SPECIAL IMPORT MEASURES ACT

Steel Structural Tubing — Decision

On August 19, 2003, the Commissioner of Customs and Revenue made a preliminary determination of dumping, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), respecting structural tubing known as hollow structural sections (HSS) made of carbon and alloy steel, welded, in sizes up to and including 16.0 inches (406.4 mm) in outside diameter (OD) for round products and up to and including 48.0 inches (1219.2 mm) in periphery for rectangular and square products, commonly but not exclusively made to ASTM A500, ASTM A513, CSA G.40.21-87-50W and comparable specifications, originating in or exported from the Republic of Korea, the Republic of South Africa, and the Republic of Turkey.

The goods in question are usually classified under the following Harmonized System classification numbers:

The Canadian International Trade Tribunal (Tribunal) will make a full inquiry into the question of injury to the domestic industry and will make an order or finding not later than 120 days after its receipt of the notice of the preliminary determination of dumping.

Pursuant to section 8 of SIMA, provisional duty is payable on subject goods released from customs during the period commencing on the date the preliminary determination was made and ending on the earlier of the day the investigation is terminated, the day on which the Tribunal makes an order or finding, or the day an undertaking is accepted. The amount of provisional duty payable is not greater than the estimated margin of dumping. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of provisional duty. As such, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

The Canadian International Trade Tribunal, under the provisions of subsection 76.03(3) of the Special Import Measures Act, has conducted an expiry review of its finding made on September 4, 1998, in Inquiry No. NQ-98-001, as amended on March 5, 2003, in Interim Review No. RD-2002-004, concerning certain stainless steel round bar originating in or exported from the Federal Republic of Germany, France, India, Italy, Japan, Spain, Sweden, Chinese Taipei (formerly designated as Taiwan) and the United Kingdom, and of its finding made on June 18, 1999, in Inquiry No. NQ-98-003, concerning certain stainless steel round bar originating in or exported from the Republic of Korea.

Pursuant to paragraph 76.03(12)(b) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby continues the above-mentioned findings, with an amendment to exclude the goods described in the appendix to the Tribunal's order.

On July 2, 2003, the Canadian International Trade Tribunal issued a notice of expiry (Expiry No. LE-2003-002) requesting views on whether the June 22, 1999 order should be reviewed. The Tribunal has decided, pursuant to subsection 76.03(5) of the Special Import Measures Act, that a review is not warranted.

The statement of reasons will be issued within 15 days.

The Notice of Filing published in the Canada Gazette, Part I, on August 7, 1999, listed the subject of the claim bearing Registry Number 4327 to be the chemical identity and concentration of two ingredients. It has since been established that the subject of the claim is the chemical identity and concentration of three ingredients.

3. The Notice of Filing published in the Canada Gazette, Part I, on February 12, 2000, listed the subject of the claim bearing Registry Number 4479 to be the chemical identity of one ingredient. It has since been established that the subject of the claim is the chemical identity of two ingredients.

4. The Notice of Filing published in the Canada Gazette, Part I, on July 22, 2000, listed the subject of the claim bearing Registry Number 4687 to be the chemical identity of one ingredient. It has since been established that the subject of the claim is the chemical identity of two ingredients.

5. The Notice of Filing published in the Canada Gazette, Part I, on July 22, 2000, listed the subject of the claim bearing Registry Number 4690 to be the chemical identity of one ingredient. It has since been established that the subject of the claim is the chemical identity of three ingredients.

6. The Notice of Filing published in the Canada Gazette, Part I, on December 9, 2000, listed the subject of the claim bearing Registry Number 4781 to be the chemical identity of one ingredient. It has since been established that the subject of the claim is the chemical identity of two ingredients.

7. The Notice of Filing published in the Canada Gazette, Part I, on December 9, 2000, listed the subject of the claim bearing Registry Number 4806 to be the chemical identity of three ingredients. It has since been established that the subject of the claim is the chemical identity of four ingredients.

