FARM PRODUCTS AGENCIES ACT

Order Amending the Canadian Chicken Marketing Levies Order

Whereas the Governor in Council has, by the Chicken Farmers of Canada Proclamation (see footnote a) , established Chicken Farmers of Canada pursuant to subsection 16(1) (see footnote b)  of the Farm Products Agencies Act (see footnote c) ;

Whereas Chicken Farmers of Canada has been empowered to implement a marketing plan pursuant to that Proclamation;

Whereas the proposed annexed Order Amending the Canadian Chicken Marketing Levies Order is an order of a class to which paragraph 7(1)(d) (see footnote d)  of the Farm Products Agencies Act (see footnote e)  applies by reason of section 2 of the Agencies' Orders and Regulations Approval Order (see footnote f) , and has been submitted to the National Farm Products Council pursuant to paragraph 22(1)(f) of that Act;

And whereas, pursuant to paragraph 7(1)(d) (see footnote g)  of the Farm Products Agencies Act (see footnote h) , the National Farm Products Council is satisfied that the proposed order is necessary for the implementation of the marketing plan that Chicken Farmers of Canada is authorized to implement, and has approved the proposed order;

Therefore, Chicken Farmers of Canada, pursuant to paragraph 22(1)(f) of the Farm Products Agencies Act (see footnote i)  and section 12 (see footnote j)  of the schedule to the Chicken Farmers of Canada Proclamation (see footnote k) , hereby makes the annexed Order Amending the Canadian Chicken Marketing Levies Order.

ORDER AMENDING THE CANADIAN CHICKEN MARKETING LEVIES ORDER

AMENDMENTS

1. The definition ''négociant'' in section 1 of the French version of the Canadian Chicken Marketing Levies Order (see footnote 1)  is replaced by the following:

" négociant " Personne autre qu'un transformateur ou un détaillant qui achète des poulets vivants sur le marché interprovincial ou d'exportation. (dealer)

2. Subsection 2(2) of the Order is amended by striking out the word ''and'' at the end of paragraph (g) and by replacing paragraph (i) with the following:

(i) a producer in the Province of Alberta who produces and markets no more than 2,000 chickens per year, or a communal group within the Province of Alberta with a communal group production quota under a law of that Province to produce no more than 6,000 chickens per year; and

COMING INTO FORCE

3. This Order comes into force on the day on which it is registered.

EXPLANATORY NOTE

(This note is not part of the Order.)

This Order amends the Canadian Chicken Marketing Levies Order to correct typographical errors and to remove a discrepancy between the English and French versions.
