EXPIRY REVIEW OF FINDING

Dishwashers and dryers

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it will, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiate an expiry review (Expiry Review No. RR-2004-005) of its finding made on August 1, 2000, in Inquiry No. NQ-2000-001, as amended on March 19, 2003, in Interim Review No. RD-2002-005, concerning certain electric household dishwashers and gas or electric laundry dryers originating in or exported from the United States of America and produced by, or on behalf of, White Consolidated Industries, Inc. and Whirlpool Corporation, their respective affiliates, successors and assigns.

Notice of Expiry No. LE-2004-006, issued on September 28, 2004, informed interested persons and governments of the impending expiry of the finding. On the basis of available information, including representations requesting or opposing the initiation of an expiry review and responses to these representations received by the Tribunal in reply to the notice, the Tribunal is of the opinion that a review of the finding is warranted. The Tribunal has notified the Canada Border Services Agency (CBSA), as well as other interested persons and governments, of its decision.

The Tribunal has issued a Draft Guideline on Expiry Reviews that can be found on the Tribunal's Web site at www.citt-tcce.gc.ca. In this expiry review, the CBSA must determine whether the expiry of the finding in respect of certain dishwashers and dryers is likely to result in the continuation or resumption of dumping of the goods.

If the CBSA determines that the expiry of the finding in respect of any goods is likely to result in the continuation or resumption of dumping, the CBSA will provide the Tribunal with the information that is required under the Canadian International Trade Tribunal Rules. The Tribunal will then conduct an inquiry to determine if the continued or resumed dumping is likely to result in injury or retardation.

If the CBSA determines that the expiry of the finding in respect of any goods is unlikely to result in the continuation or resumption of dumping, the Tribunal will not consider those goods in its subsequent determination of the likelihood of injury or retardation and will issue an order rescinding the finding with respect to those goods.

The CBSA must provide notice of its determination within 120 days after receiving notice of the Tribunal's decision to initiate an expiry review, that is, no later than March 17, 2005. The CBSA will also notify all persons or governments that were notified by the Tribunal of the commencement of an expiry review, as well as any others that participated in the CBSA's investigation.

Letters have been sent to parties with a known interest in the expiry review providing them with the schedule respecting both the CBSA's investigation and the Tribunal's inquiry, should the CBSA determine that the expiry of the finding in respect of any goods is likely to result in a continuation or resumption of dumping.

The CBSA's investigation

The CBSA will conduct its investigation pursuant to the provisions of SIMA and the administrative guidelines set forth in the Anti-dumping and Countervailing Directorate's publication entitled Guidelines on the Conduct of Expiry Review Investigations under the Special Import Measures Act. Any information submitted to the CBSA by interested persons concerning this investigation is deemed to be public information unless clearly designated as confidential. Where the submission is confidential, a non-confidential edited version or summary of the submission must also be provided which will be disclosed to interested parties upon request.

With respect to the CBSA's investigation, the schedule specifies, among other things, the date for the filing of replies to the expiry review questionnaires, the date on which the CBSA exhibits will be available to parties to the proceeding, the date on which the administrative record will be closed and the dates for the filing of submissions by parties in the proceeding. The expiry review questionnaires for exporters, importers and domestic producer are posted on the CBSA's Web site at http://www.cbsa-asfc.gc.ca/sima/expiry-eng.html.

Tribunal's inquiry

Should the CBSA determine that the expiry of the finding in respect of any goods is likely to result in a continuation or resumption of dumping, the Tribunal will conduct its inquiry, pursuant to the provisions of SIMA and its Draft Guideline on Expiry Reviews, to determine if there is a likelihood of injury or retardation. The schedule for the Tribunal's inquiry specifies, among other things, the date for the filing of replies by the domestic producer to Part E of the expiry review questionnaire, the date on which information on the record will be made available by the Tribunal to interested parties and counsel that have filed notices of participation and the dates for the filing of submissions by interested parties.

The Tribunal's Guide to Making Requests for Product Exclusions, which can be found on the Tribunal's Web site, describes the procedure for filing requests for specific product exclusions. The Guide includes a form for filing requests for product exclusions and a form for any party that opposes a request to respond to such requests. This does not preclude parties from making submissions in a different format if they so wish, provided that all of the information and supporting documentation requested in the forms are included. Requests to exclude goods from the finding shall be filed by interested parties no later than May 17, 2005. Parties opposed or consenting or not opposed to the request for exclusion shall file written reply submissions no later than May 26, 2005. Should the request for a specific product exclusion be opposed, and if the interested party wishes to reply, it must do so within a period determined by the Tribunal in advance of the hearing.

Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why the information is designated as confidential. Furthermore, the person must submit a non-confidential edited version or non-confidential summary of the information designated as confidential or a statement indicating why such an edited version or summary cannot be made.

Public hearing

The Tribunal will hold a public hearing relating to this expiry review in the Tribunal Hearing Room, 18th Floor, Standard Life Centre, 333 Laurier Avenue W, Ottawa, Ontario, commencing on June 6, 2005, at 9:30 a.m., to hear evidence and representations by interested parties.

Each interested person or government wishing to participate at the hearing as a party must file a notice of participation with the Secretary on or before March 24, 2005. Each counsel who intends to represent a party at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before March 24, 2005.

To allow the Tribunal to determine whether simultaneous interpretation will be required for the hearing, each interested person or government filing a notice of participation and each counsel filing a notice of representation must advise the Secretary, at the same time that they file the notice, whether they and their witnesses will be using English or French or both languages at the hearing.

The Canadian International Trade Tribunal Rules govern these proceedings.

In order to observe and understand production processes, the Tribunal, accompanied by its staff, may conduct plant visits.

International air cargo transhipment program at Winnipeg International airport

In accordance with the decision to approve participation of Winnipeg International Airport in the federal government's air cargo transhipment program announced by the Minister of Transport on September 27, 2004, notice is hereby given that the Canadian Transportation Agency will consider applications from Canadian and foreign air carriers for authorization to carry international cargo shipments to and from Winnipeg International Airport coming from and destined for points outside the territory of Canada. Such authorization would carry an obligation to report traffic carried to and from Winnipeg in accordance with directions to be advised upon authorization, and an obligation to have sufficient liability insurance coverage in respect of the service to be provided to satisfy the minimum requirements of the Air Transportation Regulations, SOR/88-58, as amended. Such intransit cargo would be held in bond pending its onward transportation to its destination.

There were no submissions from affected parties to the Screening Officer with respect to any of the above claims for exemption and related MSDSs.

Each of the claims for exemption listed above was found to be valid with the exception of the claim bearing registry number 5516 which was found to be partially valid. The Screening Officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to each claim did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal any decision or order of a Screening Officer. BOUNDARY WATERS TREATY OF 1909

The International Joint Commission releases International Missisquoi Bay Task Force Report and schedules public hearings

The International Joint Commission (IJC) today released the report of its International Missisquoi Bay Task Force and scheduled public hearings to receive comment on the report.

In May of this year, the Canadian and United States federal governments asked the IJC to review plans by the State of Vermont to modernize the Alburg-Swanton Bridge, involving the partial removal of the existing causeway, and to provide advice on whether the plans comply with Article IV of the Boundary Waters Treaty of 1909. Article IV states, in part, that "boundary waters and waters flowing across the boundary shall not be polluted on either side to the injury of health or property on the other."

All interested organizations and citizens are invited to speak at the public hearings to be held at the following times and locations:

Monday, December 6, 2004, from 7 p.m. to 9:30 p.m., at the Centre des loisirs, 1 Tourangeau Street, Saint-Georges-de-Clarenceville, Quebec;

Tuesday, December 7, 2004, from 7 p.m. to 9:30 p.m., at the Missisquoi Valley Union High School, 100 Thunderbird Drive, Swanton, Vermont.

COMPLETION OF PANEL REVIEW

Pure magnesium from Canada

Notice is hereby given, pursuant to rule 79 of the NAFTA Article 1904 Panel Rules, that the binational panel review of the Final Results of the Full Sunset Review of the antidumping duty order made by United States Department of Commerce, International Trade Administration, respecting Pure Magnesium from Canada is completed (Secretariat File No. USA-CDA-2000-1904-06). This notice is effective as of October 8, 2004, the day after the Extraordinary Challenge Committee issued its decision affirming the panel decisions.

In the October 7, 2004 decision, the Extraordinary Challenge Committee (Secretariat File No. ECC-2003-1904-01USA) dismissed the challenge and affirmed the panel decisions in the matter of Pure Magnesium from Canada.

Explanatory note

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.

Under Article 1904 of the North American Free Trade Agreement which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.
