SPECIAL IMPORT MEASURES ACT
Certain laminate flooring — Decision
On February 16, 2005, the President, Canada Border Services Agency (CBSA), made a preliminary determination of dumping, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), respecting laminate flooring in thickness ranging from 5.5 mm to 13 mm (other than laminate hardwood flooring where the hardwood component exceeds 2 mm in thickness) originating in or exported from Austria, Belgium, the People's Republic of China, France, the Federal Republic of Germany and the Republic of Poland and a preliminary determination of subsidy of laminate flooring in thickness ranging from 5.5 mm to 13 mm (other than laminate hardwood flooring where the hardwood component exceeds 2 mm in thickness) originating in or exported from the People's Republic of China.
On the same date, pursuant to paragraph 35(2)(a) of SIMA, the President terminated the dumping investigation of such product originating in or exported from Luxembourg.
The goods in question are properly classified under the Harmonized System classification number 4411.19.90.90.
The Canadian International Trade Tribunal (the Tribunal) will conduct a full inquiry into the question of injury to the domestic industry and will make an order or finding not later than 120 days after its receipt of the notice of the preliminary determination of dumping and subsidizing.
Pursuant to section 8 of SIMA, provisional duty is payable on the dumped and subsidized subject goods that are released from customs during the period commencing February 16, 2005, and ending on the earlier of the day the investigation is terminated, the day on which the Tribunal makes an order or finding, or the day an undertaking is accepted. The amount of provisional duty payable is not greater than the estimated margin of dumping and the estimated amount of subsidy. The Customs Act applies with respect to the accounting and payment of provisional duty. As such, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

DECISION TO COMMENCE A GLOBAL SAFEGUARD INQUIRY — REVISED NOTICE
Bicycles and finished painted bicycle frames
Following a complaint filed by the Canadian Bicycle Manufacturers Association (CBMA), the Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it is commencing, pursuant to subsection 26(1) of the Canadian International Trade Tribunal Act (CITT Act), a global safeguard inquiry (Safeguard Inquiry No. GS-2004-001) into the importation into Canada, from all sources, of bicycles, assembled or unassembled, with a wheel diameter greater than 15 inches or 38.1 centimetres, and finished painted bicycle frames, assembled or unassembled.
The purpose of the inquiry is to determine whether the goods subject to the inquiry are being imported into Canada from all sources in such increased quantities and under such conditions as to be a principal cause of serious injury, or threat thereof, to domestic producers of like or directly competitive goods.
The Tribunal will issue questionnaires to domestic producers, importers and foreign producers of bicycles and frames, requesting relevant statistical and other information for the years 2000 to 2004. The Tribunal will also issue market characteristics questionnaires to certain purchasers of bicycles and bicycle frames. Copies of these questionnaires will be available on the Tribunal's Web site by March 8, 2005, at www.citt-tcce.gc.ca/question/index_e.asp. Responses to the questionnaires will be required no later than April 5, 2005.
The Tribunal will issue a report on the inquiry no later than August 9, 2005.
Should the Tribunal make a final determination of serious injury or threat thereof, it will submit a copy of its final report to the Government of Canada, which may decide on appropriate safeguard measures.
The Tribunal's proceedings will be in accordance with the Canadian International Trade Tribunal Rules.
Participation
Each person or government wishing to participate in the Tribunal's inquiry as a party must file a notice of participation with the Secretary on or before March 11, 2005. Each counsel who intends to represent a party must file a notice of representation and, in order to have access to confidential information, a declaration and confidentiality undertaking with the Secretary on or before March 11, 2005. Forms for filing notices of participation, notices of representation, and declarations and undertakings can be found on the Tribunal's Web site at www.citt-tcce.gc.ca/forms/index_e.asp.
To allow the Tribunal to determine whether simultaneous interpretation will be required for the hearing, each party filing a notice of participation and each counsel filing a notice of representation must advise the Secretary, at the same time that they file their notices, whether they and their witnesses will be using French or English or both languages at the hearing. Requirements for interpretation in any other language should also be communicated to the Tribunal at that time.
Case briefs
Parties supporting a finding of injury shall file case briefs by May 19, 2005. Parties opposing a finding of injury shall file case briefs by May 27, 2005. Parties supporting a finding of injury shall file reply case briefs by June 3, 2005. All submissions to the Tribunal must be filed in paper and electronic formats.
Case briefs are to include three separate parts, each with a table of contents: (A) Written Submissions; (B) Witness Statements; and (C) Supporting Evidence. Written submissions shall be printed or typewritten on white paper measuring 21.5 cm by 28 cm (8 1/2 in. by 11 in.), in a type not smaller than 11 points, with top and bottom margins of not less than 2.5 cm (1 in.) and left and right margins of not less than 3.5 cm (1.5 in.), and with no more than 30 lines per page, exclusive of headings.

