COORDINATED PUBLIC REVIEW

Deep Panuke Offshore Gas Development Project

The Canada-Nova Scotia Offshore Petroleum Board (CNSOPB) and the National Energy Board (NEB) have received applications from EnCana Corporation (EnCana) to construct and operate its proposed Deep Panuke Offshore Gas Development Project (the Project). To avoid any duplication or confusion generated by separate hearings, the two Boards are coordinating one public process to hear both applications at the same time. Additionally, all comments submitted during this review that fall within the scope of the environmental assessment established by the responsible authorities will be considered in the Comprehensive Study required under the Canadian Environmental Assessment Act.

The Project

The Project includes drilling, production, installation, processing, operating and decommissioning activities offshore and transportation of natural gas. Natural gas from the Deep Panuke field would be transported via either a subsea pipeline that would connect with the existing onshore M&NP pipeline near Goldboro or a subsea pipeline connecting to the existing Sable Offshore Energy Project pipeline.

Public hearing

A public hearing will begin in Halifax on March 5, 2007, at the Marriott Halifax Harbourfront. The public can get involved in one of three ways: by writing a letter of comment on the application, by providing oral comments at the hearing or by registering and participating in the hearing as an intervenor. Letters of comment must be sent to the Secretariat by January 29, 2007. Those wishing to provide oral comments at the hearing must register with the Secretariat by February 19, 2007. Any person wishing to apply for intervenor status with the Secretariat must do so by December 4, 2006, and send a copy to the applicant at EnCana Corporation, Founders Square, Suite 700, 1701 Hollis Street, Halifax, Nova Scotia B3J 3M8. Public consultation sessions

There will be public consultation sessions to describe the participation process and to hear the public's view on issues that should be considered in the review and on the applications themselves. Everyone is welcome to attend these sessions to be held in Halifax, on Monday, November 27, 2006, at 7:30 p.m., at the Marriott Halifax Harbourfront, 1919 Upper Water Street, Halifax, Nova Scotia, and in Guysborough, on Wednesday, November 29, 2006, at 7:30 p.m., at Chedabucto Place, 27 Green Street, Guysborough, Nova Scotia.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Disposable adult incontinence briefs

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on November 22, 2006, from the Acting Director General of the Trade Programs Directorate at the Canada Border Services Agency (CBSA) stating that the President of the CBSA had initiated an investigation into a complaint respecting the alleged injurious dumping of all-in-one (one piece) disposable adult incontinence briefs, which provide absorbent protection against urinary and fecal incontinence and are held in place during use by means of a fastening system, originating in or exported from France.

Pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), the Tribunal has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2006-003) to determine whether the evidence discloses a reasonable indication that the dumping of the subject goods has caused injury or retardation or is threatening to cause injury, as these words are defined in SIMA.

The Tribunal's inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the inquiry must file a notice of participation with the Secretary on or before December 7, 2006. Each counsel who intends to represent a party in the inquiry must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before December 7, 2006.

On December 12, 2006, the Tribunal will distribute the public information received from the CBSA to all parties that have filed notices of participation, and the confidential information to counsel who have filed a declaration and undertaking with the Tribunal.

Submissions by parties opposed to the complaint must be filed on or before December 20, 2006. These submissions should include evidence, e.g. documents and sources that support the factual statements in the submissions, and argument concerning the questions of

  • whether there are goods produced in Canada, other than those identified in the CBSA's statement of reasons for initiating the investigation, that are like goods to the allegedly dumped goods;
  • whether there is more than one class of allegedly dumped goods;
  • which domestic producers of like goods comprise the domestic industry; and
  • whether the information before the Tribunal discloses a reasonable indication that the alleged dumping of the goods has caused injury or retardation, or threatens to cause injury.

The complainant may make submissions in response to the submissions of parties opposed to the complaint by January 3, 2007. At that time, other parties supporting the complaint may also make submissions to the Tribunal.

Parties should note that the Tribunal does not consider exclusion requests during a preliminary injury inquiry, and, therefore, none should be filed at this stage. Should the matter proceed to a final inquiry, particulars regarding the schedule for filing exclusion requests will be included in the notice of commencement of inquiry.

Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made. The Canadian International Trade Tribunal Rules govern these proceedings.

All submissions must be filed with the Tribunal in 25 copies. The Tribunal will distribute the public submissions to all parties that have filed notices of participation and any confidential submissions to counsel who have filed a declaration and undertaking.

The Secretary has sent the notice of commencement of preliminary injury inquiry and the inquiry schedule to the domestic producer, to importers and to exporters with a known interest in the inquiry. Call for comments on a proposed exemption order respecting certain third-language television undertakings

In the public notice, the Commission invites comments on a proposed exemption order respecting certain third-language television undertakings. The undertakings that would be exempted under the proposed order are of a class that is currently licensed as third-language ethnic Category 2 pay and specialty undertakings. The proposal to exempt this class from licensing requirements is based on the Commission's preliminary view that the compliance of these undertakings with licensing requirements will not contribute in a material manner to the implementation of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act.

The Commission invites comments on the proposed exemption order set out in the appendix to this notice and the issues raised in this public notice. The Commission will accept comments that it receives on or before January 5, 2007.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party," for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a workplace, and includes

(a) a supplier of the controlled product;

(b) an employee at the workplace;

(c) an employer at the workplace;

(d) a safety and health professional for the workplace;

(e) a safety and health representative or a member of a safety and health committee for the workplace; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or

(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the workplace.

This application is to export 2 000 MW of firm power, 7 000 GWh per year of firm energy, and 7 000 GWh per year of interruptible energy. The authorization would commence on the date it is issued, for a term of 10 years.

The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The directions on procedure that follow explain in detail the procedure that will be used.

1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at Tiverton, Ontario. Interested parties can contact Mr. Richard Horrobin at 519-361-6561 to obtain a copy of the application. A copy of the application is also available for viewing during normal business hours in the Board's library, 444 Seventh Avenue SW, Room 1002, Calgary, Alberta T2P 0X8.

2. Submissions that any party wishes to present shall be filed with the Secretary of the Board, 444 Seventh Avenue SW, Calgary, Alberta T2P 0X8, 403-292-5503 (fax), and served on the Applicant by January 2, 2007.

3. Pursuant to subsection 119.06(2) of the Act, the Board shall have regard to all considerations that appear to it to be relevant. In particular, the Board is interested in the view of submitters with respect to

(a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported;

(b) the impact of the exportation on the environment; and

(c) whether the Applicant has

(i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and

(ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.

4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by January 17, 2007.
