation at different military bases in Quebec.

The complainant alleged that PWGSC had not respected the contract award procedures by awarding the contract to a supplier whose products did not comply with the technical specifications included in the Request for Proposal.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was not valid.

INQUIRY

Communications, Photographic, Mapping, Printing and Publication Services

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2003-016) from Dollco Printing (Dollco Corporation) (Dollco), of Ottawa, Ontario, concerning a procurement (Solicitation No. 10022105/02) by the Department of Canadian Heritage (CH). The solicitation is for the establishment of a supply arrangement to procure printing services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

Dollco alleges that it has been denied the opportunity to bid on the procurement as CH has improperly disqualified its proposal. Dollco alleges that CH also incorrectly applied a conflict of interest requirement to disqualify it.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2003-012) from WorkDynamics Technologies Incorporated (WorkDynamics), of Ottawa, Ontario, concerning a procurement (Solicitation No. ET.24062-5-6004/000/D) by the Department of Public Works and Government Services (PWGSC) on behalf of the Treasury Board of Canada Secretariat.