Written submissions shall include consideration of

Parties that intend to present witnesses shall file, for each witness, a witness statement that conveys the essential elements of the witness's testimony.
(C) Supporting Evidence
Evidence supporting a party's written submissions and/or witness statements relating to injury may include, for example, internal and public information, such as statistical data, market analyses, and industry-related publications and reports. In its written submissions, a party shall make clear reference to relevant excerpts of the documents that are included as part of its supporting evidence.
Hearing
A public hearing will be held starting on June 13, 2005, in the Tribunal's hearing room, 18th Floor, Standard Life Centre, 333 Laurier Avenue W, Ottawa, Ontario.
In advance of the hearing, the Tribunal will provide detailed information to parties on the procedures that it will apply.
Confidentiality
Under section 46 of the CITT Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time that the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.

This notice has been sent to interested governments and departments, and to producers, importers, exporters and certain purchasers of bicycles and bicycle frames with a known interest in the inquiry. The notice will also be published in the March 5, 2005 edition ofthe Canada Gazette, Part I.

Subsections 27(1) and (2) of the CITT Act
27. (1) The Tribunal shall, in an inquiry into a complaint, determine whether, having regard to any regulations made pursuant to paragraph 40(a),
(a) in the case of a complaint filed under subsection 23(1), the goods that are the subject of the complaint are being imported in such increased quantities and under such conditions as to be a principal cause of serious injury, or threat thereof, to domestic producers of like or directly competitive goods;
. . .
(2) For the purposes of subsection (1), "principal cause" means, in respect of a serious injury or threat thereof, an important cause that is no less important than any other cause of the serious injury or threat thereof.
Section 5 of the Canadian International Trade Tribunal Regulations
5. (1) For the purposes of determining, during an inquiry into a matter referred to the Tribunal pursuant to paragraph 20(a) of the Act or an inquiry into a complaint referred to in paragraph 27(1)(a), (a.1), (a.2), (a.4), (a.5) or (b) of the Act, whether the goods that are the subject of the reference or complaint are being imported as set out in that paragraph, the Tribunal shall examine, among other factors,
(a) the actual volume of the goods imported into Canada;
(b) the effect of the imported goods on prices of like or directly competitive goods in Canada; and
(c) the impact of the imported goods on domestic producers of like or directly competitive goods in Canada.
(2) The Tribunal shall consider, with respect to the factor mentioned in paragraph (1)(a), whether there has been a significant increase in the importation into Canada of the goods and, where there has been, the rate and amount of such increase, either absolutely or relative to the production in Canada of like or directly competitive goods.
(3) The Tribunal shall consider, with respect to the factor mentioned in paragraph (1)(b),
(a) whether the prices of the imported goods have significantly undercut the prices of like or directly competitive goods produced and sold in Canada; and
(b) whether the effect of the importation into Canada of the goods has been
(i) to depress significantly the prices of like or directly competitive goods produced and sold in Canada, or(ii) to limit to a significant degree increases in the prices of like or directly competitive goods produced and sold in Canada.
(4) The Tribunal shall evaluate, with respect to the factor mentioned in paragraph (1)(c), all relevant economic factors that have a bearing on domestic producers of like or directly competitive goods, including the actual and potential changes in the level of production, employment, sales, market share, profits and losses, productivity, return on investments, utilization of production capacity, cash flow, inventories, wages, growth or ability to raise capital or investments.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2004-052) from Everest VIT, Inc., of Flanders, New Jersey, concerning a procurement (Solicitation No. W3474-05W500/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for the provision of video scopes. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.
It is alleged that PWGSC narrowly stated the technical specifications thereby favouring one manufacturer's videoscope, to the exclusion of all other manufacturers' equipment.

