"Notice is hereby given, pursuant to paragraph 168(1)(c) of the Income Tax Act, that I propose to revoke the registration of the charities listed below and that by virtue of paragraph 168(2)(b) thereof, the revocation of the registration is effective on the date of publication of this notice in the Canada Gazette."

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2003-051) on February 11, 2004, with respect to a complaint filed by Marcomm Inc. (the complainant), of Ottawa, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. W4181-020001/01/A) by the Department of Public Works and Government Services on behalf of the Department of National Defence (DND). The solicitation was for the supply and installation of inside-plant cable distribution systems for voice and data at buildings occupied by DND, within the National Capital Region.

The complainant alleged that, contrary to the applicable trade agreements, PWGSC awarded the Standing Offer to a bidder that did not meet the mandatory requirements of the RFSO.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid in part.

14. The Notice of Filing published in the Canada Gazette, Part I, on July 20, 2002, listed the subject of the claim bearing Registry Number 5403 to be the chemical identity of one ingredient. The subject of the claim on which the Screening Officer issued the decision is the chemical identity of one ingredient and the name of a toxicological study that identifies the ingredient.

15. Subsequent to the issuance of the decision on the claim for exemption bearing Registry Number 5084, the claimant changed its legal name from ONDEO Nalco Canada Company to Nalco Canada Company.

There were no submissions from affected parties to the Screening Officer with respect to any of the above claims for exemption and related MSDSs.

Each of the claims for exemption listed above was found to be valid. The Screening Officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to each claim did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Registry Number 4216

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose an LD50 (oral, rat) value of 6.0 mL/kg, an LD50 (dermal, rabbit) value of 16.4 mL/kg and an LC50 (8 hours, rat) value of 12 000 ppm for isopropanol;

2. Disclose an LD50 value for one of the confidential hazardous ingredients in an acceptable manner;

3. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause adverse kidney effects in laboratory animals;

4. In relation to the first-aid information shown on the MSDS for ingestion, modify or remove the statement to give water to drink and add advice to the effect that the casualty should lean forward if vomiting occurs in order to reduce the risk of aspiration;

5. Disclose that the substituted alkyl diamine in the controlled product is a skin sensitizer;

6. Disclose that an ingredient in the controlled product has been shown to cause fetotoxic effects in laboratory animals;

7. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2A.

Registry Number 4217

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose the presence of methanol in the controlled product, its CAS Registry Number 67-56-1 and its percent concentration;

2. Disclose an LD50 (oral, rat) value of 6.0 mL/kg, an LD50 (dermal, rabbit) value of 16.4 mL/kg and an LC50 (8 hours, rat) value of 12 000 ppm for isopropanol;

3. Disclose an LD50 (oral, rat) value of 3 523 mg/kg and an LC50 (4 hours, rat) value of 6 350 ppm for xylene;

4. Disclose an LD50 (oral, rat) value of 2.82 g/kg and an LD50 (dermal, rabbit) value of 661 mg/kg for 4-tert-butylcatechol;

5. Disclose an LD50 value for one of the confidential hazardous ingredients in an acceptable manner;

6. Disclose that an ingredient in the controlled product has been shown to cause skin and eye corrosion in laboratory animals;

7. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause adverse kidney effects in laboratory animals;

8. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause hearing loss in laboratory animals;

9. In relation to the period of time shown on the MSDS for flushing the eyes with water should eye contact occur, delete the current reference to "fifteen minutes" and replace it with a time of "at least twenty minutes";

10. In relation to the first-aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be washed with water for at least 20 minutes or until the chemical is removed. Also disclose that contaminated clothing, including contaminated footwear and leather goods, should be removed under running water;

11. In relation to the first-aid information shown on the MSDS for ingestion, modify or remove the statement to give water to drink and add advice to the effect that the casualty should lean forward if vomiting occurs in order to reduce the risk of aspiration;

12. Disclose the Exposure Limit Values ACGIH TLV- TWA = 200 ppm (skin) and ACGIH TLV-STEL = 250 ppm (skin) for methanol;

13. Disclose the Exposure Limit Value AIHA WEEL-TWA = 2 mg/m3 (skin, DSEN), for 4-tert-butylcatechol;

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. In relation to the first-aid information shown on the MSDS for eye contact, disclose a statement to the effect that the eyes should be washed with water for 20 minutes or until the chemical is removed;

