Outdoor barbeques — Decision

On June 25, 2004, pursuant to paragraph 39(1)(a) of the Special Import Measures Act, the President of the Canada Border Services Agency extended to 135 days the time period for making a preliminary decision of dumping and/or subsidization of self-standing barbeques for outdoor use, consisting of metal lid, base and frame, fuelled by either propane or natural gas, with primary cooking space between 200 and 550 square inches (approximately 1 290 and 3 549 square centimetres), in assembled or knocked-down condition, originating in or exported from the People's Republic of China. Consequently, the preliminary decision will be made on or before August 27, 2004.

Stainless steel wire — Decision

On June 30, 2004, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the President of the Canada Border Services Agency (CBSA) made a final determination of dumping respecting cold drawn and annealed stainless steel round wire, up to and including 0.300 inches (7.62 mm) in maximum solid cross-sectional dimension, originating in or exported from the Republic of Korea, Switzerland, and the United States of America, and made a final determination of subsidizing respecting such product originating in or exported from India.

The goods in question are properly classified under the following Harmonized System classification numbers:

7223.00.11.00      7223.00.19.00      7223.00.20.00

The Canadian International Trade Tribunal (the Tribunal) is continuing its inquiry into the question of injury to the domestic industry and will make an order or finding by July 30, 2004. Provisional duty will continue to apply until this date.

If the Tribunal finds that the dumping and subsidizing has caused injury or is threatening to cause injury, future imports of subject goods will be subject to antidumping duty equal to the margin of dumping and countervailing duty equal to the amount of subsidy. In that event, the importer in Canada shall pay all such duty. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of antidumping and countervailing duty.

Replacement Class Screening Report: Special Events in the Halifax Defence Complex — Public notice

The Canadian Environmental Assessment Agency (the Agency) declares the report entitled "Replacement Class Screening Report: Special Events in the Halifax Defence Complex" (the RCSR) to be a replacement class screening report pursuant to subsection 19(1) and paragraph 19(2)(a) of the Canadian Environmental Assessment Act (the Act).

In making the declaration proposed by the Parks Canada Agency, the Agency has reviewed the RCSR and determined that the project screening process, as described in the document, will meet the requirements of the Act for the environmental assessment of the class of projects. It is also the opinion of the Agency that the class of projects described in the RCSR is not likely to cause significant adverse environmental effects when the design standards and mitigation measures described in the report are applied.

The declaration is effective July 17, 2004, and is subject to the following terms and conditions:

— Subject to subsection 19(8) of the Act, the declaration period is valid until July 16, 2009.

— The Parks Canada Agency will notify the Agency, in writing, a minimum of six months prior to the date on which the declaration expires, of its intention to renew the RCSR, to renew the RCSR with modifications or additions, or not to renew the RCSR and thereby allow the declaration to expire.

— To renew the RCSR, the Parks Canada Agency will submit the proposed class screening report to the Agency not less than two months prior to the expiration date of this declaration, so that the Agency may initiate a new declaration process.

— The Parks Canada Agency and the Agency will ensure that the RCSR is made available to the public in accordance with the requirements of the Act, as it may be amended from time to time. As such, the Parks Canada Agency will place the RCSR in the Canadian Environmental Assessment Registry (the CEAR) project file in its Regional Office. The Parks Canada Agency will also post a statement of the projects in respect of which the RCSR was used, to the CEAR Internet site, on a quarterly basis as required under paragraph 55.1(2)(d) of the Act.

— Any amendments to the report will be developed and implemented in accordance with the provisions for amendment contained in section 6 of the RCSR.

CANADIAN RADIO-TELEVISION AND TELECOMMUNICATIONS COMMISSION

PUBLIC HEARING 2004-7

The Commission will hold a public hearing following the conclusion of the public hearing commencing on September 7, 2004, announced in Broadcasting Notice of Public Hearing CRTC 2004-5, at the Conference Centre, Portage IV, 140 Promenade du Portage, Gatineau, Quebec, to consider the following:

Star Choice Television Network Incorporated (Star Choice) is the licensee of a national, direct-to-home broadcasting distribution undertaking. On May 1, 2003, pursuant to subsection 12(2) of the Broadcasting Distribution Regulations (the Regulations), Star Choice (through its parent company Star Choice Communications Inc.) requested that the Commission resolve a dispute between Star Choice and MusiquePlus Inc. MusiquePlus Inc. is the licensee of two French-language specialty services, namely MusiMax and MusiquePlus. The dispute concerned the wholesale rate payments owed and payable by Star Choice to MusiquePlus Inc. for the distribution of these services, in both the Quebec market and the market in the rest of Canada, between July 31, 2001, and August 31, 2003, and between September 1, 2003, and August 31, 2006.

The Commission proceeded to deal with this matter by way of a confidential final offer selection process, as described in Access rules for broadcasting distribution undertakings, Public Notice CRTC 1996-60, April 26, 1996, and in Practices and procedures for resolving competitive and access disputes, Public Notice CRTC 2000-65, May 12, 2000. In accordance with this process, both Star Choice and MusiquePlus Inc. were requested to submit final offers accompanied by supporting rationales. On December 23, 2003, the Commission selected the final offer that had been submitted by MusiquePlus Inc. Although the final offer by MusiquePlus Inc. had reflected a starting date of September 1, 2000, for the wholesale rate repayments, the Commission determined that the starting date would be July 31, 2001, that date marking the beginning of the historical period for which the Commission's determination had been sought. The Commission's decision was conveyed to the parties in a confidential letter decision.

