Frozen self-rising pizza — Decision

On March 12, 2004, pursuant to paragraph 39(1)(a) of the Special Import Measures Act, the President of the Canada Border Services Agency extended to 135 days the time period for making a preliminary decision of dumping with respect to prepared uncooked frozen pizza products containing uncooked self-rising dough and cooked and/or uncooked toppings which typically may include processed vegetables and/or meats and/or poultry and/or cheeses and/or a prepared sauce, put up for retail sale, originating in or exported from the United States of America. Consequently, the preliminary decision will be made on or before May 17, 2004.

Steel fuel tanks — Decision

On March 16, 2004, pursuant to paragraph 39(1)(a) of the Special Import Measures Act, the President of the Canada Border Services Agency extended to 135 days the time period for making a preliminary decision of dumping with respect to certain steel fuel tanks originating in or exported from the People's Republic of China and Chinese Taipei. Consequently, the preliminary decision will be made on or before May 3, 2004.

Distribution of Spike TV — Call for comments

The Commission has received a submission from the Canadian Association of Broadcasters (CAB) concerning the potential competitive impact on Canadian specialty services of a recent change in the programming format of a non-Canadian satellite service being distributed in Canada. The CAB stated that this service, which appears on the Commission's lists of eligible satellite services as TNN: The Nashville Network (TNN), has changed its programming format to that of a men's lifestyle service, re-branded as Spike TV. In light of this change, the CAB has asked the Commission to consider whether the authorization that broadcasting distribution undertakings have for the distribution of TNN in Canada can be applied to Spike TV. Accordingly, the Commission seeks comments on possible options to address this matter.

Background

1. The Commission periodically publishes lists (see footnote 1) of eligible satellite services which set out various Canadian and non-Canadian programming services received via satellite that may be distributed by broadcasting distribution undertakings (BDUs). Since 1984, these lists have included TNN: The Nashville Network (TNN) among the non-Canadian services that BDUs may distribute.

2. In May 2000, TNN was acquired by Viacom International Inc. (Viacom), and was included as part of Viacom's MTV network of services. In September 2000, Viacom announced that it was changing the programming format of TNN from a format oriented to country music and the country music industry to a general entertainment format, and stated that, while the call letters would remain as TNN, the service would be known as TNN: The National Network.

3. On April 15, 2003, Viacom announced that TNN: The National Network would be re-named Spike TV: The First Network for Men (Spike TV), and that the service would be re-branded as a men's lifestyle programming service reflecting a wide range of men's interests. Spike TV was launched in August 2003.

Position of the CAB

4. On June 2, 2003, the CAB wrote to the Commission expressing concern that the change in programming format that accompanied the re-branding of TNN as Spike TV would result in the service becoming directly competitive with a number of existing Canadian pay and specialty services, including Men TV, CTV Travel, ROBTv, Discovery Health Network, TSN, The Score and Sportsnet. In light of these concerns, the CAB requested that the Commission initiate a public proceeding to determine whether Spike TV should be removed from the lists of eligible satellite services.

5. In subsequent correspondence dated August 15, 2003, the CAB concluded that, in addition to having the same target audience, Spike TV draws from program categories that are similar to those from which Men TV is authorized to draw programming. The CAB expressed concern that, with the two services targeting the same audience and offering programming from similar program categories, Spike TV is in direct competition with Men TV for the acquisition of programming.

6. In its letter of August 15, the CAB maintained its position that Spike TV, because of the broad scope of its programming is also partially competitive with many other Canadian services, including CTV Travel, ROBTv and Discovery Health Network.

7. The only remedy to the current situation, according to the CAB, is the removal of TNN from the lists of eligible satellite services, which would, in turn, lead to the deletion of Spike TV from the channel line-up of all BDUs that currently distribute the service. The CAB was of the view that TNN, the service originally authorized for distribution by the Commission, no longer exists and that the service that replaced it, now branded as Spike TV, is a completely different service in that it is owned and operated by a different company and provides programming bearing no relationship or similarity to the programming service authorized by the Commission. For these reasons, the CAB argued that the existing authorization to distribute TNN in Canada does not extend to Spike TV.

8. The CAB also submitted that the onus should be on Spike TV and a Canadian sponsor to provide evidence that the service does not compete either wholly or partially with Canadian pay and specialty services. In the absence of a formal request by a Canadian sponsor to amend the lists of eligible satellite services to replace TNN with Spike TV, the CAB was of the view that the Commission could quite properly remove TNN from the lists of eligible satellite services.

