CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice with respect to perfluorooctane sulfonate (PFOS), its salts and its precursors

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing whether to control, or the manner in which to control the substances and classes of substances listed in Schedule 1 to this notice, any person described in Schedule 2 to this notice who possesses or who may reasonably be expected to have access to the information described in Schedule 3 to this notice, to provide that information no later than April 7, 2005, 3 p.m. Eastern Standard Time.

Responses to this notice shall be submitted to the Minister of the Environment, to the attention of Mr. Yann Guilbault, Use Patterns and Controls Implementation Section, Environment Canada, 351 Saint-Joseph Boulevard, 12th Floor, Gatineau, Quebec K1A 0H3. Pursuant to section 313 of the Act, any person who provides information in response to this notice may submit, with the information, a written request that it be treated as confidential.

Pursuant to subsection 71(4) of the Act, the Minister of the Environment may, on request in writing from any person to whom this notice applies, extend the time or times within which the person shall comply with this notice.

This notice applies to any person who, during the 2004 calendar year, manufactured, imported or exported more than 100 kilograms of a substance belonging to a class of substances listed in Schedule 1, whether the substance is alone, in a mixture or in a product, and in a concentration greater than 10 grams per kilogram in a mixture or in a product.

Information Required

1. The definitions in this section apply in this notice.

"calendar year" means a period of 12 consecutive months commencing on January 1.

"export" includes movement out of Canada, including internal company transfers across the Canadian border, but does not include transit through Canada.

"import" includes movement into Canada, including internal company transfers across the Canadian border, but does not include transit through Canada.

"manufactured item" means an item that is formed into a specific physical shape or design during manufacture and has, for its final use, a function or functions dependent in whole or in part on its shape or design, including clothing, empty storage containers, furniture, tiles, electrical wire, fabric and carpeting, plywood, brake linings, fibres, leather, paper, yarns, dyed fabric, matches, flares, photographic films, and batteries.

"product" excludes manufactured item.

"precursor" means a compound that contains any of the C8F17SO2, C8F17SO3, or C8F17SO2N groups.

"transit" means the portion of an international transboundary movement through the territory of a country that is neither the country of origin nor the country of destination of the movement.

2. If the information provided in response to this notice represents more than one facility, persons to whom this notice applies shall provide the name and municipal address of each facility to which the information relates as an attachment to their submission.

The information collected in this notice will support the development of potential risk management activities for perfluorooctane sulfonate, its salts and its precursors. Environment Canada and Health Canada have published draftscreening assessment reports on perfluorooctanesulfonate,its salts and its precursors. In a notice published in the Canada Gazette,Part I, on October 2, 2004, the Ministers of the Environment and of Health proposed that perfluorooctane sulfonate, its salts and its precursors be considered "toxic" as defined in section 64 of the Canadian Environmental Protection Act, 1999. It is also proposed that consideration be given to the implementation of virtual elimination of perfluorooctanesulfonate and its salts under subsection 65(3) of the Act. This notice is published in the Canada Gazette, Part I, by virtue of paragraph 71(1)(b) of the Act. This notice requires the persons to whom it applies to provide certain information on their activities with respect to each substance belonging to a class of substances listed in Schedule 1.

Pursuant to subsection 71(3) of the Act, every person to whom this notice applies is required to comply with this notice within the time specified in the notice. The time specified in this notice isApril 7, 2005, 3 p.m. Eastern Standard Time.

Compliance with the Act is mandatory. Subsection 272(1) of the Act provides that

272. (1) Every person commits an offence who contravenes

(a) a provision of this Act or the regulations;

(b) an obligation or a prohibition arising from this Act or the regulations;

(c) an order or a direction made under this Act;

Subsection 272(2) of the Act provides that

272. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both; and

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both.

Furthermore, with respect to providing false or misleading information, subsection 273(1) of the Act provides that

273. (1) Every person commits an offence who, with respect to any matter related to this Act or the regulations,

(a) provides any person with any false or misleading information, results or samples; or

(b) files a document that contains false or misleading information.

Subsection 273(2) of the Act provides that

273. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed knowingly;

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed knowingly;

(c) on conviction on indictment, to a fine of not more than $500,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed negligently; and

(d) on summary conviction, to a fine of not more than $200,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed negligently.

