Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2006-004) on July 11, 2006, with respect to a complaint filed by Mircom Technologies Ltd. (Mircom) of Vaughan, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. W8482-054541/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for repair and overhaul services in support of the Damage Control System (DCS) of the Halifax-class frigates, the Fire Detection, Suppression, Alarm and Control System of the Iroquois-class destroyers and two shore-based DCS trainers.
It was alleged that PWGSC had improperly declared Mircom's proposal non-compliant.
Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was not valid.

The complainant alleged that the interview contained a misleading and undocumented statement that might create an anti-Palestinian sentiment in the Canadian public. The Commission finds that the CBC's broadcast of the interview in question, as a segment of the afternoon radio program "Radio Active," did not breach the prohibitions against the broadcast of abusive comment and false and misleading news contained in the Radio Regulations, 1986.

The Notice of Filing published in the Canada Gazette, Part I, on July 17, 2004, listed the subject of the claim bearing Registry Number 5957 to be the chemical identity and concentration of three ingredients. The subject of the claim on which the screening officer issued the decision is the chemical identity and concentration of four ingredients.
11. The Notice of Filing published in the Canada Gazette, Part I, on May 21, 2005, listed the subject of the claim bearing Registry Number 6028 to be the "chemical identity, chemical name of a controlled product [and] information that could be used to identify a supplier of a controlled product of two ingredients." The subject of the claim on which the screening officer issued the decision is the chemical identity of one ingredient, the chemical name of a controlled product and information that could be used to identify a supplier of a controlled product.
There were no submissions from affected parties to the screening officer with respect to any of the above claims for exemption and related MSDSs or label.
Each of the claims for exemption listed above was found to be valid. The screening officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that the respective MSDS in respect of which the claims bearing Registry Numbers 5913, 6058, 6059 and 6130 were filed complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.
In the case of the claims bearing Registry Numbers 5839 and 5843, being claims from an employer in the province of Alberta, the screening officer found that the MSDSs relating to these claims did not comply with the applicable disclosure requirements of the Occupational Health and Safety Code of the Province of Alberta.
In the case of the claim bearing Registry Number 6028, being a claim from an employer in the province of Ontario, the screening officer found that the MSDS in respect of which the claim was filed complied with the applicable disclosure requirements of the Occupational Health and Safety Act of the Province of Ontario, while the label in respect of which the claim was filed did not comply with the applicable disclosure requirements of the said act.
Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that the respective MSDS in respect of which the remaining claims were filed did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.
Registry Numbers 5353, 5355 and 5356
The claimant has been ordered to amend certain aspects of the format and content of the MSDS.
In the opinion of the screening officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.
1. Disclose an 8-hour exposure limit value with a skin notation for one of the confidential hazardous ingredients;
2. Disclose that acute exposure to an ingredient in the controlled product has been shown to cause central nervous system depression both in workers and in laboratory animals;
3. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause central nervous system depression, atrophy and necrosis of the thymus, the spleen and the lymph nodes as well as hypoplasia of the bone marrow in laboratory animals;
4. Disclose that chronic ingestion of an ingredient in the controlled product has been shown to cause adverse kidney effects in laboratory animals;
5. Disclose that chronic ingestion of an ingredient in the controlled product has been shown to cause a lowering of fertility in laboratory animals;
6. Disclose that ingredients in the controlled product has been shown to cause fetotoxic effects in laboratory animals in the absence of maternal toxic effects;
7. Registry Number 5353:
(a) Disclose the presence of four additional confidential hazardous ingredients in the controlled product;
(b) Disclose dermal LD50 values for four of the confidential hazardous ingredients in an acceptable manner;
(c) Disclose an LC50 value for one of the confidential hazardous ingredients in an acceptable manner;
(d) Disclose that ingredients in the controlled product have been shown to cause mutagenic effects in mammalian cells, in vitro;
8. Registry Number 5355:
(a) Disclose the presence of an additional confidential hazardous ingredient in the controlled product;
(b) Add skin contact, inhalation and ingestion as routes of entry;
(c) Add strong acids to the list of incompatible materials;
(d) Disclose dermal LD50 values for two of the confidential hazardous ingredients in an acceptable manner;
(e) Disclose an LD50 (oral, rat) value in an acceptable manner for one of the confidential hazardous ingredients or the calculated value of 3 271 mg/kg for the controlled product;
9. Registry Number 5356:

11. Disclose that acetylsalicylic acid synergistically enhances the hearing loss caused by inhalation exposure to toluene in laboratory animals.

5. In relation to the first aid information shown on the MSDS for ingestion, add a statement such as the following: If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration;
6. Amend the statement concerning suitable extinguishing agents to advise that carbon dioxide should not be used;

2. Disclose a pH range of 9–11 for the controlled product.
Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the screening officer has, for each of the above-noted claims, with the exceptions of those claims bearing Registry Numbers 5839, 5843, 5913, 6028, 6058, 6059 and 6130, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the screening officer within 40 days of expiry of the appeal period.
In the case of the claims bearing Registry Numbers 5839 and 5843, the screening officer has ordered the claimant to comply with the provisions of the Occupational Health and Safety Code of the Province of Alberta, except that the information in respect of which the claims for exemption were made does not have to be disclosed, and to provide a copy of the amended MSDS to the screening officer, within the respective time period specified in the foregoing paragraph.
In the case of the claim bearing Registry Number 6028, the screening officer has ordered the claimant to comply with the provisions of the Occupational Health and Safety Act of the Province of Ontario, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended label to the screening officer, within the respective time period specified in the foregoing paragraph.
Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the screening officer, should have been shown on the relevant MSDS or label.
Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.
Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal a decision or order of a screening officer.
