Food and Drug Regulations — Amendments

Interim Marketing Authorization

Provisions currently exist in Table IX to section B.16.100 of the Food and Drug Regulations for the use of acesulfame-potassium and sucralose as sweeteners in a variety of foods at specified levels, including the use of sucralose in unstandardized processed fruit and vegetable products to a maximum level of 0.015%.

Health Canada has received a submission to permit the use of acesulfame-potassium, sucralose or a combination of these sweeteners in standardized canned fruit, including canned apples, peaches, pears, pineapple, grapefruit, and mandarin oranges, and in unstandardized canned fruits, including fruit cocktail, and tropical salad. The maximum level of use for acesulfame-potassium and sucralose in these products would be 0.007% and 0.025%, respectively. Evaluation of available data supports the safety and effectiveness of these sweeteners at the specified levels, either singly or in combination, in canned fruit.

The use of these sweeteners will benefit both consumers and industry by providing a replacement for sweetening agents, thereby helping to reduce the sugar content of canned fruit.

Therefore, it is the intention of Health Canada to recommend that the Food and Drug Regulations be amended to permit the use of acesulfame-potassium to a maximum level of 0.007%, sucralose to a maximum level of 0.025% or a combination of these sweeteners in unstandardized canned fruit and canned fruit that are subject to the standard set out in section B.11.101.

As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate use of acesulfame-potassium and sucralose as sweeteners in canned apples, peaches, pears, pineapple, grapefruit, mandarin oranges, fruit cocktail, and tropical salad to the maximum levels indicated above, while the regulatory process is undertaken to formally amend the Regulations.

The proposed regulatory amendments would be enabling measures to allow the sale of additional foods containing acesulfame-potassium and sucralose as sweeteners. The amendments are supported by the safety assessment and would have low impact on the economy and the environment. Consequently, the regulatory amendments may proceed directly to final approval and publication in the Canada Gazette, Part II.

Interested persons may make representations with respect to Health Canada's intention to amend the Regulations within 75 days after the date of publication of this notice. All such representations must cite the Canada Gazette, Part I, and the date of publication of this notice, and be addressed to the contact person identified below.

Notice is hereby given that Industry Canada is releasing the following amendments:

1. CB-01, Issue 3: Requirements for Certification Bodies. This amendment includes

(a) The replacement of the Recognition Requirements Checklist in Appendix II with a cross reference checklist;

(b) Changes to the contact information in Section 4 and Appendix I; and

(c) Clarifications to the procedural requirements for obtaining departmental recognition (Section 6.1).

2. CB-02, Issue 4: Recognition Criteria, and Administrative and Operational Requirements Applicable to Certification Bodies for the Certification of Radio Apparatus to Industry Canada's Standards and Specifications. This amendment includes

(a) The removal of Appendix I, Cross Reference Checklist; and

(b) Clarification to the notification requirements for certifications performed by CBs (Section 6.4.1).

3. REC-CB, Issue 2: Procedure for the Recognition of Foreign Certification Bodies by Industry Canada. This amendment includes (

(a) Addition of Section 3, Related Documents;

(b) Changes to the contact information in Section 4 and Appendix I;

(c) The replacement of the Recognition Requirements Checklist in Appendix II by a cross reference checklist; and

(d) Updates to the requirements of Section 7, Disclosure of Information, and Section 9, Retaining Recognition, to align them with requirements in CB-01.

These issues will come into effect upon publication of this notice.

Submitting comments

Respondents are requested to provide their comments in electronic format (WordPerfect, Microsoft Word, Adobe PDF or ASCII TXT), along with a note specifying the software, version number and operating system used, to the following email address: telecom.reg@ic.gc.ca.

Written submissions should be addressed to the Deputy Director, Telecommunications Engineering and Certification, Industry Canada, 300 Slater Street, Ottawa, Ontario K1A 0C8.

All submissions should cite the Canada Gazette, Part I, the publication date, the title, and the notice reference number (SMSE-010-07).
