Notice is hereby given that the Canadian International Trade Tribunal made a decision on January 26, 2006, with respect to an appeal filed by Roche Vitamins Canada Inc. from a decision of the Commissioner of the Canada Customs and Revenue Agency with respect to a request for re-determination under subsection 60(4) of the Customs Act.

The appeal, heard on February 14 and 15, 2005, under subsection 67(1) of the Customs Act, was allowed in part.

DETERMINATION

Garlic

On August 26, 2005, the Canadian International Trade Tribunal (the Tribunal) issued a notice of expiry review to all parties advising them that it would initiate an expiry review (Expiry Review No. RR-2005-001), under section 76.03 of the Special Import Measures Act (SIMA), respecting

  • its finding made on May 2, 2001, in Inquiry No. NQ-2000-006, concerning garlic, fresh or frozen, originating in or exported from the People's Republic of China (China) and Vietnam, excluding fresh garlic subject to the finding made in Inquiry No. NQ-96-002; and
  • its order made on March 20, 2002, in Expiry Review No. RR-2001-001, continuing without amendment, its finding made on March 21, 1997, in Inquiry No. NQ-96-002, concerning fresh garlic originating in or exported from China, imported into Canada from July 1 to December 31, inclusive, of each calendar year.

On December 22, 2005, the President of the Canada Border Services Agency (CBSA) determined that, pursuant to subsection 76.03(7) of SIMA, the expiry of the finding and order was likely to result in the continuation or resumption of dumping of the subject goods.

The Tribunal's notice of expiry review gave interested parties until January 3, 2006, to file notices of participation in the expiry review. The notice also gave domestic growers until January 6, 2006, to reply to Part E of the domestic growers' expiry review questionnaire. As of January 25, 2006, the Tribunal has received no responses to the questionnaire and no notices of participation. In addition, the CBSA received no questionnaire responses from domestic growers, importers or foreign producers.

In view of the fact that there are no parties participating in the process and that no information has been filed on the factors to be considered by the Tribunal in an expiry review, it is not possible for the Tribunal to make a determination that a continuation or resumption of dumping will likely cause material injury to the domestic industry. Therefore, the Tribunal hereby determines, pursuant to subsection 76.03(10) of SIMA, that the expiry of the finding and order is unlikely to result in injury. The public hearing scheduled for March 13, 2006, is cancelled.

The Tribunal will issue orders, with reasons, rescinding the finding and order when they expire on May 1, 2006, and March 19, 2007, respectively.

In the decision, the Commission addresses complaints respecting comments made on the program Imus in the Morning, aired on the now defunct MSNBC Canada Category 2 specialty television service. The Commission finds that, by airing comments made during the November 12, 2004 and November 19, 2004 episodes of the program, the licensee breached the provision of the Specialty Services Regulations, 1990 that prohibits the broadcast of abusive comment. The Commission will send a copy of this decision to the Chief Executive Officers of Rogers Broadcasting Limited, Shaw Communications Inc. and MSNBC Cable, LLC, and a copy will be placed on the public file of MSNBC Canada.

Call for comments on the proposed addition of ETV Bangla to the lists of eligible satellite services for distribution on a digital basis

Comments on the Canadian Cable Telecommunications Association's (CCTA) request must be received by the Commission no later than February 22, 2006. A copy of the comments must be received by the CCTA no later than the deadline for receipt of comments by the Commission.

The CCTA may file a written reply to any comments received concerning its request. This reply should be filed with the Commission and a copy sent to the person who submitted the comments by no later than March 9, 2006.

In the public notice, the Commission reviews the comments received in response to Viewing and expenditure incentives for English-language Canadian television drama — Call for comments, Broadcasting Public Notice CRTC 2005-81, August 10, 2005 (Public Notice 2005-81), and sets out the targets for the viewing and expenditure components of the Commission's drama incentive program.

The subject of the claim on which the Screening Officer issued the decision is the chemical identity of four ingredients.

The subject of the claim on which the Screening Officer issued the decision is the chemical identity of one ingredient.

5. The Notice of Filing published in the Canada Gazette, Part I, on July 26, 2003, listed the subject of the claim bearing Registry Number 5574 to be the chemical identity of two ingredients. The subject of the claim on which the Screening Officer issued the decision is the chemical identity of four ingredients.

6. The Notice of Filing published in the Canada Gazette, Part I, on July 26, 2003, described the claim bearing Registry Number 5628 as seeking exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

It has since been established that the claim was seeking exemption from the disclosure of employer confidential information in respect of a controlled product which would otherwise be required to be disclosed by the provisions of the applicable provincial legislation relating to occupational health and safety. The Screening Officer issued the decision on that basis.

7. The Notice of Filing published in the Canada Gazette, Part I, on July 26, 2003, listed the subject of the claims bearing Registry Numbers 5629 and 5630 to be the chemical identity and concentration of one ingredient. The subject of the claims on which the Screening Officer issued the decisions is the chemical identity and concentration of two ingredients.

