COMMENCEMENT OF INVESTIGATION

Woven Fabrics of Cotton and Elastomeric Monofilament

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) is satisfied that the request (Request No. TR-2003-001) received from Tribal Sportswear Inc. (the requester), of Montréal, Quebec, is properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of woven fabrics, solely of cotton and elastomeric monofilament, containing 90 percent or more by weight of cotton, of subheading No. 5208.39, 5209.32, 5209.39, 5209.52 or 5209.59, for use in the manufacture of women's jackets, blazers, dresses, skirts, trousers, capri pants and shorts (the subject fabrics). The requester has asked the Tribunal to conduct its investigation expeditiously. The Tribunal has examined the request and is not persuaded that the circumstances constitute critical circumstances. However, barring any opposition to the request, the Tribunal intends to conduct its investigation as expeditiously as possible.

The Tribunal will conduct an investigation under section 19 of the Canadian International Trade Tribunal Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabrics, which are classified in subheading No. 5208.39, 5209.32, 5209.39, 5209.52 or 5209.59.

The Tribunal's investigation commenced on October 21, 2003, and will be conducted by way of written submissions. To participate in the Tribunal's investigation, the requester or an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before November 12, 2003. The Tribunal's recommendations to the Minister of Finance are scheduled to be issued by February 18, 2004.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2003-035) on October 23, 2003, with respect to a complaint filed by Virtual Wave Inc. (the complainant), of Ottawa, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. A1632-11/20-03-6002) by the Department of Indian Affairs and Northern Development (INAC). The solicitation was for the provision of litigation research analysis, research services and related document management support services.

The complainant alleged that INAC had used unknown new criteria or measures to disqualify the complainant's offered resources.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement and the Agreement on Government Procurement, the Tribunal determined that the complaint was not valid.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

EXPIRY OF FINDINGS

Cold-rolled Steel Sheet Products

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its findings made on August 27, 1999, in Inquiry No. NQ-99-001, concerning cold-reduced flat-rolled sheet products of carbon steel (including high-strength low-alloy steel), in coils or cut lengths (not painted, clad, plated or coated), in widths up to and including 80 in. (2 032 mm) and in thicknesses from 0.014 in. to 0.142 in. (0.35 mm to 3.61 mm) inclusive, originating in or exported from Belgium, the Russian Federation, the Slovak Republic and Turkey, are scheduled to expire (Expiry No. LE-2003-006) on August 26, 2004. Under SIMA, findings of injury or threat of injury and the associated special protection in the form of antidumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date. An expiry review will not be initiated unless the Tribunal decides that there is sufficient information to indicate that it is warranted.

Persons or governments requesting or opposing the initiation of an expiry review of the said findings should file 20 copies of written public submissions containing relevant information, opinions and arguments, with the Secretary of the Tribunal not later than November 14, 2003. Persons or governments should endeavour to base their submissions exclusively on public information; however, confidential information relevant to the issues before the Tribunal may be filed, if necessary, along with a comprehensive public summary or edited version thereof.

Submissions should address all relevant factors, including:

— the likelihood of continued or resumed dumping of the goods;

— the likely volume and price ranges of dumped imports if dumping were to continue or resume;

— the domestic industry's recent performance, including trends in production, sales, market share and profits;

— the likelihood of injury to the domestic industry if the findings were allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped imports on the industry's future performance;

— any other developments affecting, or likely to affect, the performance of the domestic industry;

— changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and

— any other matter that is relevant.

Where there are opposing views, each person or government that filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other persons or governments. In these circumstances, the Tribunal will distribute copies of the public submissions to each person or government that filed a submission with the Tribunal. Persons or governments wishing to respond to the submissions must do so not later than November 24, 2003. If confidential submissions have been filed, the Secretary will notify persons or governments and instruct them on how they may access these submissions through qualified counsel.

The Tribunal will issue a decision on December 9, 2003, on whether an expiry review is warranted based on the submissions and representations received and the responses to them.

— If there is no request for a review, the Tribunal will not initiate a review and the findings will expire on their expiry date.

— If the Tribunal decides that a review is not warranted, the findings will expire on their expiry date. The Tribunal will issue its reasons not later than 15 days after its decision.

— If the Tribunal decides to initiate a review, it will issue a notice of expiry review.

The Tribunal's Draft Guideline on Expiry Reviews can be found on its Web site at www.citt-tcce.gc.ca. In addition to providing more detailed information on the proceeding whereby the Tribunal determines if an expiry review is warranted, the draft guideline explains how an expiry review is conducted if the Tribunal determines that one is warranted. In an expiry review, the Commissioner of the Canada Customs and Revenue Agency (the Commissioner) first determines whether the expiry of the order or finding is likely to result in the continuation or resumption of dumping or subsidizing of the goods. If the Commissioner determines that the expiry of the order or finding in respect of any goods is likely to result in the continuation or resumption of dumping or subsidizing, the Tribunal will then conduct an inquiry to determine if the continued or resumed dumping or subsidizing is likely to result in injury or retardation. The Tribunal's notice of expiry review will provide more information on the expiry review process.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2003-055) from K-W Leather Products Ltd., of Waterloo, Ontario, concerning a procurement (Solicitation No. W8476-019901/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for the supply of tactical vests. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

It is alleged that PWGSC introduced and applied a new evaluation criterion, incorrectly conducted a financial capability assessment, and applied a biased technical specification.

The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party", for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies, or is otherwise involved in the use or supply of the controlled product at a work place, and includes

(a) a supplier of the controlled product;

(b) an employee at the work place;

(c) an employer at the work place;

(d) a safety and health professional for the work place;

(e) a safety and health representative or a member of a safety and health committee for the work place; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or
(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based, and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3.

NATIONAL ENERGY BOARD

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Teck Cominco Metals Ltd.

Notice is hereby given that, by an application dated October 24, 2003, Teck Cominco Metals Ltd. (the "Applicant") has applied to the National Energy Board (the "Board") under Division II of Part VI of the National Energy Board Act (the "Act") for renewal of its authorization to export surplus electrical energy from the Province of British Columbia. The electrical energy to be removed each year from January 1, 2004, to December 31, 2013, is described as follows:

(a) Interruptible and firm transfers — export transfers for sale of interruptible and firm energy, up to a maximum of 3 500 gigawatt-hours in any consecutive 12-month period.

(b) Carrier transfers — the firm carrier transfer of energy to the United States, up to a maximum of 250 gigawatt-hours in any consecutive 12-month period.

The export would be made over any lines currently, or in future, authorized by the Board.

The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The Directions on Procedure that follow explain in detail the procedure that will be used.

1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at Teck Cominco Metals Ltd.'s Administration Office, in Trail, British Columbia, and provide a copy of the application to any person who requests a copy. A copy of the application is also available for viewing during normal business hours in the Board's library, 444 Seventh Avenue SW, Room 1002, Calgary, Alberta T2P 0X8.

2. Submissions that any party wishes to present shall be filed with the Secretary of the Board, 444 Seventh Avenue SW, Calgary, Alberta T2P 0X8, (403) 292-5503 (Facsimile), and served on the Applicant by November 30, 2003.

3. Pursuant to subsection 119.06(2) of the Act, the Board shall have regard to all considerations that appear to it to be relevant. In particular, the Board is interested in the views of submittors with respect to:

(a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported;

(b) the impact of the exportation on the environment; and

(c) whether the Applicant has

(i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
(ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.

4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this Notice of Application and Directions on Procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by December 15, 2003.
