COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Carbon steel welded pipe

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on January 23, 2008, from the Director General of the Trade Programs Directorate at the Canada Border Services Agency (CBSA) stating that the President of the CBSA had initiated an investigation into a complaint respecting the alleged injurious dumping and subsidizing of carbon steel welded pipe, commonly identified as standard pipe, in the nominal size range of 1/2 in. up to and including 6 in. (12.7 mm to 168.3 mm in outside diameter) inclusive, in various forms and finishes, usually supplied to meet ASTM A53, ASTM A135, ASTM A252, ASTM A589, ASTM A795, ASTM F1083 or Commercial Quality, or AWWA C200-97 or equivalent specifications, including water well casing, piling pipe, sprinkler pipe and fencing pipe, but excluding oil and gas line pipe made to API specifications exclusively, originating in or exported from the People's Republic of China.

Pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), the Tribunal has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2007-002) to determine whether the evidence discloses a reasonable indication that the dumping and subsidizing of the subject goods have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA.

The Tribunal's inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the inquiry must file a notice of participation with the Secretary on or before February 6, 2008. Each counsel who intends to represent a party in the inquiry must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before February 6, 2008.

On February 14, 2008, the Tribunal will distribute the public information received from the CBSA to all parties that have filed notices of participation, and the confidential information to counsel who have filed a declaration and undertaking with the Tribunal.

Submissions by parties opposed to the complaint must be filed no later than noon on February 22, 2008. These submissions should include evidence, e.g. documents and sources that support the factual statements in the submissions, and argument concerning the questions of

  •   whether there are goods produced in Canada, other than those identified in the CBSA's statement of reasons for initiating the investigation, that are like goods to the allegedly dumped and subsidized goods;
  •   whether there is more than one class of allegedly dumped and subsidized goods;
  •   which domestic producers of like goods comprise the domestic industry; and
  •   whether the information before the Tribunal discloses a reasonable indication that the alleged dumping and subsidizing of the goods have caused injury or retardation, or threaten to cause injury.

The complainants may make submissions in response to the submissions of parties opposed to the complaint by March 3, 2008. At that time, other parties supporting the complaint may also make submissions to the Tribunal.

Parties should note that the Tribunal does not consider exclusion requests during a preliminary injury inquiry and, therefore, none should be filed at this stage. Should the matter proceed to a final inquiry, particulars regarding the schedule for filing exclusion requests will be included in the notice of commencement of inquiry.

Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made. (See Procedural Guidelines for the Designation and Use of Confidential Information in Canadian International Trade Tribunal Proceedings available on the Tribunal's Web site at www.citt-tcce.gc.ca.)

The Canadian International Trade Tribunal Rules govern these proceedings.

All submissions must be filed with the Tribunal in 25 copies. The Tribunal will distribute the public submissions to all parties that have filed notices of participation and any confidential submissions to counsel who have filed a declaration and undertaking.

The Secretary has sent the notice of commencement of preliminary injury inquiry and the inquiry schedule to the domestic producers, to importers and to exporters with a known interest in the inquiry. The notice and schedule of key inquiry events are available on the Tribunal's Web site at www.citt-tcce.gc.ca.

The subjects of the claims on which the screening officer issued the decisions are the chemical identity of three ingredients and the concentration of four ingredients, the chemical identity of two ingredients and the concentration of three ingredients, the chemical identity of three ingredients and the concentration of four ingredients and the chemical identity of four ingredients and the concentration of five ingredients, respectively.

There were no submissions from affected parties to the screening officer with respect to any of the above claims for exemption and related MSDSs.

Each of the claims for exemption listed above was found to be valid. The screening officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that the MSDS in respect of which the claim bearing Registry Number 6635 was filed complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

In the case of the claims bearing Registry Numbers 6170, 6306 and 6413 being claims from an employer in the province of Alberta, the screening officer found that the MSDSs relating to these claims did not comply with the applicable disclosure requirements of the Occupational Health and Safety Code 2006 of the Province of Alberta.

Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that the respective MSDS in respect of which the remaining claims were filed did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Registry Number 6036

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the screening officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose a lower LD50 value for one of the confidential hazardous ingredients in an acceptable manner;

2. Disclose a lower Exposure Limit Value ACGIH TLVߝTWA (C) for one of the confidential hazardous ingredients;

9. Disclose an LD50 (oral, rat) value of 10 600 mg/kg and an LC50 (4 hours, rat) value of 31 600 ppm for ethanol;

10. Disclose an LD50 (oral, rat) value of 2.51 g/kg for n-butyl alcohol;

14. Disclose that an ingredient in the controlled product is considered to be a germ cell mutagen based on positive results in in vivo screening tests and that it has been shown to cause mutagenic effects in human cells, in vitro;

15. Disclose that acetylsalicylic acid synergistically enhances the hearing loss caused by exposure to toluene in laboratory animals.

Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the screening officer has, for each of the above-noted claims, with the exceptions of those claims bearing Registry Numbers 6170, 6306, 6413 and 6635, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the screening officer within 40 days of expiry of the appeal period.

In the case of the claims bearing Registry Numbers 6170, 6306 and 6413, the screening officer has ordered the claimant to comply with the provisions of the Occupational Health and Safety Code 2006 of the Province of Alberta, except that the information in respect of which the claims for exemption were made does not have to be disclosed, and to provide a copy of the amended MSDS to the screening officer, within the respective time period specified in the foregoing paragraph.

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the screening officer, should have been shown on the relevant MSDS.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal a decision or order of a screening officer. The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, “affected party,” for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a work place, and includes

(a) a supplier of the controlled product;

(b) an employee at the work place;

(c) an employer at the work place;

(d) a safety and health professional for the work place;

(e) a safety and health representative or a member of a safety and health committee for the work place; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or

(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3.