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing whether the substances listed in Schedule 1 to this notice are toxic or are capable of becoming toxic, or for the purpose of assessing whether to control or the manner in which to control the listed substances, any person described in Schedule 2 to this notice who possesses or who may reasonably be expected to have access to the information required in Schedule 3 to this notice to provide that information no later than April 28, 2005, at 3 p.m. Eastern Standard Time.

1. This notice applies to any person who, during the 2004 calendar year, manufactured or imported more than 100 kilograms of a substance described in Schedule 1, whether alone, in a mixture or in a product.

1. The definitions in this section apply in this notice.

"calendar year" means a period of 12 consecutive months commencing on January 1.

"import" includes movement into Canada, including internal company transfers across the Canadian border but does not include transit through Canada.

"manufacture" includes to produce or prepare a substance; also includes the incidental production of a substance at any level of concentration as a result of the manufacturing, processing or other uses of other substances, mixtures, or products.

"transit" means the portion of an international transboundary movement through the territory of a country that is neither the country of origin nor the country of destination of the movement.

EXPLANATORY NOTE

(This note is not part of the notice.)

Perfluoroalkyl substances (PFAs) are substances of emerging concern and international interest. They have been detected in a wide variety of biota and media, including in remote and Arctic regions, far from their known sites of manufacture or import. Recent information provided to the New Substances Notification Program on certain PFAs (see Canada Gazette, July 17, 2004, Vol. 138, No. 29, pp. 1951–1952, www.ec.gc.ca/CEPARegistry/ notices) increase the importance in obtaining the information required by this notice.

The information required by this notice will be used, along with other data sources, to inform current and future risk assessment and risk management activities conducted under the Canadian Environmental Protection Act, 1999. Information submitted may be used to determine whether substances covered by this notice are toxic or capable of becoming toxic in accordance with the criteria set out in section 64 of the Act.

Information acquired from a similar 2000 notice is assumed out of date, as there are known industry changes which have occurred since 2000, due to the phase-out of certain PFAs and expected industry shift in the use of replacement PFAs. Therefore, updated information on PFAs manufacture and import is required to establish a current profile of industry activity in Canada.

This notice is published in the Canada Gazette,Part I, pursuant to paragraph 71(1)(b) of the Act. This notice requires the persons to whom it applies to provide certain information on their activities with respect to the substances identified in Schedule 1.

Pursuant to subsection 71(3) of the Act, every person to whom this notice applies is required to comply with this notice within the time specified in the notice. The time specified in this notice isApril 28, 2005, 3 p.m. Eastern Standard Time.

Compliance with section 71 and this notice is mandatory. Subsection 272(1) of the Act provides that

272. (1) Every person commits an offence who contravenes

(a) a provision of this Act or the regulations;

(b) an obligation or a prohibition arising from this Act or the regulations;

(c) an order or a direction made under this Act;

Subsection 272(2) of the Act provides that

272. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both; and

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both.

Furthermore, with respect to providing false or misleading information, subsection 273(1) provides that

273. (1) Every person commits an offence who, with respect to any matter related to this Act or the regulations,

(a) provides any person with any false or misleading information, results or samples; or

(b) files a document that contains false or misleading information.

Subsection 273(2) provides that

273. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed knowingly;

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed knowingly;

(c) on conviction on indictment, to a fine of not more than $500,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed negligently; and

(d) on summary conviction, to a fine of not more than $200,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed negligently.

The above provisions of the Canadian Environmental Protection Act, 1999 have beenreproduced for convenience of reference only. If there is any variance between the above provisions and the wording of the Act, the Act prevails.

The following is a summary of the official Calls for Bids:

1. All bids must be submitted in accordance with the General Terms and Conditions of a Call for Bids which is available by request or by downloading from our Web site.

2. Winning bidders for each of the parcels will receive an exploration licence for a term of eight years consisting of two consecutive periods of four years each.

A sample of an exploration licence is available by request or by downloading from our Web site.

3. Sealed bids must be delivered, either by registered mail or in person, at the following address: Trena Barnes, National Energy Board, Frontier Information Office, 444 Seventh Avenue SW, Calgary, Alberta T2P 0X8.

The Calls for Bids will close at noon, Mountain Time, onMay 17, 2005.

4. Selection of the successful bid will be made on the basis of a single criterion, namely, the total amount of money that the bidder proposes to spend doing exploratory work on each parcel within Period 1 of the term of the exploration licence (Work Proposal Bid).

