DETERMINATION

Fabricated materials

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2006-019) on October 17, 2006, with respect to a complaint filed by Pelican Products, Inc. (Pelican) of Edmonton, Alberta, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. W0002-07CS02/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of storage and transport cases.

Pelican alleged that PWGSC accepted an alternate product from the successful bidder that did not meet the specifications.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade and the North American Free Trade Agreement, the Tribunal determined that the complaint was not valid.

Amendment to the Exemption order respecting closed circuit video programming undertakings

The Commission amends the Exemption order respecting closed circuit video programming undertakings to ensure that such undertakings do not operate in a manner that prevents a hotel or motel guest, hospital patient or prison inmate from receiving any programming service listed in section 37 of the Broadcasting Distribution Regulations, which sets out the television programming services that must be distributed by direct-to-home (DTH) broadcasting distribution undertakings as part of the basic service.

PUBLIC NOTICE 2006-133

Determination with respect to the marketing and billing practice by which a broadcasting distribution undertaking treats the provision of service to separate dwellings owned by the same person as a single subscription

In Call for comments on the marketing and billing practice known as "account stacking" in the context of the Commission's regulatory framework for broadcasting distribution undertakings, Broadcasting Public Notice CRTC 2006-41, March 31, 2006, the Commission requested comments on the practice whereby a broadcasting distribution undertaking treats the provision of service to two separate residences owned by the same person as a single subscription and remits a wholesale fee to programming services on the basis that only one subscriber is being provided with service.

Having considered the record of the proceeding, the Commission determines that the practice described above is inconsistent with the objectives of the broadcasting policy for Canada as set out in the Broadcasting Act. In order to ensure that the practice ceases, the Commission is amending the applicable distribution and linkage rules, so that when a Class 1, Class 2 or direct-to-home licensee provides a Canadian programming service to a single subscriber at two or more separate dwellings owned or occupied by the same subscriber, the licensee must remit a wholesale fee to the Canadian programming service on a per-dwelling basis.

There were no submissions from affected parties to the screening officer with respect to any of the above claims for exemption and related MSDSs or label.

Each of the claims for exemption listed above was found to be valid with the exception of the claims bearing Registry Numbers 5924 and 5925 which were found to be partially valid. The screening officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that the MSDS in respect of which the claim bearing Registry Number 6029 was filed complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

In the case of the claim bearing Registry Number 5469, being a claim from an employer in the province of Ontario, the screening officer found that the MSDS and the label relating to the claim did not comply with the applicable disclosure requirements of the Occupational Health and Safety Act of the Province of Ontario.

Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that the respective MSDS in respect of which the remaining claims were filed did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Registry Number 5469

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the screening officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose the name, address and emergency telephone number of the user of the controlled product;

2. Add oxides of sulphur and hydrogen sulphide to the list of hazardous combustion products;

3. Disclose that the controlled product is incompatible with strong acids;

4. Remove the LC50 value for the controlled product;

5. Remove the statement in section 6 that the material is not expected to be harmful if absorbed;

6. In relation to the first aid information shown on the MSDS for ingestion, remove the statement to give water to drink;

7. In relation to the first aid information shown on the MSDS for inhalation, disclose a statement to the effect that trained personnel should administer artificial respiration if breathing has stopped and that a physician should be consulted;

In the opinion of the screening officer, certain information should also have been shown on the label. The claimant has been ordered to amend the label as indicated below.

1. Disclose the HMIRC registry number and the date of the decision granting the exemption;

2. In relation to the first aid information shown on the label for ingestion, remove the statement to give water to drink;

3. In relation to the first aid information shown on the MSDS for inhalation, disclose a statement to the effect that trained personnel should administer artificial respiration if breathing has stopped.

