AN ACT TO AMEND THE CRIMINAL CODE (FIREARMS) AND THE FIREARMS ACT

Order Fixing May 30, 2003 as the Date of the Coming into Force of Certain Sections of the Act

Her Excellency the Governor General in Council, on the recommendation of the Solicitor General of Canada, pursuant to section 57 of An Act to amend the Criminal Code (firearms) and the Firearms Act, assented to on May 13, 2003, being chapter 8 of the Statutes of Canada, 2003, hereby fixes May 30, 2003 as the day on which section 1, subsections 2(1) and 9(2) and sections 48 to 50 of that Act come into force.

EXPLANATORY NOTE

An Act to amend the Criminal Code (firearms) and the Firearms Act ("the Act") was assented to on May 13, 2003. The Act amends the Firearms Act and Part III of the Criminal Code. It streamlines processes related to the issuance of various documents under the Firearms Act, creates the position of Commissioner of Firearms, grandfathers prohibited handguns to individuals and businesses who registered or recorded them before the effective date of the prohibition, and provides a mechanism for making regulations to allow Canada to ratify international agreements related to firearms.

This Order brings into force section 1, subsections 2(1) and 9(2) and sections 48 to 50 of the Act.

Subsection 2(1) of the Act defines the term "Commissioner of Firearms" for the purposes of the Criminal Code, while subsection 9(2) of the Act defines that position for the purposes of the Firearms Act. Section 48 of the Act creates the position of the Commissioner of Firearms and provides for appointment. Section 49 provides for the appointment of the Registrar of Firearms while section 50 amends the provisions for reporting to Parliament presently contained in the Firearms Act to give authority to the Commissioner to complete the report.