2. Add oxides of nitrogen to the list of hazardous combustion products;

3. Disclose an LD50 (oral, rat) value of 1 340 mg/kg for cyclohexanone;

4. Disclose the Exposure Limit Values ACGIH TLV-TWA = 20 ppm (skin) and ACGIH TLV-STEL = 50 ppm (skin) for cyclohexanone;

5. Disclose the Exposure Limit Value AIHA WEEL (TWA, 8 hours) = 100 ppm for 1-methoxy-2-propyl acetate;

6. Disclose that an ingredient in the controlled product has been shown to cause moderate eye irritation in laboratory animals;

7. Disclose that an ingredient in the controlled product has been shown to be a moderate skin irritant in rabbits;

8. Disclose that an ingredient in the controlled product has been shown to cause mutagenic effects in human and mammalian cells, in vitro;

9. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D1B;

10. Registry Number 5086:

(a) In relation to the first-aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be washed with water for 20 minutes or until the chemical is removed. Also disclose that contaminated clothing and footwear should be removed;

(b) In relation to the first-aid information shown on the MSDS for inhalation, disclose a statement to the effect that trained personnel should immediately administer cardiopulmonary resuscitation if the heart has stopped;

(c) In relation to the first-aid information shown on the MSDS for ingestion, disclose a statement to the effect that trained personnel should immediately administer artificial respiration or cardiopulmonary resuscitation if breathing has stopped or the heart has stopped;

11. Registry Number 5087:

(a) In relation to the first-aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be washed with water for 20 minutes or until the chemical is removed;

(b) In relation to the first-aid information shown on the MSDS for inhalation, disclose a statement to the effect that trained personnel should immediately administer artificial respiration or pulmonary resuscitation if breathing has stopped or the heart has stopped;

(c) In relation to the first-aid information shown on the MSDS for ingestion, remove the statements to give water to drink and add advice to the effect that trained personnel should immediately administer artificial respiration or cardiopulmonary resuscitation if breathing has stopped or the heart has stopped.

Acknowledgement: Subsequent to the review of the MSDSs-of-Record respecting these particular claims, the claimant provided the Commission with copies of revised versions. These revised versions of the MSDSs were not, however, reviewed by the Screening Officer.

1. In relation to the first-aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be washed with water for at least 20 minutes or until the chemical is removed;

2. In relation to the first-aid information shown on the MSDS for eye contact, disclose a statement to the effect that the eyes should be flushed with water for at least 20 minutes or until the chemical is removed while taking care not to rinse contaminated water into the unaffected eye or face;

3. In relation to the first-aid information shown on the MSDS for ingestion, delete the statement "If conscious, drink one to two glasses of water (8-16 oz.)";

4. Disclose the flash point of 196°C (Pensky-Martens Closed Cup).

Registry Numbers 5319 and 5382

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. In relation to the first-aid information shown on the MSDS for eye contact, disclose a statement to the effect that the eyes should be flushed with water for 20 to 60 minutes;

2. In relation to the first-aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be flushed with water for 20 to 60 minutes or until the chemical is removed;

3. In relation to the first-aid information shown on the MSDS for ingestion, remove the statement to give water to drink;

4. Disclose that an ingredient in the controlled product has been shown to cause mutagenic effects in mammalian cells, in vitro;

5. Registry Number 5382:

(a) Remove the entry for amorphous silica in the hazardous materials section and disclose the presence of an additional confidential hazardous ingredient in the controlled product, together with its percent concentration;

(b) Remove the concentration range shown for epoxy resin (4,4'-isopropylidenediphenol epichlorohydrin polymer) and disclose its actual concentration or an acceptable range value.

Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the Screening Officer has, for each of the above-noted claims, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except for the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the Screening Officer within 40 days of expiry of the appeal period.

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the Screening Officer, should have been shown on the relevant MSDS.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal any decision or order of a Screening Officer. To initiate the appeal process, a Statement of Appeal (Form 1) as prescribed by the Hazardous Materials Information Review Act Appeal Board Procedures Regulations must be completed and delivered within 45 days of the publication of this notice in the Canada Gazette, Part I, to the Chief Appeals Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3, (613) 993-4429.
