MOTOR VEHICLE SAFETY ACT

Whereas, pursuant to subsection 11(3) of the Motor Vehicle Safety Act (see footnote a), a copy of the proposed Regulations Amending the Motor Vehicle Safety Regulations (Restraint Systems Consequential Amendments), substantially in the form set out in the annexed Regulations, was published in the Canada Gazette, Part I, on July 13, 1996, and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 5 and subsection 11(1) of the Motor Vehicle Safety Act (see footnote b), hereby makes the annexed Regulations Amending the Motor Vehicle Safety Regulations (Restraint Systems Consequential Amendments).
REGULATIONS AMENDING THE MOTOR VEHICLE
SAFETY REGULATIONS (RESTRAINT SYSTEMS CONSEQUENTIAL AMENDMENTS)
AMENDMENTS
1. (1) The definitions "booster cushion" (see footnote 1), "child restraint system" (see footnote 2), "contactable surface" (see footnote 3), "custom restraint system for disabled persons" (see footnote 4), "infant restraint system" (see footnote 5), "production restraint system for disabled persons" (see footnote 6) and "restraint system for disabled persons" (see footnote 7) in subsection 2(1) of the Motor Vehicle Safety Regulations (see footnote 8) are repealed.
(2) The definition "Loi" in subsection 2(1) of the French version of the Regulations is replaced by the following:
" Loi " La Loi sur la sécurité automobile. (Act)
2. Items 213 to 213.3 (see footnote 9) of Schedule III to the Regulations are repealed.
3. The heading (see footnote 10) before section 213 and sections 213 to 213.3 (see footnote 11) of Schedule IV to the Regulations are repealed.

4. These Regulations come into force on March 15, 1998.

Description
At the time this amendment was proposed, the requirements governing "add-on" motor vehicle restraint equipment, which is installed after purchase by users, were contained in the Motor Vehicle Safety Regulations under sections 213, 213.1, 213.2, and 213.3. The new Motor Vehicle Safety Act, which came into force on April 12, 1995, gives the Department of Transport explicit authority over add-on restraint equipment and sets additional requirements with regard to this equipment. As a result, a separate body of regulations, called the Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations, has been created (see footnote c), which renders the requirements contained in the Motor Vehicle Safety Regulations (MVSRs) redundant.
This amendment repeals sections 213, 213.1, 213.2, and 213.3 of the MVSRs, which were entitled "Child Restraint Systems", "Infant Seating and Restraint Systems", "Booster Cushions", and "Restraint Systems for Disabled Persons", respectively. It also rescinds the definitions related to add-on restraint equipment, as they are no longer necessary, and it removes the references to the above sections from Schedule III.
This amendment is effective on March 15, 1998.
Benefits and Costs
The repeal of the sections of the Motor Vehicle Safety Regulations governing add-on restraint equipment will impose no cost on the manufacturers of restraint equipment.
Consultation
Early notice of the Department of Transport's intention to create the Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations was given in the 1995 Federal Regulatory Plan, under Proposal No. TC-68; the repeal of sections 213, 213.1, 213.2, and 213.3 of the Motor Vehicle Safety Regulations is a complementary administrative measure. Restraint equipment manufacturers were informed directly of the Department's intention to make this amendment, which was published in the Canada Gazette Part I on July 13, 1996. Interested parties were given 90 days in which to respond. No comments were received.
