The following notice of proposed revocation was sent to the charity listed below revoking it for failure to meet the parts of the Income Tax Act as listed in this notice:

"Notice is hereby given, pursuant to paragraphs 168(1)(b), 168(1)(d) and 168(1)(e) of the Income Tax Act, that I propose to revoke the registration of the charity listed below and that by virtue of paragraph 168(2)(b) thereof, the revocation of the registration is effective on the date of publication of this notice in the Canada Gazette."

Refined sugar

In the matter of an expiry review, under subsection 76.03(3) of the Special Import Measures Act, of the orders made by the Canadian International Trade Tribunal on November 3, 2000, in Review No. RR-99-006, continuing, with amendment, its findings made on November 6, 1995, in Inquiry No. NQ-95-002, concerning the dumping of refined sugar originating in or exported from the United States of America, Denmark, the Federal Republic of Germany, the Netherlands and the United Kingdom, and the subsidizing of refined sugar originating in or exported from the European Union

The Canadian International Trade Tribunal, under the provisions of subsection 76.03(3) of the Special Import Measures Act, has conducted an expiry review (Expiry Review No. RR-2004-007) of its orders made on November 3, 2000, in Review No. RR-99-006, continuing, with amendment, its findings made on November 6, 1995, in Inquiry No. NQ-95-002, concerning the dumping of refined sugar originating in or exported from the United States of America, Denmark, the Federal Republic of Germany, the Netherlands and the United Kingdom, and the subsidizing of refined sugar originating in or exported from the European Union.

Pursuant to paragraph 76.03(12)(b) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby continues its order in respect of the dumping of refined sugar originating in or exported from Denmark, the Federal Republic of Germany, the Netherlands and the United Kingdom, and the subsidizing of refined sugar originating in or exported from the European Union, with an amendment to exclude individually wrapped rectangular cane sugar tablets.

Pursuant to subsection 76.04(1) of the Special Import Measures Act, the Canadian International Trade Tribunal also hereby continues its order in respect of the dumping of refined sugar originating in or exported from the United States of America, with an amendment to exclude individually wrapped rectangular cane sugar tablets.

The Notice of Filing published in the Canada Gazette, Part I, on November 1, 2003, listed the subject of the claims bearing Registry Numbers 5739 to 5744, inclusively, and 5746 to 5754, inclusively, to be the chemical identity and concentration of three ingredients. The subject of the claims on which the Screening Officer issued the decisions is the chemical identity and concentration of two ingredients.

15. The Notice of Filing published in the Canada Gazette, Part I, on November 1, 2003, described the claim bearing Registry Number 5773 as seeking exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

It has since been established that the claim was seeking exemption from the disclosure of employer confidential information in respect of a controlled product which would otherwise be required to be disclosed by the provisions of the applicable provincial legislation relating to occupational health and safety. The Screening Officer issued the decision on that basis.

16. The Notice of Filing published in the Canada Gazette, Part I, on November 1, 2003, listed the subject of the claim bearing Registry Number 5782 to be the chemical identity of two ingredients. The subject of the claim on which the Screening Officer issued the decision is the chemical identity of one ingredient.

There were no submissions from affected parties to the Screening Officer with respect to any of the above claims for exemption and related MSDSs.

Each of the claims for exemption listed above was found to be valid with the exception of the claims bearing Registry Numbers 5205 and 5206 which were found to be invalid. The Screening Officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the claims bearing Registry Numbers 5763 and 5837 complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

In the case of the claims bearing Registry Numbers 5528, 5566, 5757, 5758, 5759, 5778, 5782 and 5783, being claims from an employer in the province of Alberta, the Screening Officer found that the MSDSs and, in the case of the claim bearing Registry Number 5528, the label relating to these claims did not comply with the applicable disclosure requirements of the Occupational Health and Safety Code of the Province of Alberta.

In the case of the claims bearing Registry Numbers 4994 and 5773, being claims from an employer in the province of Ontario, the Screening Officer found that the MSDSs relating to these claims did not comply with the applicable disclosure requirements of the Occupational Health and Safety Act of the Province of Ontario.

Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the remaining claims did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Registry Number 4994

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. Disclose the percent concentrations of certain ingredients in an acceptable manner;

2. Disclose that acute inhalation of an ingredient in the controlled product has been shown to cause adverse lung effects in laboratory animals;

3. In relation to the first aid information for skin and eye contact already disclosed on the MSDS, add a statement to the effect that medical attention be obtained immediately.

