SPECIAL IMPORT MEASURES ACT
Certain copper pipe fittings — Decision
On January 18, 2007, the President of the Canada Border Services Agency (CBSA) made a final determination of dumping pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA) with respect to certain solder joint pressure pipe fittings and solder joint drainage, waste and vent pipe fittings, made of cast copper alloy, wrought copper alloy or wrought copper, for use in heating, plumbing, air conditioning and refrigeration applications (certain copper pipe fittings) originating in or exported from the United States of America, the Republic of Korea and the People's Republic of China and made a final determination of subsidizing pursuant to paragraph 41(1)(a) of SIMA with respect to certain copper pipe fittings originating in or exported from the People's Republic of China, restricted to the products enumerated in the appendix contained in the Canada Gazette notice dated June 24, 2006, in which the initiation of the investigation was announced.
The goods in question are commonly classified under the following Harmonized System classification numbers:

The Canadian International Trade Tribunal (Tribunal) is continuing its inquiry into the question of injury to the domestic industry and will make an order or finding by February 19, 2007. Provisional duty will continue to apply until this date.
If the Tribunal finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, future imports of subject goods will be subject to anti-dumping duty equal to the margin of dumping, and/or countervailing duty equal to the amount of subsidy on the goods. In that event, the importer in Canada shall pay all such duty. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duty.

PRELIMINARY DETERMINATION OF INJURY
Disposable adult incontinence briefs
In the matter of a preliminary injury inquiry, under subsection 34(2) of the Special Import Measures Act, respecting the dumping of disposable adult incontinence briefs originating in or exported from France
The Canadian International Trade Tribunal, under the provisions of subsection 34(2) of the Special Import Measures Act, has conducted a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2006-003) into whether the evidence discloses a reasonable indication that the dumping of all-in-one (one piece) disposable adult incontinence briefs, which provide absorbent protection against urinary and fecal incontinence and are held in place during use by means of a fastening system, originating in or exported from France has caused injury or retardation or is threatening to cause injury.
This preliminary injury inquiry is pursuant to the notification, on November 22, 2006, that the President of the Canada Border Services Agency had initiated an investigation into the alleged injurious dumping of the above-mentioned goods.
Pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby determines that there is evidence that discloses a reasonable indication that the dumping of the above-mentioned goods has caused injury.

PUBLIC HEARING
TransCanada PipeLines Limited — Application for approval of the Gros Cacouna receipt point
The National Energy Board (NEB) has scheduled an oral public hearing on an application from TransCanada PipeLines Limited (TransCanada) under the National Energy Board Act for approval of the method that would be used to determine the tolls for services from a new receipt point. This new receipt point would allow the reception of regasified liquefied natural gas from Gros-Cacouna, Quebec.
This application is to be distinguished from a future facilities application which may be filed in respect of the construction of pipeline facilities required to connect the proposed Gros Cacouna receipt point to TransCanada's integrated pipeline system.

Project details
TransCanada is applying for the new receipt point at Gros-Cacouna to accommodate a request for service that was submitted by Petro-Canada Oil and Gas who plans to transport regasified liquefied natural gas from Gros-Cacouna using TransCanada's integrated pipeline system.
Public hearing
The public hearing will start on Monday, April 16, 2007, in Québec City, Quebec, at a location yet to be determined. The proceeding will obtain the evidence and views of interested persons on the application. Any person interested in participating in the hearing may do so by either filing an application to intervene or by providing a letter of comment. Hearing Order RH-1-2007 is available on the Board's Internet site for further background and instructions.

To be considered for intervenor status, applications must be submitted by noon (MST), February 2, 2007. The deadline for letters of comment is noon (MST), March 5, 2007.
