Whereas the Canadian Radio-television and Telecommunications Commission rendered Broadcasting Decision CRTC 2002-377 on November 19, 2002, which approved the licence renewal applications by Cable Public Affairs Channel Inc. (CPAC);
Whereas, subsequent to the rendering of Decision CRTC 2002-377, the Governor in Council received a petition requesting that the Decision be set aside or referred back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing of the matter by the Commission;
And whereas the Governor in Council, having considered the petition, is not satisfied that Decision CRTC 2002-377 derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act (see footnote a) ;
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act (see footnote b) , hereby declines to set aside Decision CRTC 2002-377 of November 19, 2002 or to refer it back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing.
