Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2003-005) on July 14, 2003, with respect to a complaint filed by Ready John Inc. (the complainant), of Saint John, New Brunswick, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. W0105-03E005/A) by the Department of Public Works and Government Services on behalf of the Department of National Defence. The solicitation was for the provision of chemical toilets.

The complainant alleged that, contrary to the applicable trade agreements, the evaluation process was unfair and certain tendering requirements were not enforced.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement and the Agreement on Government Procurement, the Tribunal determined that the complaint was not valid.

(the complainant), of Ottawa, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. 5P420-02-5056) by the Parks Canada Agency. The complainant alleged that the evaluation process was unfair and conducted improperly, that a certain bidder received preferential treatment and that responses to inquiries were not properly disseminated.

FINDING

Carbon Steel Pipe Nipples, Threaded Couplings and Adaptor Fittings

In the matter of an inquiry, under section 42 of the Special Import Measures Act, respecting certain carbon steel pipe nipples, threaded couplings and adaptor fittings, in nominal diameters up to and including 6 inches or the metric equivalents, originating in or exported from the People's Republic of China

The Canadian International Trade Tribunal, under the provisions of section 42 of the Special Import Measures Act, has conducted an inquiry (Inquiry No. NQ-2002-004) to determine whether the dumping in Canada of certain carbon steel pipe nipples, threaded couplings and adaptor fittings, in nominal diameters up to and including 6 inches or the metric equivalents, originating in or exported from the People's Republic of China, has caused injury or retardation, or is threatening to cause injury to the domestic industry.

This inquiry is pursuant to the issuance by the Commissioner of the Canada Customs and Revenue Agency of a preliminary determination dated March 18, 2003, and of a final determination dated June 16, 2003, that the aforementioned goods have been dumped and that the margins of dumping of these goods were not insignificant.

Pursuant to subsection 43(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby finds that the dumping in Canada of the aforementioned goods has caused injury to the domestic industry.

The statement of reasons will be issued within 15 days.

Call for Comments on Proposals for the Addition of Non-Canadian Satellite Services to the List of Services Eligible for Digital Distribution

Extension of the deadline for submission of replies

1. In Call for Comments on Proposals for the Addition of Non-Canadian Satellite Services to the List of Services Eligible for Digital Distribution, Broadcasting Public Notice CRTC 2003-36, July 11, 2003 (Public Notice 2003-36), the Commission called for comments on proposals to amend the list of eligible satellite services through the inclusion of additional non-Canadian programming services that would be authorized for distribution on a digital basis only, and established a two-stage process for the filing of written comments.

2. The Commission extends the deadline for the filing of replies to September 15, 2003. The deadline for the filing of initial comments remains August 11, 2003.

3. The final bullet in paragraph 2 of the English version of Public Notice 2003-36 should read:

— an undertaking from the non-Canadian service provider that it does not hold, will not obtain, nor will it exercise, preferential or exclusive programming rights in relation to the distribution of programming in Canada.

The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party", for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a work place, and includes

(a) a supplier of the controlled product;

(b) an employee at the work place;

(c) an employer at the work place;

(d) a safety and health professional for the work place;

(e) a safety and health representative or a member of a safety and health committee for the work place; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or
(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3.

DECISION

Softwood Lumber Products

Notice is hereby given, pursuant to rule 70 of the NAFTA Article 1904 Panel Rules, that the panel established to review the Final Determination of Sales at Less Than Fair Value made by the United States Department of Commerce, International Trade Administration, respecting certain softwood lumber products from Canada, issued its decision on July 17, 2003 (Secretariat File No. USA-CDA-2002-1904-02).

In the July 17, 2003 decision, the binational panel remanded the agency's determination respecting softwood lumber products from Canada.

The binational panel instructed the investigating authority to provide its determination on remand by September 15, 2003.

Explanatory Note

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in anti-dumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the anti-dumping or countervailing duty law of the country that made the determination.

Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.
