Stainless steel wire — Decision

On February 17, 2004, pursuant to paragraphs 39(1)(a), (b) and (c) of the Special Import Measures Act, the President of the Canada Border Services Agency extended to 135 days, the time period for rendering the preliminary decision respecting the alleged injurious dumping into Canada of cold drawn and annealed stainless steel round wire, up to and including 0.300 inches (7.62 mm) in maximum solid cross-sectional dimension, originating in or exported from Chinese Taipei, India, the Republic of Korea, Switzerland and the United States of America, and subsidizing of such product originating in or exported from India. Consequently, the preliminary decision by the President of the Canada Border Services Agency will be made on or before April 2, 2004.

The Tribunal hereby gives notice that any parties wishing to be heard in this appeal must file a Notice of Appearance with the Secretary on or before Monday, March 29, 2004. If no such notice has been filed by that date, the appeal will be determined without holding an oral hearing.

Cold-rolled steel sheet products

On December 9, 2003, the Canadian International Trade Tribunal gave notice that it had initiated a review (Expiry Review No. RR-2003-004) pursuant to subsection 76(2) of the Special Import Measures Act concerning its findings made on August 27, 1999, in Inquiry No. NQ-99-001, concerning cold-reduced flat-rolled sheet products of carbon steel (including high-strength low-alloy steel), in coils or cut lengths (not painted, clad, plated or coated), in widths of up to and including 80 in. (2 032 mm) and in thicknesses from 0.014 in. to 0.142 in. (0.35 mm to 3.61 mm) inclusive, originating in or exported from Belgium, the Russian Federation, the Slovak Republic and Turkey.

The Notice indicated that, should the President of the Canada Border Services Agency (formerly the Commissioner of the Canada Customs and Revenue Agency) make a determination of likelihood of continuation or resumed dumping, the Tribunal's inquiry would resume on April 8, 2004, and that a public hearing would be held in the Canadian International Trade Tribunal Hearing Room, Standard Life Centre, 18th Floor, 333 Laurier Avenue W, Ottawa, Ontario, commencing on July 5, 2004, at 9:30 a.m.

Notice is hereby given that the date of the commencement of the public hearing is changed to July 19, 2004, at 9:30 a.m.

PRELIMINARY DETERMINATION OF INJURY

Frozen self-rising pizza

In the matter of a preliminary injury inquiry, under subsection 34(2) of the Special Import Measures Act, respecting the dumping of frozen self-rising pizza originating in or exported from the United States of America

The Canadian International Trade Tribunal, under the provisions of subsection 34(2) of the Special Import Measures Act, has conducted a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2003-006) into whether the evidence discloses a reasonable indication that the dumping of prepared uncooked frozen pizza products containing uncooked self-rising dough and cooked and/or uncooked toppings which typically may include processed vegetables and/or meats and/or poultry and/or cheeses and/or a prepared sauce, put up for retail sale, originating in or exported from the United States of America, has caused injury or retardation or is threatening to cause injury to the domestic industry.

This preliminary injury inquiry is pursuant to the notification, on January 2, 2004, that the President of the Canada Border Services Agency (formerly the Commissioner of the Canada Customs and Revenue Agency) had initiated an investigation into the alleged injurious dumping of the above-mentioned frozen self-rising pizza.

Pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby determines that there is evidence that discloses a reasonable indication that the dumping of the above-mentioned frozen self-rising pizza has caused injury to the domestic industry.

The statement of reasons will be issued within 15 days.

PUBLIC NOTICE 2004-10

Broadcasting licence fees — Part I

1. The Broadcasting Licence Fee Regulations, 1997, SOR/97-144, March 26, 1997 (the Regulations), provide for the payment of a Part I licence fee by certain broadcasting undertakings. Subsection 9(1) of the Regulations sets out the components for the calculation of the regulatory costs.

2. As contemplated by section 10 of the Regulations, the Commission hereby announces that the estimated total broadcasting regulatory costs of the Commission for the 2004-2005 fiscal year are $25.729 million.

3. The annual adjustment amount referred to in subsection 8(2) for the fiscal year 2002-2003 is $0.591 million.

4. A second adjustment (credit) pertaining to fiscal year 2003-2004 in the amount of $0.523 million is being made following the revision of the operating revenues reported by a number of broadcasting companies. As a result of these revisions, Part I broadcasting licence fees were recalculated and a credit is being issued and redistributed amongst the remaining broadcasting companies.

5. The net billing for the Part I licence fee for fiscal year 2004-2005, taking into account the adjustments in paragraphs 3 and 4, is $25.797 million.

The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party," for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a workplace, and includes

(a) a supplier of the controlled product;

(b) an employee at the workplace;

(c) an employer at the workplace;

(d) a safety and health professional for the workplace;

(e) a safety and health representative or a member of a safety and health committee for the workplace; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or
(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the workplace.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3.