PUBLIC NOTICE 2005-18
Commission requirements for the pass-through of video description — Call for comments on the obligations of smaller broadcasting distribution undertakings
Broadcasters are stepping up their efforts to make programming accessible to persons who are blind or who have a visual impairment by increasing the amount of their programming that is accompanied by video description. The Commission's current regulatory requirements are that all broadcasting distribution undertakings (BDUs) must pass through to subscribers all video description contained in the programming signals they receive from broadcasters. In the case of smaller BDUs, however, the Commission is aware that there are certain technical, operational and cost concerns associated with making the upgrades necessary to enable them to pass such programming signals through to subscribers.
Accordingly, the Commission calls for comments on the requirements for the pass-through of programming containing video description that should apply to Class 2 and Class 3 BDUs, whether licensed or exempt, and to multipoint distribution systems (MDS) undertakings. The Commission will accept comments that it receives on or before April 19, 2005.

Application for an order
Notice is hereby given that on February 11, 2005, an application pursuant to section 106(2) of the Competition Act, R.S.C. 1985, c. C-34, was filed with the undersigned at the Competition Tribunal by Burns Lake Native Development Corporation et al., relating to the rescission of the consent agreement.

3. Disclose the Exposure Limit Values ACGIH TLV-TWA = 200 ppm and ACGIH TLV-STEL = 400 ppm for isopropanol;
4. Disclose that an ingredient in the controlled product is incompatible with aluminum powder, potassium tert-butoxide, and 2-butanone;
5. Disclose an LC50 (4 hours, rat) value of 16 970 ppm for isopropanol;
6. Disclose that acute ingestion of an ingredient of the controlled product has been shown to cause gastrointestinal tract disturbances;
7. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause testicular and kidney effects in laboratory animals;

2. In relation to the first aid information shown on the MSDS for ingestion, delete the statements to give water to drink and to induce vomiting and add advice to the effect that the casualty should lean forward should vomiting occur in order to reduce the risk of aspiration;
3. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be washed with soap and water for at least 20–30 minutes;
4. In relation to the first aid information shown on the MSDS for eye contact, disclose that immediate medical attention should be sought in all cases, and that flushing should continue for at least 20–30 minutes;
5. Correct the impression that the controlled product is irritating as opposed to being a corrosive material;
6. Disclose that an ingredient in the controlled product has been shown to cause skin corrosion in laboratory animals;
7. Disclose that inhalation of an ingredient in the controlled product has been shown to cause fetotoxic effects in laboratory animals;
8. Disclose a calculated LD50 (oral, rat) value of 2 900 mg/kg for the controlled product;
9. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class E.
Registry Number 5930
The claimant has been ordered to amend certain aspects of the format of the MSDS.
In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.
1. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be flushed with water for at least 15 minutes or until the chemical is removed;
2. In relation to the first aid information shown on the MSDS for ingestion, remove the statement to give two glasses of water to drink and add a statement that medical attention should be obtained;
3. Disclose that chronic inhalation exposure to an ingredient in the controlled product has been shown to cause neurotoxic effects in laboratory animals.
Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the Screening Officer has, for each of the above-noted claims, with the exceptions of those claims bearing Registry Numbers 4984, 5075, 5116, 5151 and 5152, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the Screening Officer within 40 days of expiry of the appeal period.
Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the Screening Officer, should have been shown on the relevant MSDS.
Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.
Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal a decision or order of a Screening Officer. Notice is hereby given, pursuant to subrule 78(a) of the NAFTA Article 1904 Panel Rules, that the binational panel review of the findings made by the Canadian International Trade Tribunal, respecting Wood Venetian Blinds and Slats originating in or exported from Mexico, is completed. Pursuant to subrule 78(a) of the NAFTA Article 1904 Panel Rules, this Notice of Completion of Panel Review is effective on February 23, 2005, the day the consent motion to terminate the binational panel review of this matter was filed (Secretariat File No. CDA-MEX-2004-1904-01).
Explanatory note
Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in anti-dumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.
These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the anti-dumping or countervailing duty law of the country that made the determination.
Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.

Notice is hereby given that the Request for Panel Review of the Notice of Implementation Under Section 129 of the Uruguay Round Agreements Act; Countervailing Measures made by the United States Department of Commerce, International Trade Administration, concerning Certain Softwood Lumber Products from Canada, has been withdrawn by the requesters as of February 17, 2005 (Secretariat File No. USA-CDA-2005-1904-02). No complaints were filed pursuant to rule 39, no notices of appearance were filed pursuant to rule 40 and no panel has been appointed.