8. The Notice of Filing published in the Canada Gazette, Part I, on February 3, 2001, listed the subject of the claim bearing Registry Number 4888 to be the chemical identity and concentration of three ingredients. It has since been established that the subject of the claim is the chemical identity and concentration of two ingredients.

There were no submissions from affected parties to the Screening Officer with respect to any of the above claims for exemption and related MSDSs.

Each of the claims for exemption listed above was found to be valid. The Screening Officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the MSDS relating to the claim bearing Registry Numbers 4847 complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

In the case of the claim bearing Registry Number 4813, being a claim from an employer in the province of Ontario, the Screening Officer found that the MSDS relating to this claim did not comply with the applicable disclosure requirements of the Occupational Health and Safety Act of the Province of Ontario.

Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the remaining claims did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Registry Number 4327

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose the presence of an additional confidential hazardous ingredient in the controlled product;

2. In relation to the first aid information shown on the MSDS for inhalation, disclose a statement to the effect that trained personnel should immediately administer artificial respiration or cardiopulmonary resuscitation if breathing has stopped or if the heart has stopped;

3. In relation to the first aid information shown on the MSDS for ingestion, remove the statements to dilute with plenty of fluids and to induce vomiting and add advice to the effect that the casualty should lean forward should vomiting occur in order to reduce the risk of aspiration;

4. Disclose either the ACGIH Exposure Limit Values for the individual ingredients in the controlled product or the calculated value for the product as a whole;

5. Add strong acids, alkali metals and catalytic reductors to the list of incompatible materials;

6. Disclose that acute ingestion of an ingredient of the controlled product has been shown to cause necrosis and haemorrhaging in the brain and that dermal absorption can lead to visual and gastrointestinal effects;

7. Disclose that chronic ingestion of an ingredient in the controlled product has been shown to cause adverse effects on the heart, peripheral nerves, skeletal muscles and brain as well as testicular and sperm effects in laboratory animals;

8. Disclose that chronic ingestion of an ingredient in the controlled product has been shown to cause CNS effects in laboratory animals;

9. Disclose that chronic inhalation of an ingredient in the controlled product has caused visual and gastrointestinal disturbances;

10. Disclose an LD50 (dermal, rabbit) value of 16 433 mg/kg and an LC50 (4 hours, rat) value of 522 p.p.m. for the controlled product;

11. Disclose that an ingredient in the controlled product is considered to be a germ cell mutagen based on positive results in in vivo screening tests and that an ingredient in the controlled product is considered to be a somatic cell mutagen based on positive results in an in vivo screening test;

12. Disclose that ingredients in the controlled product cause fetotoxic and teratogenic effects in laboratory animals;

13. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in classes D1B, D2A and D2B.

Registry Number 4360

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. In relation to the first aid information shown on the MSDS for inhalation, disclose a statement to the effect that trained personnel should immediately administer cardiopulmonary resuscitation if the heart has stopped;

2. In relation to the first aid information shown on the MSDS for ingestion, disclose a statement to the effect that trained personnel should immediately administer artificial respiration or cardiopulmonary resuscitation if breathing has stopped or if the heart has stopped. Also, add advice to the effect that the casualty should lean forward should vomiting occur in order to reduce the risk of aspiration;

3. Disclose that acute ingestion of an ingredient in the controlled product has been shown to cause adverse CNS effects in laboratory animals.

Registry Number 4364

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose the available CAS Registry Number for the disclosed hazardous ingredient N-methylol acrylamide together with its percent concentration;

2. Disclose that an ingredient in the controlled product has caused positive results in an in vivo screening test for germ cell mutagenicity;

3. In relation to the first aid information shown on the MSDS for inhalation, disclose a statement to the effect that trained personnel should immediately administer cardiopulmonary resuscitation if the heart has stopped;

4. In relation to the first aid information shown on the MSDS for ingestion, remove the statement to induce vomiting and add advice to the effect that the casualty should lean forward should vomiting occur in order to reduce the risk of aspiration;

5. Disclose that metal containers should be grounded when transferring large quantities of the controlled product;

6. Disclose an LC50 value for the confidential hazardous ingredient in an acceptable manner;

7. Disclose an LD50 (oral, rat) value of 5 800 mg/kg for acetone;

8. Disclose an LD50 (dermal, rabbit) value of 10.5 g/kg for ethylene glycol;

9. Disclose acetone and acetonitrile as synergistic materials;

10. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in classes D1A and D2A.

