EXPLANATORY NOTE
(This note is not part of the Regulations.)
The Sex Offender Information Registration Act ("the Act") provides for the creation of a national sex offender registry database, which is to be maintained by the Royal Canadian Mounted Police. The Act further provides that the Lieutenant Governor in Council of a province may make regulations concerning certain specified elements of the registration system in that province.
The British Columbia Sex Offender Information Registration Regulations ("the Regulations") will come into force on the later of the day on which the Act comes into force and the day on which the Regulations are registered. The Regulations provide for the following in the Province of British Columbia:
(a) a means by which sex offenders may provide notification under the Act;
(b) the authorization of persons to collect information from sex offenders;
(c) the authorization of persons to register information collected from sex offenders; and
(d) the designation of places as registration centres in British Columbia and the areas served by those centres.
After royal assent to the Act, the RCMP and municipal police forces in British Columbia were consulted with respect to the proposed Regulations. Notice with respect to specific obligations will be provided to sex offenders under the Criminal Code.
