Replacement Class Screening Report: Minor Transportation Projects — Public notice

The Canadian Environmental Assessment Agency (the Agency) declares the report entitled Minor Transportation Projects to be a replacement class screening report (RCSR) pursuant to the provisions of subsection 19(1) and paragraph 19(2)(a) of the Canadian Environmental Assessment Act (the Act).

Public consultations on the RCSR took place from January 21 to February 19, 2008. The Agency received two written submissions from the public concerning the RCSR. Any public comments were subsequently forwarded to Transport Canada (TC) and addressed, where appropriate, in the RCSR. In making the declaration proposed by TC and Infrastructure Canada (INFC), the Agency has reviewed the RCSR and has determined that the project screening process, as described in the document, will meet the requirements of the Act for the environmental assessment of the class of projects. It is also the Agency’s opinion that the class of projects described in the RCSR is not likely to cause significant adverse environmental effects when the design standards and mitigation measures described in the report are applied.

The declaration is effective June 14, 2008, and is subject to the following terms and conditions:

  • Subject to subsection 19(8) of the Act, the declaration period is valid until June 14, 2013.
  • TC and/or INFC will notify the Agency, in writing, a minimum of six months prior to the date on which the declaration expires, of their intention to re-declare the RCSR, to re-declare the RCSR with modifications or additions, or not to re-declare the RCSR and, thereby, allow the declaration to expire.
  • To re-declare the RCSR, TC and/or INFC will submit the proposed RCSR to the Agency no less than three months prior to the expiration date of this declaration, so that the Agency may initiate a new declaration process.
  • TC, INFC and the Agency will ensure that the RCSR is made available to the public in accordance with the requirements of the Act, as the RCSR may be amended from time to time. As such, TC and INFC will place the RCSR in the Canadian Environmental Assessment Registry (CEAR) project file. On a quarterly basis, TC or INFC will also post on the CEAR Web site a statement of the projects in respect of which the RCSR was used, as required under paragraph 55.1(2)(d) of the Act. The quarterly schedule for posting on the CEAR Web site is contained in section 1.5 of the RCSR.
  • Any amendments to the report will be developed and implemented in accordance with the provisions for amendment contained in section 6.0 of the RCSR.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

COMMENCEMENT OF INVESTIGATION

Woven polyester fabric

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) is satisfied that the request (Request No. TR-2007-006) received from Peerless Clothing Inc. (the requester) of Montréal, Quebec, is properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of woven fabric, plain weave, dyed, of untwisted textured polyester filament yarns in the weft and untwisted non-textured polyester filament yarns in the warp, of a weight not exceeding 55 g/m2, of tariff item No. 5407.69.90, for use as knee lining in the manufacture of trousers (the subject fabric). The requester has asked the Tribunal to conduct its investigation expeditiously. The Tribunal has examined the request and is not persuaded that the circumstances constitute critical circumstances. However, barring any opposition to the request, the Tribunal intends to conduct its investigation as expeditiously as possible.

The Tribunal will conduct an investigation under section 19 of the Canadian International Trade Tribunal Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabric, which is classified under tariff item No. 5407.69.90.

The Tribunal’s investigation commenced on June 4, 2008, and will be conducted by way of written submissions. To participate in the Tribunal’s investigation, the requester or an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before June 23, 2008. The Tribunal’s recommendations to the Minister of Finance are scheduled to be issued by September 10, 2008.

Parties and the public may file documents electronically with the Tribunal through its Secure E-filing Service. The service utilizes the Government of Canada’s epass system, which allows the secure transmission of confidential business information. The information is fully encrypted from the sender to the Tribunal.

However, parties must still file paper copies in the required number as instructed. Where a party is required to file hard copies, the electronic version and the hard-copy version must be identical. In case of discrepancies, the hard-copy version will be considered the original.

Headingley, Manitoba Application No. 2007-1713-4

Application by Videon Cablesystems Inc. (Videon) to renew the Class 3 licence of its cable broadcasting distribution undertaking serving Headingley, expiring August 31, 2008.

c) The licensee is authorized to distribute the following signals on a digital discretionary basis:

  • a second set of signals that provides the programming of the four U.S. commercial networks (CBS, NBC, ABC, FOX) and the non-commercial PBS network (hereafter referred to as the U.S. 4+1 signals).

The distribution on a discretionary basis on the licensee’s digital service of a second set of U.S. 4+1 signals is subject to the provision that, with respect to such signals, the licensee adhere to the requirements regarding non-simultaneous program deletion set out in section 43 of the Broadcasting Distribution Regulations. The Commission may suspend the application of this provision upon its approval of an executed agreement between the licensee and broadcasters. Such an agreement must deal with issues related to the protection of program rights arising in connection with the discretionary carriage of a second set of U.S. 4+1 signals solely on the licensee’s digital service.

d) The licensee is authorized to receive, directly through its own facilities, at its option, any of the distant Canadian signals and U.S. 4+1 signals that are otherwise required to be received from a licensed satellite relay distribution undertaking. The licensee is not authorized to use any facilities other than its own for the reception of these signals. This condition does not authorize the licensee to provide these services to any other licensed or exempt distribution undertaking.