Registry Numbers 4381 and 4382

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D1B;

2. In relation to the first aid information shown on the MSDS for eye contact, disclose a statement to the effect that the eyes should be flushed continuously with lukewarm, gently flowing water for at least 20-60 minutes;

3. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that contaminated clothing, footwear and leather goods should be removed under running water;

4. Add oxides of nitrogen and sulphur to the list of hazardous combustion products;

5. Disclose that ingredients in the controlled product have been shown to cause eye corrosion in laboratory animals.

Acknowledgement: Subsequent to the review of the MSDSs-of-Record respecting these particular claims, the claimant provided the Commission with copies of revised versions. These revised versions of the MSDSs were not, however, reviewed by the Screening Officer.

Registry Number 4402

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Remove the concentration range shown for the confidential hazardous ingredient orange oil and disclose its actual concentration or an acceptable range value;

2. Disclose the Exposure Limit Value ACGIH TLV-TWA = 1 000 p.p.m. for ethanol;

3. Disclose the Exposure Limit Value AIHA WEEL (TWA, 8 hours) = 10 mg/m3 (aerosol) for the alkyl alcohol;

4. Disclose an LD50 value for two of the confidential hazardous ingredients in an acceptable manner;

5. Disclose that an ingredient in the controlled product is considered to be a germ cell mutagen based on positive results in in vivo screening tests and that it has been shown to cause mutagenic effects in human cells, in vitro;

6. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2A.

Registry Numbers 4415 and 4416

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose that acute ingestion of an ingredient in the controlled product has been shown to cause adverse CNS effects;

2. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be flushed with water for at least 15 minutes or until the chemical is removed;

3. In relation to the first aid information shown on the MSDS for inhalation, disclose a statement to the effect that trained personnel should immediately administer cardiopulmonary resuscitation if the heart has stopped;

4. In relation to the first aid information shown on the MSDS for ingestion, disclose statements to the effect that trained personnel should immediately administer artificial respiration or cardiopulmonary resuscitation if breathing has stopped or if the heart has stopped, and that if vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration;

5. Registry Number 4416:

(a) Disclose the Exposure Limit Value ACGIH TLV-TWA = 200 mg/m3 for kerosene;

(b) Disclose that an ingredient in the controlled product has been shown to cause skin irritation in laboratory animals;

(c) Disclose an LD50 (dermal, rabbit) value of >2 000 mg/kg and an LC50 (4 hours, rat) value of >5 000 mg/m3 for kerosene;

(d) Disclose that one ingredient in the controlled product has been classified as a confirmed animal carcinogen with unknown relevance to humans (A3) by the American Conference of Governmental Industrial Hygienists (ACGIH);

(e) Disclose that an ingredient in the controlled product has shown positive results in a screening test for mutagenicity.

Registry Number 4420

The claimant has been ordered to amend certain aspects of the content and wording of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose that both acute ingestion and acute dermal exposure to an ingredient in the controlled product have been shown to cause adverse CNS effects in laboratory animals;

2. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be flushed with water for at least 15 minutes or until the chemical is removed and that contaminated clothing should be removed under running water;

3. In relation to the first aid information shown on the MSDS for ingestion, add a statement such as the following: If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration;

4. Disclose the Exposure Limit Value ACGIH TLV-STEL = 10 mg/m3 for oil mist;

5. Disclose an LD50 (oral, rat) value of 3 200 mg/kg, an LD50 (dermal, rabbit) value of >1.8 g/kg and an LC50 (rat, 4 hours, saturated vapour) value of >590 mg/m3 for heavy aromatic naphtha.