5. Work proposal bids of less than $1,000,000.00 for each parcel will not be considered.

6. Each bid must be accompanied by a work deposit in the amount of 25 percent of the bid.

Work deposits of unsuccessful bidders will be returned, without interest, after the announcement of the bid results. Work deposits of successful bidders are refundable as allowable expenditures are incurred during Period 1 of the term.

7. Issuance fees of $250 per grid, or portion thereof, must be submitted with the bid by separate cheque made payable to the Receiver General for Canada.

8. Exploration licences are subject to the payment of Environmental Studies Research Fund (ESRF) levies in accordance with section 81 of the Canada Petroleum Resources Act. Where applicable, the ESRF manager will send notices to the interest holders.

9. The drilling of one well prior to the end of Period 1 is a condition precedent to obtaining tenure to Period 2. Where a well has been commenced and drilling is being pursued diligently, Period 1 shall continue until the well has been completed. Period 2 shall be reduced accordingly. Such a well shall be drilled to a depth sufficient to evaluate a defined geological objective.

The interest owner may, at its option, extend Period 1 for one year by posting a Drilling Deposit, in the name of the Receiver General for Canada with the Northern Oil and Gas Branch of the Department of Indian Affairs and Northern Development, before the end of the last year of Period 1. Where Period 1 is extended by the posting of a Drilling Deposit, Period 2 shall be reduced accordingly.

10. Rentals will be payable during Period 2 at a rate of $3.00 per hectare in respect of the first year, $5.50 in respect of the second year and $8.00 in respect of the third and fourth years. There are no rentals payable in Period 1. Rentals are refundable as allowable expenditures are incurred during Period 2 of the term.

11. A Schedule of Allowable Expenditures is available by request or by downloading from our Web site.

12. Operators wishing to conduct activities as a result of this Call for Bids will be required to comply with all federal environmental requirements including, for example, the federal Environmental Assessment and Review Process as well as those defined in the Sahtu Land Claim Agreement.

13. The successful bidder shall adhere to the "Northern Benefits Requirements Associated with New Exploration Programs," which is available by request or by downloading from our Web site.

14. The successful bidder shall adhere to the terms of the Sahtu Land Claim Agreement. Interested parties should become familiar with the Agreement. Interested parties are advised to obtain a copy of the appropriate land claim settlement agreement from the Frontier Information Office of the National Energy Board in Calgary.

15. For the purpose of issuing an exploration licence, the Minister will choose the highest bid in terms of the single bidding criterion (Work Proposal Bid). The Minister is not bound to select any bid submitted.

Bids will only be accepted in relation to an entire parcel.

VETERANS REVIEW AND APPEAL BOARD

Members (full-time positions)

The Veterans Review and Appeal Board is an independent, quasi-judicial agency established by Parliament in 1995. The Board deals with requests from veterans to review decisions made by Veterans Affairs Canada in disability pension matters. The Board is also the final level for pension appeals and War Veterans Allowance appeals from decisions taken by Veterans Affairs Canada. There are up to 29 permanent members, all appointed by the Governor in Council, and such number of temporary members as the workload of the Tribunal requires.

Locations:Charlottetown, Montréal, Québec, Ottawa, Toronto, Edmonton, Vancouver

The chosen candidates will have a university degree in a relevant field or a combination of equivalent education, job-related training and/or experience. The selected candidates should be experienced in the use of rules and procedures in conducting quasi-judicial hearings or presenting cases in such hearings and the underlying legal principles. An acceptable combination of relevant experience in other fields, including disability compensation and veterans' affairs, would also be considered. Preference may be given to candidates with a medical or legal background. The chosen candidates must have knowledge of the principles of natural justice and of contemporary veterans' issues. Also, they must have knowledge of the Veterans Review and Appeal Board Act,the Pension Act and other related statutes. Candidates must have excellent analytical skills and be able to render decisions in accordance with the applicable law. To work effectively as part of an adjudicative panel, the candidates will need excellent interpersonal and communication skills and must be able to write clear, accurate and concise decisions on behalf of the Board. Also needed is the ability to organize workload to ensure the rendering of quality decisions in a timely manner. Judgement and initiative are also required. Candidates must clearly demonstrate on their application how they meet the education and experience criteria in order to be considered further in the process.

These positions may require extensive travel throughout Canada, sometimes for periods of three weeks or more at a time.

The successful full-time candidates must be prepared to relocate to the area of employment or to a location within reasonable commuting distance.

Proficiency in both official languages is an asset.
