BROADCASTING ACT

Whereas the Canadian Radio-television and Telecommunications Commission rendered Broadcasting Decision CRTC 2003-115 on April 17, 2003, which approved the application by 3885275 Canada Inc., carrying on business as Canadian Multicultural Radio, for a broadcasting licence for an ethnic FM radio station in Toronto operating at a frequency of 101.3 MHz;
Whereas the Governor in Council received petitions requesting that the Decision be set aside or referred back to the Commission for reconsideration and hearing of the matter;
And whereas the Governor in Council is not satisfied that the Decision derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act (see footnote a) ;
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Acting Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act (see footnote b) , hereby declines to set aside or refer back to the Commission for reconsideration and hearing Broadcasting Decision CRTC 2003-115 of April 17, 2003.