Registry Numbers 5205 and 5206

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose the chemical identity and CAS Registry Number of the confidential hazardous ingredient identified with the GCI halo cyclic amide;

2. Disclose the percent concentration of each hazardous ingredient in an acceptable manner;

3. In relation to the first aid information shown on the MSDS for eye contact, disclose a statement to the effect that the eyes should be flushed continuously with lukewarm, gently flowing water for at least 30 minutes;

4. In relation to the first aid information shown on the MSDS for ingestion, add a statement such as the following: Never give anything by mouth if the casualty is rapidly losing consciousness, or is unconscious or convulsing. Also disclose a statement to the effect that trained personnel should immediately administer artificial respiration or cardiopulmonary resuscitation if breathing has stopped or the heart has stopped;

5. Disclose oxides of carbon and nitrogen as hazardous combustion products;

6. Disclose procedures to be used in dealing with a leak or a spill;

7. Disclose that grounded equipment be used when handling large quantities of the controlled product;

8. Disclose that an ingredient in the controlled product has been shown to be corrosive to the eyes of laboratory animals;

9. Registry Number 5205:

(a)Disclose an LC50 (4 hours, female rat) value of 40.7 mg/L for ethyl acetate;

(b)Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause adverse effects on the testes and accessory reproductive organs as well as causing behavioural effects in laboratory animals;

(c)Disclose that an ingredient in the controlled product has shown positive results in a screening test for mutagenicity;

(d)If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D1B;

10. Registry Number 5206:

(a)In relation to the first aid information shown on the MSDS for inhalation, disclose a statement to the effect that trained personnel should immediately administer cardiopulmonary resuscitation if the heart has stopped;

(b)Disclose that an ingredient in the controlled product has been shown to cause fetotoxic effects and developmental effects in laboratory animals.

Registry Numbers 5321 to 5323, inclusive

The claimant has been ordered to amend certain aspects of the content and wording of the MSDS.

8. Disclose that ingredients in the controlled product have been shown to cause fetotoxic effects in laboratory animals in the absence of maternal toxic effects.

Registry Number 5409

2. Remove the concentration range shown for the confidential hazardous ingredient long chain alkenyl amide and disclose its actual concentration or an acceptable range value;

3. Add eye contact as a route of entry;

4. Disclose that an ingredient in the controlled product has shown positive results in an in vitro screening test for mutagenicity;

5. Disclose oral LD50 values for three of the confidential hazardous ingredients in an acceptable manner.

Acknowledgement: Subsequent to the review of the MSDS-of-Record respecting this particular claim, the claimant provided the Commission with a copy of a revised version. This revised version of the MSDS was not, however, reviewed by the Screening Officer.

Registry Numbers 5447 and 5448

5. Disclose that inhalation of an ingredient in the controlled product has been shown to cause teratogenic effects in laboratory animals at maternally toxic dose levels;

7. Disclose an LD50 (oral, rat) value of 2 049 mg/kg and an LC50 (rat, 6 hours) value of >227 ppm for 2-ethylhexanol.

8. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause testicular effects in laboratory animals;

9. Disclose that inhalation of an ingredient in the controlled product has been shown to cause fetotoxicity and developmental toxicity in laboratory animals.

Having regard to the foregoing, and pursuant to sections 16 and 17 of the Hazardous Materials Information Review Act, notice is hereby given that the Screening Officer has, for each of the claims bearing Registry Numbers 5205 and 5206, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, including disclosing the identity of the ingredient which was the information in respect of which the claim for exemption was made, and to provide a copy of the amended MSDS to the Screening Officer within 40 days of expiry of the appeal period.

Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the Screening Officer has, for each of the remaining above-noted claims, with the exception of those claims bearing Registry Numbers 4994, 5528, 5566, 5757, 5758, 5759, 5763, 5773, 5778, 5782, 5783 and 5837, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the Screening Officer within 40 days of expiry of the appeal period.

In the case of the claims bearing Registry Numbers 4994 and 5773, the Screening Officer has ordered the claimant to comply with the provisions of the Occupational Health and Safety Act of the Province of Ontario, except that the information in respect of which the claims for exemption were made does not have to be disclosed, and to provide copies of the amended MSDS to the Screening Officer, within the respective time period specified in the foregoing paragraph.

In the case of the claims bearing Registry Numbers 5528, 5566, 5757, 5758, 5759, 5778, 5782 and 5783, the Screening Officer has ordered the claimant to comply with the provisions of the Occupational Health and Safety Code of the Province of Alberta, except that the information in respect of which the claims for exemption were made does not have to be disclosed, and to provide copies of the amended MSDS and, in the case of the claim bearing Registry Number 5528, the amended label, to the Screening Officer, within the respective time period specified in the foregoing paragraph.

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the Screening Officer, should have been shown on the relevant MSDS or label.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal a decision or order of a Screening Officer. The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party," for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a work place, and includes

(a) a supplier of the controlled product;

(b) an employee at the work place;

(c) an employer at the work place;

(d) a safety and health professional for the work place;

(e) a safety and health representative or a member of a safety and health committee for the work place; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or

(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3.
