CANADIAN INTERNATIONAL TRADE TRIBUNAL

EXPIRY OF FINDING

Stainless steel round bar

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its finding made on October 27, 2000, in Inquiry No. NQ-2000-002, concerning the dumping in Canada of stainless steel round bar of sizes 25 mm in diameter up to 570 mm in diameter inclusive, excluding stainless steel round bar made to specifications ASN-A3380, ASN-A3294 and 410QDT (oil quenched), i.e. grade 410 quenched and double-tempered with an oil quenching medium, originating in or exported from Brazil, and the subsidizing of stainless steel round bar of sizes 25 mm in diameter up to 570 mm in diameter inclusive, excluding stainless steel round bar made to specifications ASN-A3380, ASN-A3294 and 410QDT (oil quenched), i.e. grade 410 quenched and double-tempered with an oil quenching medium, originating in or exported from Brazil and India, is scheduled to expire (Expiry No. LE-2004-008) on October 26, 2005. Under SIMA, findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date. An expiry review will not be initiated unless the Tribunal decides that there is sufficient information to indicate that it is warranted.

Persons or governments requesting or opposing the initiation of an expiry review of the said finding should file 20 copies of written public submissions containing relevant information, opinions and arguments, with the Secretary of the Tribunal not later than December 22, 2004. Persons or governments should endeavour to base their submissions exclusively on public information; however, confidential information relevant to the issues before the Tribunal may be filed, if necessary, along with a comprehensive public summary or edited version thereof.

Submissions should address all relevant factors, including

•  the likelihood of continued or resumed dumping and subsidizing of the goods;

•  the likely volume and price ranges of dumped and subsidized imports if dumping and subsidizing were to continue or resume;

•  the domestic industry's recent performance, including trends in production, sales, market share and profits;

•  the likelihood of injury to the domestic industry if the finding were allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped and subsidized imports on the industry's future performance;

•  any other developments affecting, or likely to affect, the performance of the domestic industry;

•  changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and

•  any other matter that is relevant.

Where there are opposing views, each person or government that filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other persons or governments. In these circumstances, the Tribunal will distribute copies of the public submissions to each person or government that filed a submission with the Tribunal. Persons or governments wishing to respond to the submissions must do so not later than January 6, 2005. If confidential submissions have been filed, the Secretary will notify persons or governments and instruct them on how they may access these submissions through qualified counsel.

The Tribunal will issue a decision on January 18, 2005, on whether an expiry review is warranted based on the submissions and representations received and the responses to them.

•  If there is no request for a review, the Tribunal will not initiate a review and the finding will expire on its expiry date.

•  If the Tribunal decides that a review is not warranted, the finding will expire on its expiry date. The Tribunal will issue its reasons not later than 15 days after its decision.

•  If the Tribunal decides to initiate a review, it will issue a notice of expiry review.

The Tribunal's Draft Guideline on Expiry Reviews can be found on its Web site at www.citt-tcce.gc.ca. In addition to providing more detailed information on the proceeding whereby the Tribunal determines if an expiry review is warranted, the draft guideline explains how an expiry review is conducted if the Tribunal determines that one is warranted. In an expiry review, the President of the Canada Border Services Agency (CBSA) first determines whether the expiry of the order or finding is likely to result in the continuation or resumption of dumping or subsidizing of the goods. If the CBSA determines that the expiry of the order or finding in respect of any goods is likely to result in the continuation or resumption of dumping or subsidizing, the Tribunal will then conduct an inquiry to determine if the continued or resumed dumping or subsidizing is likely to result in injury or retardation. The Tribunal's notice of expiry review will provide more information on the expiry review process.

The Canadian International Trade Tribunal, under the provisions of subsection 34(2) of the Special Import Measures Act, has conducted a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2004-003) into whether the evidence discloses a reasonable indication that the dumping of laminate flooring in thickness ranging from 5.5 mm to 13.0 mm (other than laminate hardwood flooring where the hardwood component exceeds 2.0 mm in thickness) originating in or exported from Austria, Belgium, the People's Republic of China, France, the Federal Republic of Germany, Luxembourg and the Republic of Poland and the subsidizing of laminate flooring in thickness ranging from 5.5 mm to 13.0 mm (other than laminate hardwood flooring where the hardwood component exceeds 2.0 mm in thickness) originating in or exported from the People's Republic of China have caused injury or retardation or are threatening to cause injury to the domestic industry.

This preliminary injury inquiry is pursuant to the notification, on October 4, 2004, that the President of the Canada Border Services Agency had initiated an investigation into the alleged injurious dumping and subsidizing of the above-mentioned goods.

Pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby determines that there is evidence that discloses a reasonable indication that the dumping and subsidizing of the above-mentioned goods have caused injury to the domestic industry.

The Canadian International Trade Tribunal finds that the question of whether there should be more than one class of goods merits further consideration. Therefore, the Canadian International Trade Tribunal requests the Canada Border Services Agency to collect separate information on the dumping and subsidizing of laminate flooring with a decorative layer constructed with (1) a surface layer of fibrous material (usually paper) or (2) a hardwood surface layer not exceeding 2.0 mm in thickness. The Canadian International Trade Tribunal also requests aggregated information for these two categories of products. As well, the Canadian International Trade Tribunal requests the information by both value and volume.

The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party," for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a workplace, and includes

(a) a supplier of the controlled product;

(b) an employee at the workplace;

(c) an employer at the workplace;

(d) a safety and health professional for the workplace;

(e) a safety and health representative or a member of a safety and health committee for the workplace; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or

(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the workplace.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3.

Softwood lumber products

Notice is hereby given, pursuant to rule 70 of the NAFTA Article 1904 Panel Rules, that the panel established to review the Final Affirmative Countervailing Duty Determination made by the United States Department of Commerce, International Trade Administration, respecting Certain Softwood Lumber Products from Canada, issued its decision on the second determination on remand on December 1, 2004 (Secretariat File No. USA-CDA-2002-1904-03).

In the December 1, 2004 decision, the binational panel affirmed in part and remanded in part the agency's second determination on remand respecting Softwood Lumber Products from Canada.

The binational panel instructed the investigating authority to provide its third determination on remand by January 24, 2005.

Explanatory note

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.

Under Article 1904 of the North American Free Trade Agreement which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.

REQUEST FOR EXTRAORDINARY CHALLENGE COMMITTEE

Softwood lumber from Canada

Notice is hereby given, in accordance with the Special Import Measures Act (as amended by the North American Free Trade Agreement Implementation Act), that on November 24, 2004, the Office of the United States Representative filed a Request for an Extraordinary Challenge Committee (ECC) to review issues raised by the decisions of the binational panel in the matter of the final affirmative threat of material injury determination made by the United States International Trade Commission, respecting softwood lumber from Canada, Secretariat File No. USA-CDA-2002-1904-07.

The extraordinary challenge proceeding will be conducted in accordance with the NAFTA Extraordinary Challenge Committee Rules. Rules 40 and 41 of the above-mentioned Rules provide that within 10 days after the Request for an Extraordinary Challenge Committee is filed, a Party, a participant in the panel review or a panelist against whom an allegation contained in the Request is made and who proposes to participate in the extraordinary challenge proceeding shall file with the responsible Secretariat a Notice of Appearance (the deadline for filing a Notice of Appearance is December 6, 2004).

Also, subrule 58(2)(b) of the above-mentioned Rules provides that all briefs of

(i) the Party who has filed the Request and of every participant who files a Notice of Appearance in support of the Request shall be filed no later than 21 days after the date of filing of the Request (the deadline is December 15, 2004);

(ii) every participant who files a Notice of Appearance in opposition to the Request shall be filed no later than 21 days after the expiration of the time period, referred to in subrule (i), for filing of briefs (the deadline is January 5, 2005); and

(iii) the Party who has filed the Request and of every participant who files a brief under subrule (i) in reply to the grounds and arguments set forth in the briefs filed pursuant to sub- rule (ii) shall be filed no later than 10 days after the expiration of the time period, referred to in subrule (ii), for filing of briefs (the deadline is January 18, 2005).

Notices of Appearance pertaining to the present extraordinary challenge proceeding, ECC-2004-1904-01USA, should be filed with the United States Secretary at the NAFTA Secretariat, U.S. Section, Commerce Building, Suite 2061, 14th Street and Constitution Avenue NW, Washington, DC 20230.

Explanatory note

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty panel reviews involving imports from a NAFTA country with review by binational panels.

Chapter 19 also provides for an extraordinary challenge committee (ECC) review process where a Party alleges that a panelist was guilty of gross misconduct or serious conflict of interest, or that a panel seriously departed from a fundamental rule of procedure or that a panel manifestly exceeded its powers, authority or jurisdiction (for example, by failing to apply the appropriate standard of review) and that any of these actions materially affected the panel's decision and threatened the integrity of the panel process.

Under Article 1904 of the North American Free Trade Agreement which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the NAFTA Extraordinary Challenge Committee Rules. These Rules were published in the Canada Gazette, Part I, on January 29, 1994.
