Unprocessed grain corn from the United States of America — Decision

On March 15, 2006, pursuant to paragraph 41(1)(a) of the Special Import Measures Act, the President of the Canada Border Services Agency (CBSA) made a final determination of dumping and subsidizing in respect of unprocessed grain corn, excluding seed corn (for reproductive purposes), sweet corn and popping corn, originating in or exported from the United States of America.

For further clarity, unprocessed grain corn includes whole kernel grain corn and grain corn that has been milled to a limited degree such that the milled grain corn preserves all the constituent parts of whole kernel corn.

The goods in question are properly classified under the following Harmonized System classification numbers:

1005.90.00.11 US No. 1 yellow dent corn
1005.90.00.12 US No. 2 yellow dent corn
1005.90.00.13 US No. 3 yellow dent corn
1005.90.00.14 US No. 4 yellow dent corn
1005.90.00.19 Other
1005.90.00.99 Other (including white dent corn)
1104.23.00.00 Corn which is sliced (corn which is hulled or kibbled is not subject, but also falls within this tariff number)

The Canadian International Trade Tribunal (the Tribunal) is continuing its inquiry into the question of injury to the Canadian industry and will make an order or finding by April 18, 2006. Provisional duty will continue to apply until this date.

If the Tribunal finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, future imports of subject goods will be subject to anti-dumping duty equal to the margin of dumping and/or countervailing duty equal to the amount of subsidy on the goods. In that event, the importer in Canada shall pay all such duty. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duty.

Licensing of new radio stations to serve Charlottetown, Prince Edward Island — Introduction to Broadcasting Decisions CRTC 2006-88 to 2006-91

At a public hearing commencing October 3, 2005, in Charlottetown, the Commission considered four applications for commercial radio stations to serve Charlottetown. Two of the applications proposed to convert existing radio stations from the AM band to the FM band and two proposed to establish new FM radio stations.

The notice describes the various applications and sets out the Commission's determinations with respect to the ability of the Charlottetown market to absorb additional radio stations. This notice also summarizes the Commission's decision to approve two applications to convert existing radio stations from the AM band to the FM band, as well as to approve in part an application to establish a new FM radio station to serve Charlottetown.

The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party," for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a work place, and includes

(a) a supplier of the controlled product;

(b) an employee at the work place;

(c) an employer at the work place;

(d) a safety and health professional for the work place;

(e) a safety and health representative or a member of a safety and health committee for the work place; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or

(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3.

Notice is hereby given, pursuant to subrule 78(a) of the NAFTA Article 1904 Panel Rules, that the binational panel review of the Final Affirmative Countervailing Duty Determinations made by the United States Department of Commerce, International Trade Administration, concerning Certain Durum Wheat and Hard Red Spring Wheat from Canada, is completed. This Notice of Completion of Panel Review is effective on March 6, 2006, the day the consent motion to terminate the binational panel review of this matter was filed (Secretariat File No. USA-CDA-2003-1904-05).

Explanatory note

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty panel reviews involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.

Notice is hereby given, pursuant to rule 70 of the NAFTA Article 1904 Panel Rules, that the panel established to review the Final Affirmative Countervailing Duty Determination made by the United States Department of Commerce, International Trade Administration, respecting Certain Softwood Lumber Products from Canada, issued its decision on the fifth determination on remand on March 17, 2006 (Secretariat File No. USA-CDA-2002-1904-03).

In the March 17, 2006 decision, the binational panel affirmed the agency's fifth determination on remand respecting Certain Softwood Lumber Products from Canada.

NATIONAL ENERGY BOARD

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Yudinn Energy Inc. on behalf of Yudinn Energy Limited Partnership

By an application dated March 30, 2006, Yudinn Energy Inc. on behalf of Yudinn Energy Limited Partnership (the "Applicant") has applied to the National Energy Board (the "Board"), under Division II of Part VI of the National Energy Board Act (the "Act"), for authorization to export up to 204 MW and 1 787 GWh of firm power and energy or up to 1 787 GWh of interruptible energy in any consecutive twelve-month period to prospective customers in the United States from its Chisasibi/ Laforge-Brisay wind farm. The requested permit term is for a period of twenty-five years commencing on the date of approval by the Board, with individual contracts not to exceed five years in duration.

The Board wishes to obtain the views of interested parties on the application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The directions on procedures that follow explain in detail the procedure that will be used.

1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at the office of the Cree Nation of Chisasibi, Quebec, (819) 855-2878, and at the offices of its counsel at Scotia Plaza, Suite 2100, 40 King Street W, Toronto, Ontario M5H 3C2, and provide a copy of the application to any person who requests one. (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported;

(b) the impact of the exportation on the environment; and

(c) whether the Applicant has

(i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and

(ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.

4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by Monday, May 15, 2006.