Commission policies concerning the authorization of non-Canadian services

9. The decision to authorize the distribution of a non-Canadian service by Canadian BDUs is made on a case-by-case basis. The Commission has, however, addressed this matter in several policy statements. In Specialty Programming Services, Public Notice CRTC 1984-81, April 2, 1984 (Public Notice 1984-81), the Commission stated that it would not be in the interest of the Canadian broadcasting system to allow the carriage of non-Canadian specialty programming services that, in the Commission's opinion, could be considered either totally or partially competitive with Canadian discretionary services. In Revised List of Eligible Satellite Services, Public Notice CRTC 1997-96, July 22, 1997, the Commission reaffirmed the approach set out in Public Notice 1984-81 and stated that it would consider the removal of a non-Canadian service from the lists of eligible satellite services if that service should undergo a change in format so as to become competitive with a Canadian pay or specialty service.

10. In Structural Public Hearing, Public Notice CRTC 1993-74, June 3, 1993 (Public Notice 1993-74), the Commission set out an additional option for dealing with non-Canadian services that undergo a change in programming format so as to become competitive with a Canadian pay or specialty service. In Public Notice 1993-74, the Commission stated that it may, on a case-by-case basis, place such a service on Section "B" of the Part II list, for linkage exclusively with Canadian pay television services, rather than delete it entirely from the Part II list of eligible satellite services. The linkage requirements are to ensure that non-Canadian services are distributed in conjunction with licensed Canadian services. The current linkage requirements are set out in Distribution and linkage requirements for Class 1 and Class 2 licensees, Public Notice CRTC 2000-155, November 8, 2000, and are updated periodically.

11. In Call for proposals to amend the lists of eligible satellite services through the inclusion of additional non-Canadian services eligible for distribution on a digital basis only, Public Notice CRTC 2000-173, December 14, 2000, the Commission stated that it would only consider those requests for non-Canadian services to be added to the lists of eligible satellite services which include evidence that such services have agreed to be sponsored by a Canadian party. It is the role of a Canadian sponsor to file such requests for addition to the lists on behalf of a non-Canadian service. Such requests must include a brief description of the non-Canadian service, a copy of the program schedule, a statement that the service has obtained all necessary rights for the distribution of its programming in Canada, and a statement that the non-Canadian service does not hold, will not obtain, and will not exercise preferential or exclusive programming rights in relation to the distribution of programming in Canada.

Call for comments

12. The CAB has submitted that Spike TV is wholly or partially competitive with a number of Canadian pay and specialty services. It has further submitted that the current authorization to distribute TNN in Canada does not extend to Spike TV. The Commission invites comments on the position of the CAB.

13. The Commission further invites comments on what actions would be appropriate should the Commission find that Spike TV is wholly or partially competitive with one or more Canadian pay and specialty services, and/or that the current authorization to distribute TNN in Canada does not extend to Spike TV.

14. The Commission will accept comments that it receives on or before May 17, 2004. The Commission will not formally acknowledge comments. It will, however, fully consider all comments and they will form part of the public record of the proceeding, provided that the procedures for filing set out in the notice have been followed.

The subject of the claim on which the Screening Officer issued the decision is the chemical identity and concentration of one ingredient.

There were no submissions from affected parties to the Screening Officer with respect to any of the above claims for exemption and related MSDSs.

Each of the claims for exemption listed above was found to be valid with the exception of the claim bearing Registry Number 4770 which was found to be partially valid. The Screening Officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the claims bearing Registry Numbers 5109 and 5169 complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

In the case of the claim bearing Registry Number 4754, being a claim from an employer in the province of Alberta, the Screening Officer found that the MSDS relating to this claim did not comply with the applicable disclosure requirements of the Chemical Hazards Regulation to the Occupational Health and Safety Act of the Province of Alberta.

Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the remaining claims did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Registry Number 4430

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Delete the statement which indicates that the ingredient called a reaction product of formaldehyde and isobutylenated phenol is a WHMIS confidential ingredient;

2. Delete the statement which indicates that the ingredient zinc alkyldithiophosphate is a WHMIS confidential ingredient and disclose its CAS number, 68649-42-3;

3. In relation to the first-aid information shown on the MSDS for ingestion, delete the statements to drink water;

4. Disclose skin contact and eye contact as routes of entry.

Registry Number 4472

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2B;

2. Disclose an LD50 value for both the confidential hazardous ingredients in an acceptable manner;

3. Disclose that acute inhalation of high doses of an ingredient in the controlled product has been shown to cause adverse lung effects and disclose that chronic inhalation of the ingredient has been shown to cause adverse effects on the kidneys and testes of laboratory animals;

4. Disclose that acute ingestion of an ingredient of the controlled product has caused adverse CNS effects;

5. Disclose that an ingredient in the controlled product has been shown to be a moderate to severe skin irritant;

6. Disclose that an ingredient in the controlled product has shown positive results in a screening test for mutagenicity;

7. Disclose the ACGIH TLV-STEL Exposure Limit Values for the confidential hazardous ingredients;

8. In relation to the first-aid information shown on the MSDS for ingestion, disclose a statement to the effect that trained personnel should immediately administer artificial respiration or cardiopulmonary resuscitation if breathing has stopped or the heart has stopped.

Acknowledgement: Subsequent to the review of the MSDS-of-Record respecting this particular claim, the claimant provided the Commission with a copy of a revised version. This revised version of the MSDS was not, however, reviewed by the Screening Officer.

Registry Number 4629

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Characterize the long-chain alkyl amines and long-chain alkenyl amine as being precursor ingredients of a reaction mixture considered hazardous in Canada and disclose a generic chemical identity for that reaction mixture;

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose an LD50 (dermal, rabbit) value of 235 mg/kg and an LC50 (6 hours, rat) of 117 ppm for 2,2'-oxybis (N,N-dimethylethanamine);

2. Disclose the percent concentrations of 1,8-diazobicyclo [5,4,0] undec-7-ene and 2,2'-oxybis (N,N-dimethylethanamine) in an acceptable manner;

3. In relation to the first-aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be flushed with water for 20 to 60 minutes or until the chemical is removed;

4. In relation to the first-aid information shown on the MSDS for inhalation, add that medical attention should be obtained immediately;

5. In relation to the first-aid information shown on the MSDS for ingestion, remove the statements to give water to drink;

6. Disclose that an ingredient in the controlled product has shown positive results in an in vitro screening test for mutagenicity.

Registry Number 5150

The claimant has been ordered to amend certain aspects of the format of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Remove sulfur oxides from the list of hazardous decomposition products.

Acknowledgement: Subsequent to the review of the MSDS-of-Record respecting this particular claim, the claimant provided the Commission with a copy of a revised version. This revised version of the MSDS was not, however, reviewed by the Screening Officer.

Registry Numbers 5167 and 5168

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. In relation to the first-aid information shown on the MSDS for ingestion, remove the statement to give two glasses of water to drink;

2. Disclose oxides of sulphur as hazardous combustion products;

3. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D1.

Registry Number 5233

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. In relation to the first-aid information shown on the MSDS for ingestion, delete the statements to drink water and add advice to the effect that the casualty should lean forward if vomiting occurs in order to reduce the risk of aspiration.

Registry Numbers 5286 and 5287

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. In relation to the first-aid information shown on the MSDS for ingestion, remove the statement to give one to two glasses of water to drink.

Registry Number 5377

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. In relation to the first-aid information shown on the MSDS for ingestion, remove the statement to give two glasses of water to drink.

Having regard to the foregoing, and pursuant to sections 16 and 17 of the Hazardous Materials Information Review Act, notice is hereby given that the Screening Officer has, for the claim bearing Registry Number 4770, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, including disclosing the identity of one ingredient which was included among the information in respect of which the claim for exemption was made, and to provide a copy of the amended MSDS to the Screening Officer within 40 days of expiry of the appeal period.

Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the Screening Officer has, for each of the remaining above-noted claims, with the exceptions of those claims bearing Registry Numbers 4754, 5109 and 5169, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the Screening Officer within 40 days of expiry of the appeal period.

In the case of the claim bearing Registry Number 4754, the Screening Officer has ordered the claimant to comply with the provisions of the Chemical Hazards Regulation to the Occupational Health and Safety Act of the Province of Alberta, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the Screening Officer, within the respective time period specified in the foregoing paragraph.

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the Screening Officer, should have been shown on the relevant MSDS.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal any decision or order of a Screening Officer. To initiate the appeal process, a Statement of Appeal (Form 1) as prescribed by the Hazardous Materials Information Review Act Appeal Board Procedures Regulations must be completed and delivered within 45 days of the publication of this notice in the Canada Gazette, Part I, to the Chief Appeals Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3, (613) 993-4429.
