Architect and engineering services
The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2007-025) from TPG Technology Consulting Limited (TPG), of Ottawa, Ontario, concerning a procurement (Solicitation No. EN869-040407/A) by the Department of Public Works and Government Services. The solicitation is for engineering and technical services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint. Interested parties were advised of the Tribunal's decision on July 6, 2007.
TPG alleges that the Government improperly modified the evaluation methodology set out in the Request for Proposal after the closing date and that, therefore, bids were not evaluated in accordance with the published evaluation methodology and criteria.

In the decision, the Commission addresses a complaint regarding the apparent non-compliance by Rogers Broadcasting Limited (Rogers) with conditions of licence relating to the broadcast of religious programming on CHNU-TV Fraser Valley. The Commission finds that nine programs broadcast on the station were not consistent with its conditions of licence and directs Rogers to take the measures necessary to ensure that CHNU-TV's program schedule is consistent with those conditions of licence by no later than January 1, 2008. The Commission further indicates its willingness to entertain applications to vary condition of licence 2(a) given the Commission's realization that the condition should reflect the programming realities of the marketplace.

Review of the regulatory frameworks for broadcasting distribution undertakings and discretionary programming services
The Commission will hold a public hearing commencing on January 28, 2008, at 9 a.m., at the Conference Centre, Phase IV, 140 Promenade du Portage, Gatineau, Quebec, to consider the matters addressed in this notice as part of a review of the regulatory frameworks for broadcasting distribution undertakings and discretionary programming services.
The Commission invites written comments and proposals, along with supporting evidence, on the matters for consideration set out below. The Commission anticipates that many of the matters identified will prove suitable to be addressed through written comments and need not be discussed at the hearing.
The deadline for filing comments is October 9, 2007. Parties may file replies to matters raised in the comments and proposals. The deadline for the filing of replies is November 5, 2007. Parties are asked to clearly identify, with rationale, those issues that, in their view, need to be considered at the hearing. The Commission will make a determination as to matters that will be dealt with at the hearing following the intervention period, and parties will be notified of that determination.
