CANADA-NOVA SCOTIA OFFSHORE PETROLEUM RESOURCES ACCORD IMPLEMENTATION ACT
Prohibition order — Donkin Coal Block Area
The Canada-Nova Scotia Offshore Petroleum Board has issued an order prohibiting the issuance of petroleum licences over the portion of the offshore area known as the Donkin coal block. Under the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act and the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation (Nova Scotia) Act, an order such as this is a fundamental decision. The Federal Minister of Natural Resources and the Provincial Minister of Energy have approved the Board’s decision to issue the order.
This order will prevent competing resource development issues from arising in the event that the development of coal reserves that are found in the Donkin coal block area proceeds.
The Donkin coal block area is located off the coast of Cape Breton Island near the community of Donkin. For a legal description of the area under prohibition order, please refer to the Board’s Web site at www.cnsopb.ns.ca.

DETERMINATION

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File Nos. PR-2007-080 to PR-2007-083) on April 29, 2008, with respect to complaints filed by NETGEAR, Inc. (Netgear), of Santa Clara, California, U.S.A., under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning procurements (Solicitation Nos. EN869-060331/J [RVD157], EN869-060331/V [RVD165], EN869-060331/U [RVD166] and EN869-060331/W [RVD174]) by the Department of Public Works and Government Services (PWGSC). The solicitation was for networking equipment.
Netgear alleged that PWGSC improperly conducted the above-noted solicitations.
Having examined the evidence presented by the parties and considered the provisions of the North American Free Trade Agreement, the Tribunal determined that the complaints were not valid.
Further information may be obtained from the Secretary, Canadian International Trade Tribunal, Standard Life Centre, 15th Floor, 333 Laurier Avenue W, Ottawa, Ontario K1A 0G7, 613-993-3595 (telephone), 613-990-2439 (fax), secretary@citt-tcce.gc.ca (email).