8. The Notice of Filing published in the Canada Gazette, Part I, on July 17, 2004, listed the subject of the claims bearing Registry Numbers 5910 and 5950 to be the chemical identity of one ingredient. The subject of the claims on which the Screening Officer issued the decisions is the chemical identity of two ingredients.

9. The Notice of Filing published in the Canada Gazette, Part I, on July 17, 2004, listed the subject of the claims bearing Registry Numbers 5929 and 5932 to be the chemical identity and concentration of one ingredient. The subject of the claims on which the Screening Officer issued the decisions is the chemical identity of one ingredient.

10. The Notice of Filing published in the Canada Gazette, Part I, on July 17, 2004, listed the subject of the claim bearing Registry Number 5974 to be the chemical identity of two ingredients. The subject of the claim on which the Screening Officer issued the decision is the chemical identity of four ingredients.

There were no submissions from affected parties to the Screening Officer with respect to any of the above claims for exemption and related MSDSs.

Each of the claims for exemption listed above was found to be valid with the exception of the claims bearing Registry Numbers 5205 and 5206 which were found to be invalid. The Screening Officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the claims bearing Registry Numbers 5876 and 5976 complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

In the case of the claim bearing Registry Number 5487, being a claim from an employer in the province of Alberta, the Screening Officer found that the MSDS relating to this claim did not comply with the applicable disclosure requirements of the Occupational Health and Safety Code of the Province of Alberta.

In the case of the claims bearing Registry Numbers 5628, 5834 and 5835, being claims from an employer in the province of Ontario, the Screening Officer found that the respective MSDS relating to these claims did not comply with the applicable disclosure requirements of the Occupational Health and Safety Act of the Province of Ontario.

Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the remaining claims did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Registry Numbers 5389 to 5392, inclusive

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose storage precautions for the controlled product;

2. Disclose correct information concerning the odour threshold of the chemical;

3. Disclose an LD50 value for one of the confidential hazardous ingredients in an acceptable manner;

4. Registry Number 5391:

(a) In relation to the first aid information shown on the MSDS for inhalation, disclose a statement to the effect that trained personnel should immediately administer cardiopulmonary resuscitation if the heart has stopped;

(b) Disclose an LC50 value for one of the confidential hazardous ingredients in an acceptable manner;

(c) Disclose that acute inhalation exposure to an ingredient in the controlled product have been shown to cause adverse CNS effects in laboratory animals;

(d) If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D1A;

5. Registry Number 5392:

(a) Disclose that exposure to epoxy resins similar to those in the controlled product has caused respiratory sensitization in workers;

(b) Disclose that an ingredient in the controlled product has shown positive results in screening tests for mutagenicity;

6. Registry Numbers 5390 and 5391: Disclose an LD50 (oral, rat) value of 2 570 mg/kg for diglycidyl resorcinol ether;

Registry Number 5457

The claimant has been ordered to amend certain aspects of the format and content of the MSDS.

1. Disclose an LD50 value for the sodium polycarboxylate in an acceptable manner;

Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the Screening Officer has, for each of the above-noted claims, with the exceptions of those claims bearing Registry Numbers 5487, 5628, 5834, 5835, 5876 and 5976, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the Screening Officer within 40 days of expiry of the appeal period.

In the case of the claims bearing Registry Numbers 5628, 5834 and 5835, the Screening Officer has ordered the claimant to comply with the provisions of the Occupational Health and Safety Act of the Province of Ontario, except that the information in respect of which the claims for exemption were made does not have to be disclosed, and to provide copies of the amended MSDSs to the Screening Officer, within the respective time period specified in the foregoing paragraph.

In the case of the claim bearing Registry Number 5487, the Screening Officer has ordered the claimant to comply with the provisions of the Occupational Health and Safety Code of the Province of Alberta, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the Screening Officer within the respective time period specified in the foregoing paragraph.

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the Screening Officer, should have been shown on the relevant MSDS or label.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal a decision or order of a Screening Officer. Filing of a claim for exemption

The Notice of Filing published in the Canada Gazette, Part I, Vol. 138, No. 29, dated Saturday, July 17, 2004, identified the claims bearing Registry Numbers 6016, 6017 and 6018 as having been filed by Degussa Canada Inc. of Brampton, Ontario.

COMPLETION OF PANEL REVIEW

Hard red spring wheat from Canada

Notice is hereby given, pursuant to subrule 78(b) of the NAFTA Article 1904 Panel Rules, that the binational panel review of the Final Determination of material injury to a domestic industry made by the United States International Trade Commission, concerning Hard Red Spring Wheat from Canada, is completed (Secretariat File No. USA-CDA-2003-1904-06).

On December 12, 2005, the binational panel affirmed the investigating authority's determination on remand, respecting Hard Red Spring Wheat from Canada.

No Request for an Extraordinary Challenge Committee has been filed with the responsible Secretary. Therefore, pursuant to subrule 78(b) of the NAFTA Article 1904 Panel Rules, this Notice of Completion of Panel Review is effective on January 24, 2006, the 31st day following the date on which the responsible Secretary issued the Notice of Final Panel Action.

Explanatory note

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.

Under Article 1904 of the North American Free Trade Agreement which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.