On April 26, 2004, the Commission received a letter from MusiquePlus Inc. alleging that Star Choice had failed to pay wholesale fees to MusiquePlus Inc. in accordance with the Commission's decision. MusiquePlus Inc. requested that the Commission issue a mandatory order to Star Choice, pursuant to subsection 12(2) of the Broadcasting Act (the Act), requiring Star Choice to comply with the Commission's decision. In a subsequent letter dated May 14, 2004, MusiquePlus Inc. indicated that, as of February 2004, Star Choice was in arrears by a total amount of $1,121,373.21.

In a letter dated April 30, 2004, Star Choice was asked to inform the Commission whether it was in compliance with the Commission's decision. In its reply letter dated May 7, 2004, Star Choice indicated its wish to continue to negotiate with MusiquePlus Inc. on this and related matters and that, in the interim, it would adjust its payments going forward to reflect the Commission's decision.

Mandatory order

The Commission notes that the requirements set out in its decision covered both of the periods July 31, 2001, to August 31, 2003, and September 1, 2003, to August 31, 2006. The Commission is satisfied that the requirements were clear and does not regard Star Choice's letter of May 7, 2004, as responsive to the Commission's letter of April 30, 2004. The Commission thus considers it appropriate to proceed to a mandatory order hearing immediately.

Accordingly, pursuant to section 12 of the Act, the Commission requires Star Choice to appear at a public hearing following the conclusion of the September 7, 2004 public hearing, at the Conference Centre, Portage IV, 140 Promenade du Portage, Gatineau, Quebec, to show cause why a mandatory order requiring it to comply with section 15 of the Regulations and, more particularly, with the Commission's letter decision dated December 23, 2003, should not be issued.

Call for comments — Three phase process

In order to gather additional information with respect to this matter in advance of the hearing and to co-ordinate the Commission's efforts efficiently, the Commission's public process will proceed as set out below.

Phase 1

Star Choice may file no later than July 23, 2004, any documentation and argument it believes pertinent to the issuance of a mandatory order requiring it to comply with section 15 of the Regulations and, more particularly, with the Commission's letter decision dated December 23, 2003.

Once received, the above information will be placed on the public file to permit all parties to comment.

Phase 2

MusiquePlus Inc. and the public may provide written comments concerning the issuance of a mandatory order. In Call for comments on the channel placement of services whose distribution has been required pursuant to section 9(1)(h) of the Broadcasting Act, Broadcasting Public Notice CRTC 2002-49, August 16, 2002, the Commission sought comments on questions concerning the channel placement of programming services, in particular the Aboriginal Peoples Television Network and TVA, that have been licensed for mandatory carriage as part of the basic service pursuant to paragraph 9(1)(h) of the Broadcasting Act. The Commission has determined that, instead of mandating the channel placement of these services, it will require all distributors to assist in improving the visibility of such services through improved promotion. Accordingly, in the public notice, the Commission seeks comments on what specific tools could be used to promote and improve the visibility of these mandated services. The Commission will accept comments that it receives on or before October 7, 2004.

Proposal by the Canadian Cable Television Association to amend the policy regarding the use of local availabilities — Call for comments

The Canadian Cable Television Association (CCTA) proposed that the Commission amend its policy regarding the use of the local availabilities contained in the programming of U.S. satellite services. Under the CCTA's proposal, a Canadian cable broadcasting distribution undertaking, upon approval of an application, would be permitted to use these local availabilities to distribute commercial advertising messages, as well as messages promoting affiliated services offered by the cable undertaking. The Commission seeks comments on the CCTA's proposal and on the impact that approval of the proposed policy amendments could have on the Canadian broadcasting system. The Commission will accept comments that it receives on or before October 7, 2004.

CANADA TRANSPORTATION ACT

Public hearing

IN THE MATTER OF complaints filed by Jacob Pendergrast, Charles Warren and Kimberley Dowson against Jetsgo Corporation alleging that the carrier's $250 liability limit for baggage lost, damaged or delayed on its domestic flights is unreasonable, the Canadian Transportation Agency will hold a public hearing commencing on September 27, 2004, at 10 a.m., in Toronto, Ontario.

Pursuant to subsection 67.2(1) of the Canada Transportation Act, if, upon complaint, the Agency finds that the holder of a domestic licence has applied terms or conditions of carriage applicable to the domestic service it offers that are unreasonable or unduly discriminatory, the Agency may suspend or disallow those terms or conditions and substitute other terms or conditions in their place. In the course of the public hearing, the Agency will hear evidence from interested persons with respect to factors which air carriers should consider in establishing reasonable tariff liability limits for baggage lost, damaged or delayed on domestic flights.

Participation at the hearing

Persons who have information or positions relevant to this matter and who wish to participate in the proceeding as interveners in support of, or opposition to, any of the complaints shall file a written intervention with the Agency by no later than August 18, 2004. Submissions must include the person's name, address, telephone number and, if applicable, a fax number and/or electronic mail address; a clear and detailed description of the person's interest in, and support of or opposition to, the complaint; detailed arguments and, where applicable, evidence in support of the position adopted; and an indication of whether or not they wish to make an oral presentation at the hearing in addition to their written intervention.

Please note that the Agency may refuse an intervention if a person fails to demonstrate a real interest in any of the complaints.

Written comments

Persons who wish to comment on the issues raised by the complaints without participating in the public hearing may do so by writing a letter to the Agency stating their views and enclosing any relevant information. The communication should indicate that the author does not wish to appear at the public hearing. Letters received on or before September 8, 2004, will become part of the public record and will be considered by the Agency in making its final determinations in respect of the complaints.

The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party," for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a workplace, and includes

(a) a supplier of the controlled product;

(b) an employee at the workplace;

(c) an employer at the workplace;

(d) a safety and health professional for the workplace;

(e) a safety and health representative or a member of a safety and health committee for the workplace; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or

(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the workplace.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3.