In the opinion of the screening officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. Revise the MSDS to show that formaldehyde has been classified as carcinogenic to humans (Group 1) by the International Agency for Research on Cancer (IARC) and reasonably expected to be a human carcinogen (R) by the National Toxicology Program (NTP) of the United States of America;

2. In relation to the period of time shown on the MSDS for flushing the eyes with water should eye contact occur, delete the current reference to "fifteen minutes" and replace it with a time of "at least thirty minutes";

3. In relation to the period of time shown on the MSDS for flushing the skin with water should skin contact occur, delete the current reference to "fifteen minutes" and replace it with a time of "at least thirty minutes." Disclose a statement to the effect that trained personnel should immediately administer artificial respiration or cardiopulmonary resuscitation if breathing has stopped or the heart has stopped;

4. In relation to the first aid information shown on the MSDS for inhalation, disclose a statement to the effect that trained personnel should immediately administer cardiopulmonary resuscitation if the heart has stopped;

5. In relation to the first aid information shown on the MSDS for ingestion, add a statement such as the following: If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration;

6. Add the "SEN" notation to the disclosed ACGIH CEIL value for formaldehyde;

7. Remove the vacated exposure limit value and disclose the Exposure Limit Value ACGIH TLV–TWA = 20 ppm for butanol;

4. In relation to the first aid information shown on the MSDS for inhalation, disclose a statement to the effect that trained personnel should immediately administer cardiopulmonary resuscitation if the heart has stopped.

2. Disclose that hexane synergistically enhances the hearing loss caused by inhalation exposure to xylene in laboratory animals.

Registry Number 6051

In the opinion of the screening officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. In relation to the period of time shown on the MSDS for flushing the eyes with water should eye contact occur, delete the current reference to "fifteen minutes" and replace it with a time of "at least thirty minutes";

2. In relation to the period of time shown on the MSDS for flushing the skin with water should skin contact occur, delete the current reference to "fifteen minutes" and replace it with a time of "at least thirty minutes." Disclose a statement to the effect that trained personnel should immediately administer artificial respiration or cardiopulmonary resuscitation if breathing has stopped or the heart has stopped;

3. In relation to the first aid information shown on the MSDS for ingestion, disclose advice to the effect that the casualty should lean forward should vomiting occur in order to reduce the risk of aspiration. Also disclose a statement to the effect that trained personnel should immediately administer artificial respiration or cardiopulmonary resuscitation if breathing has stopped or the heart has stopped;

4. Disclose an LD50 (oral, rat) value of 612 mg/kg, an LD50 (dermal, rat) value of 251 mg/kg and an LC50 (4 hours, female rat) value of 157 ppm for the confidential hazardous ingredient alkyl amines;

5. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D1B.

Registry Number 6062

In the opinion of the screening officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. In relation to the first aid information shown on the MSDS for ingestion, add a statement such as the following: If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration.

Registry Number 6080

The claimant has been ordered to amend certain aspects of the format and content of the MSDS.

Having regard to the foregoing, and pursuant to sections 16 and 17 of the Hazardous Materials Information Review Act, notice is hereby given that the screening officer has, for the claims bearing Registry Numbers 5924 and 5925, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, including disclosing the identities of three and two ingredients respectively which were included among the information in respect of which the claims for exemption were made, and to provide a copy of the amended MSDS to the screening officer within 40 days of expiry of the appeal period.

Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the screening officer has, for each of the remaining above-noted claims, with the exceptions of those claims bearing Registry Numbers 5469 and 6029, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the screening officer within 40 days of expiry of the appeal period.

In the case of the claim bearing Registry Number 5469, the screening officer has ordered the claimant to comply with the provisions of the Occupational Health and Safety Act of the Province of Ontario, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide copies of the amended MSDS and the amended label to the screening officer, within the respective time period specified in the foregoing paragraph.

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the screening officer, should have been shown on the relevant MSDS or label.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal a decision or order of a screening officer. To initiate the appeal process, a Statement of Appeal (Form 1) as prescribed by the Hazardous Materials Information Review Act Appeal Board Procedures Regulations must be completed and delivered within 45 days of the publication of this notice in the Canada Gazette, Part I, to the acting Chief Appeals Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3, 613-993-4472.

Notice is hereby given, pursuant to the Softwood Lumber Agreement between the Government of Canada and the Government of the United States of America, that on October 12, 2006, the United States withdrew its Request for an Extraordinary Challenge Committee filed on April 27, 2006 (Secretariat File No. ECC-2006-1904-01USA). Therefore, the Request for an Extraordinary Challenge Committee to review the underlying panel decisions in the matter of Certain Softwood Lumber Products from Canada: Final Affirmative Countervailing Duty Determination (Secretariat File No. USA-CDA-2002-1904-03) is terminated on October 12, 2006.
