CANADIAN ENVIRONMENTAL ASSESSMENT ACT
Model Class Screening Report for Operation and Maintenance of Electrical Power Distribution Facilities in Banff National Park — Public Notice
The Canadian Environmental Assessment Agency (the Agency) declares the Model Class Screening Report for Operation and Maintenance of Electrical Power Distribution Facilities in Banff National Park to be a Class Screening Report pursuant to the provisions of subsection 19(1) of the Canadian Environmental Assessment Act (the Act).
In making the declaration proposed by Parks Canada, the Agency reviewed the Model Class Screening Report (MCSR) and determined that the project-screening process described in the document would facilitate meeting the requirements of the Act on specific future projects.
The declaration is effective September 30, 2003, and is subject to the following terms and conditions:
— Subject to subsection 19(6) of the Act (subsection (8) following the coming into force of Bill C-9), the declaration period is valid until September 29, 2008.
— Parks Canada will notify the Agency, in writing, a minimum of six months prior to the date on which the declaration expires, of its intention to renew the MCSR as is; or to renew the MCSR with modifications or additions; or to not renew the MCSR and thereby allow the declaration to expire.
— To renew the MCSR, Parks Canada must submit the proposed class screening report to the Agency for renewal of the declaration not less than two months prior to the expiration date of this declaration.
— Parks Canada and the Agency will ensure that the MCSR and subsequent Class Screening Project Reports are made available to the public in accordance with the Public Registry requirements of the Act, as it may be amended from time to time. As such, Parks Canada will place the MCSR and subsequent Class Screening Project Reports in the Public Registry in its regional office. Parks Canada will maintain a running tally, by project category, of all projects completed under the class, and submit the tally semi-annually to the Agency for incorporation in the Federal Environmental Assessment Index (i.e. September 30 and March 31). Following the coming into force of Bill C-9, Parks Canada will comply with the requirements of the Canadian Environmental Assessment Registry (i.e. quarterly reporting of projects completed under the class).
— Any amendments to the MCSR will be developed and implemented in accordance with the provisions for amendment contained in section 6 of the MCSR.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2003-047) from Southern California Safety Institute, Inc. (SCSI), of Torrance (California), concerning a procurement (Solicitation No. T8080-02-0503) by the Department of Transport (TC). The solicitation is for the provision of course design, development and delivery. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.
It is alleged that TC violated the provisions of the North American Free Trade Agreement by conducting an improper evaluation of the proposals of both SCSI and the contract awardee.

DECISION
Iodinated Contrast Media (Dumping)
Notice is hereby given, pursuant to rule 70 of the NAFTA Article 1904 Panel Rules, that the panel established to review the final determination made by the Commissioner of Canada Customs and Revenue Agency, respecting certain iodinated contrast media used for radiographic imaging, originating in or exported from the United States of America (including the Commonwealth of Puerto Rico), issued its decision on the second remand on September 23, 2003 (Secretariat File No. CDA-USA-2000-1904-01).
In the September 23, 2003 decision, the binational panel affirmed the agency's second determination on remand respecting certain iodinated contrast media used for radiographic imaging, originating in or exported from the United States of America (including the Commonwealth of Puerto Rico).

Explanatory Note
Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.
These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.
Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.