Registry Number 4432

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Remove the concentration range shown for the hazardous ingredient carbon and disclose its actual concentration or an acceptable range value;

2. In relation to the first aid information shown on the MSDS for ingestion, remove the statements "Give 2-3 glasses of milk or water to dilute" and "If vomiting occurs, give more fluids."

Registry Numbers 4437 and 4438

The claimant has been ordered to amend certain aspects of the content and wording of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose an LD50 (oral, rat) value of 3 523 mg/kg for xylene;

2. In relation to the period of time shown on the MSDS for flushing the eyes with water should eye contact occur, delete the current reference to "fifteen minutes" and replace it with a time of "twenty minutes or until the chemical is removed";

3. In relation to the first aid information shown on the MSDS for skin contact, delete the statements to cover the skin with an emollient or an anti-bacterial cream. Disclose a statement to the effect that the skin should be washed with water for 20 minutes or until the chemical is removed;

4. In relation to the first aid information shown on the MSDS for ingestion, delete the statement "Have conscious person drink several glasses of water";

(b) Disclose that an ingredient in the controlled product has been classified as possibly carcinogenic to humans (Group 2B) by the International Agency for Research on Cancer (IARC);

11. Registry Numbers 5194 and 5242:

(a) Amend the ACGIH Exposure Limit Value disclosed for kaolin to the effect that the value is applicable only if no asbestiform fibres are present and the material contains less than 1 percent crystalline silica;

(b) Disclose that an ingredient in the controlled product has been shown to cause teratogenic effects in laboratory animals at maternally toxic dose levels;

(c) Disclose that an ingredient in the controlled product has been shown to cause mutagenic effects in human cells, in vitro.

Registry Numbers 5405, 5407 and 5408

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose that acute ingestion of an ingredient in the controlled product has been shown to cause neurological impairment;

2. Disclose that chronic ingestion of an ingredient in the controlled product has been shown to cause adverse effects on the bone marrow of laboratory animals;

3. Disclose that the controlled product is incompatible with sodium hypochlorite;

4. Disclose the lower LD50 (oral, female rat) value of 4 000 mg/kg for ethylene glycol;

5. Disclose that an ingredient in the controlled product has been shown to cause mutagenic effects in human cells, in vitro;

6. Registry Number 5405: Disclose oxides of sulphur and nitrogen as hazardous combustion products;

7. Registry Numbers 5407 and 5408: Amend the ACGIH Exposure Limit Value disclosed for kaolin to the effect that the value is applicable only if no asbestiform fibres are present and the material contains less than 1 percent crystalline silica.

Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the Screening Officer has, for each of the above-noted claims, with the exception of the claims bearing Registry Numbers 4813 and 4847, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the Screening Officer within 40 days of expiry of the appeal period.

In the case of the claim bearing Registry Number 4813, the Screening Officer has ordered the claimant to comply with the provisions of the Occupational Health and Safety Act of the Province of Ontario, and to provide a copy of the amended MSDS to the Screening Officer, within the respective time period specified in the foregoing paragraph.

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the Screening Officer, should have been shown on the relevant MSDS.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal any decision or order of a Screening Officer. To initiate the appeal process, a Statement of Appeal (Form 1) as prescribed by the Hazardous Materials Information Review Act Appeal Board Procedures Regulations must be completed and delivered within 45 days of the publication of this notice in the Canada Gazette, Part I, to the Chief Appeals Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3, (613) 993-4429.

Softwood Lumber Products

Notice is hereby given, pursuant to rule 70 of the NAFTA Article 1904 Panel Rules, that the panel established to review the Final Determination of Injury made by the United States International Trade Commission, respecting softwood lumber products from Canada, issued its decision on September 5, 2003 (Secretariat File No. USA-CDA-2002-1904-07).

In the September 5, 2003 decision, the binational panel affirmed in part and remanded in part the agency's determination respecting softwood lumber products from Canada.

The binational panel instructed the investigating authority to provide its determination on remand by December 15, 2003.

Explanatory Note

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.

Under Article 1904 of the North American Free Trade Agreement which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.
